L0541 The movie was about a woman named Slim (played by Jennifer Lopez) who thought that a fantasy-like family life would forever be hers. However, when she caught her husband having an illicit relationship with another woman, the agony started and she soon witnessed herself trapped in a tormenting world she never thought could exist. Let us try to connect several scenes from the film step by step- that is, as the show progresses. When Slim told her family and friends that she was being tortured by her husband, the latter planned to rescue the former. However, when Slim was about to leave the house for good, the husband caught her and commenced another series of violent actions. Because of this, the father and friends of Slim waiting outside the house entered such forcibly. According to the Revised Penal Code, this, even if considered as trespassing, is an absolutory cause. There was also an instance in the film when the house of Slim's friend (where Slim temporarily dwelled) was searched by fake FBI. No search warrant was shown. The fake FBI unlawfully entered the house, and even deliberately caused damaged to several properties thereon. Assuming a crime has been committed, i.g. murder, robbery, etc., that would be an aggravating circumstance for disregard of dwelling.

Further, we could also consider this act of the FBI as unlawful aggression against property, which would entitle the dwellers a mitigating circumstance (supposed the FBI were killed by the dwellers) since it is not coupled with aggression against life. On a different perspective, it could also be said that the FBI has done sufficient provocation; enough to irritate the dwellers. When Slim was still running and hiding from her husband, the latter ordered a police officer to pursue Slim at any cost. We cannot say that the police officer's action is a natural consequence of being a police in pursuit of an "alleged" fugitive. Were it now for the superb driving skills of Slim, they could have been killed by the police officer. Thus, there is no EXEMPTING CIRCUMSTANCE of performance of a duty. In the same scenario, the husband's act of inducing the police officer to commit a crime rendered him a PRINCIPAL BY INDUCTION. The material executor, obviously, was a PRINCIPAL BY DIRECT PARTICIPATION. The husband also tried to enter the new dwelling of Slim. Here, the aggravating circumstance of disrespect of dwelling was considered. Since the very purpose of the entry was to kill Slim, the husband would be guilty of ATTEMPTED MURDER because an overt act has already been made, yet it had not passed on the subjective phase of the crime. There was also an obvious disregard on GENDER (as far as Slim is concerned) and AGE (as far as the daughter was concerned) when their car was being deliberately bumped by the police officer then pursuing them.

Further more, when Slim decided to face the original malefactor by breaking into the latter's new house, there were sets of mitigating and aggravating circumstances. MITIGATING CIRCUMSTANCES: Slim was suffering from a BATTERED WIFE SYNDROME. This is one of the analogous cases provided in paragraph ten of the Mitigating Circumstances. VINDICATION FOR A GRAVE OFFENSE is also tenable since Slim suffered grave offenses- recurrent torture- and this would never be affected even if there has already been an interval of time so long as it is not that unreasonable to negate its existence. AGGRAVATING CIRCUMSTANCES: There was a DISRESPECT OF DWELLING when Slim illegally broke in. The crime was also committed at night. There was an evident premeditation. As a matter of fact, Slim prepared for the attack for approximately 30 days. Slim intentionally destroyed the husband's properties. The crime was done with craft. The crime was committed after an unlawful entry. JUSTIFYING CIRCUMSTANCES The contention of Slim that what she was doing was self-defense has given sufficient provocation. If any, she would be entitled to the privilege mitigating circumstance of INCOMPLETE SELF-DEFENSE.

More so, there was an agreement to fight. So long as the aggression happens at the stipulated time and place of fight, there was no unlawful aggression. Lastly, when the policemen arrived, the non-flight of Slim did not constitute VOLUNTARY SURRENDER. The very objective of voluntary surrender is to spare the authorities from unnecessary expense and efforts. Slim did not claim that she was responsible for the crime. Hence, she could not avail of this mitigating circumstance if she got arrested.
