Last September we shared with you our proposal for the local CHP to use radar on the streets in Serrano to control speeding. With over 50 miles of private streets, keeping our streets safe is a big responsibility and speeding is one of the biggest complaints that owners express. In order for the CHP to enforce a 25 MPH speed limit on our private streets, there are stop signs that need to be added. Our original proposal was discussed at the September Board meeting. Several members wrote to the Board or attended the meeting and shared a variety of opinions about that proposal. After considering all input, we have reworked that proposal. Locations that received specific objections were re-evaluated resulting in several proposed stop sign locations being moved to alternate intersections. Association staff has prepared the following presentation to help you visual our current proposal. By scrolling to your village map and then clicking on the intersections that interest you most, you can view an approximation of the stop sign locations. The Association Board is scheduled to consider this matter at their 5:00 PM meeting on April 25, 2013. Please send your comments to the Board in writing before the meeting. Prima Facie Speed Limit Details


25 MPH PRIMA FACIE SPEED LIMITS ON PRIVATE ROADS: CALIFORNIA SPEED LAW The primary legal justification for Vehicle Code enforcement in California is the CVC. All states base their speed regulations on the Basic Speed Law: No person shall drive a vehicle at a speed greater than is reasonable or prudent and in no event at a speed which endangers the safety of persons or property (CVC 22350). State law also establishes maximum speed limits. For example, the maximum speed on an undivided two-lane roadway is 55 MPH, (CVC 22349b). Currently, the Serrano Private Roads are classified as undivided two-lane roadways. All other speed limits are called prima facie limits, which are considered by law to be safe and prudent under normal conditions. Certain prima facie limits are established by State law and include the 25 MPH speed limit in business and residential districts and the 25 MPH in school zones when children are present. [Residence district speed limits do not need to be posted to be enforceable.] Local authorities have authority to establish reduced speed limits on the basis of engineering and traffic surveys (CVC 22358). Such surveys must include an analysis of roadway conditions, accident records, and a sampling of the prevailing speed of traffic (CVC 627). Other factors may be considered, but an unreasonable speed limit, which is called a speedtrap, may not be established (CVC 40802). RESIDENTIAL AREAS The most common concerns about speeding generally originate from residential areas. Twenty-five MPH speed limit signs may be posted on residential streets without conducting a speed survey, if the street or segment of street being considered (CVC 515) meets the following: 1. Width cannot exceed 40 feet. 2. Uninterrupted length cannot be more than one half mile; interruptions include official traffic control devices such as stop signs and traffic signals. 3. There can be only one traffic lane in each direction. STOP SIGNS The Stop Signs being proposed will interrupt lengths of roadways in the Serrano Community that are currently longer than one half mile. Upon completion of the Stop Sign and traffic marking installation, most of the private streets in Serrano will meet the California Vehicle Code (CVC) definition of a Residence District. The C HP will enforce the 25 MPH Prima Facie Residence District speed limit on all Serrano roads that have a uninterrupted length of less than one half mile.(CVC Section 22352 Prima Facie Speed Limits) Prima Facie Speed Limits 22352. (a) The prima facie limits are as follows and shall be applicable unless changed as authorized in this code and, if so changed, only when signs have been erected giving notice thereof: (2) Twenty-five miles per hour: (A) On any highway other than a state highway, in any business or residence district unless a different speed is determined by local authority under procedures set forth in this code. (B) When approaching or passing a school building or the grounds thereof, contiguous to a highway and posted with a standard "SCHOOL" warning sign, while children are going to or leaving the school either during school hours or during the noon recess period. The prima facie limit shall also apply when approaching or passing any school grounds which are not separated from the highway by a fence, gate, or other physical barrier while the grounds are in use by children and the highway is posted with a standard "SCHOOL" warning sign. For purposes of this subparagraph, standard "SCHOOL" warning signs may be placed at any distance up to 500 feet away from school grounds. (C) When passing a senior center or other facility primarily used by senior citizens, contiguous to a street other than a state highway and posted with a standard "SENIOR" warning sign. A local authority is not required to erect any sign pursuant to this paragraph until donations from private sources covering those costs are received and the local agency makes a determination that the proposed signing should be implemented. A local authority may, however, utilize any other funds available to it to pay for the erection of those signs. (b) This section shall become operative on March 1, 2001.
