suggestion: the issue in the given situation is whether the revocation of offer is effective or not. Section 2(h) of the Contracts Act 1950 defines contract as an agreement enforceable by law.its legally binding between parties. In order for an agreement to be enforceable by law, it must consist of six essential elements which are offer, acceptance, consideration, intention to create legal relation, capacity and certainty. Offer is defined in Section 2(a) of the Contracts Act as something which is capable of being converted into an agreement by its acceptance. in section 5(1) Contract Act: A proposal may be revoked at any time before the communication of its acceptance is complete as against the proposer, but not afterward. In the event of acceptance by post or telegram, the acceptance is complete as against the proposer upon posting or delivery of the telegram. In the case of Byrne v. Tienhoven :the dependent posted a letter of offer to the plaintiff on 1 Oct. On 8 Oct., dependent posted a letter revoking the offer. On 11 Oct., the plaintiff receive the letter of the offer and sent his acceptance by telegram the same day. only on 20 Oct. did the dependent's letter of revocation was received by plaintiff.therefore,there is contract between the parties. thus,there is contract between Peter Pan and Captain Hook. the revocation of offer posted on 22 April 2011 was not effective till 30th April when Captain Hook receive it. but in the meantime, the Captain Hook had already accepted the offer on 26th April. In conclusion the offer was already accepted. 2) Advise Captain Hook whether there is a contact between him and wendy. suggested solution : the issue is whether there is contact between Captain Hook and Wendy. A counter-proposal is treated as a rejection of original proposal. In the case of Hyde v Wrench: the dependent offered to sell his land to plaintiff for 1000 pounds. plaintiff made a counter-proposal to buy at 950 pounds. Defendant refuse to accept his proposal.plaintiff then wanted the original proposal.No acceptance

thus,three is no acceptance. Wendy made a counter-proposal to Captain Hook which reject the original proposal. In conclusion there is no contract. which means Captain Hook is free to offer to whom ever he wants
