By capacity it is meant the eligibility to enter into contracts Minors (under 18), People who are drunk or insane have limitations to enter into a contract.

The general principle is that a contract made by a minor with an adult is binding on the adult but not on the minor

Family Law Reform Act 1969 defines a Minor as any one under the age of 18. BUT* Infants Relief Act consider an Infant as any one under the age of 21 Marriage Ordinance allows to marry at 17 21 above allowed to smoke 16 and above could be employed.
