AN ACT PREVENTING AND PENALIZING CARNAPPING

Anti-Carnapping Act of 1972


Republic Act No. 6539

DEFINITION OF TERMS
CARNAPPING taking, with intent to gain, of a motor vehicle belonging to another without the latters consent, by means of: a) Violence against or intimidation of persons; or b) By using force upon things.

MOTOR VEHICLE any vehicle propelled by any power other than muscular power using the public highways, but excepting: a) Road rollers, trolley cars, street-sweepers, sprinklers, lawn mowers, bulldozers, graders, forklifts, amphibian trucks, and cranes, if not used on public highways; b) vehicles which only run on rails or tracks, and tractors, trailers and traction engines of all kinds, used exclusively for agricultural purposes.

DEFACING OR TAMPERING the erasing, scratching, altering or changing of the original factoryinscribed serial number on the motor vehicle engine, engine block or chassis of any motor vehicle. - if the serial number is different from the number listed in the Bureau of Customs, deemed defaced or tampered.
REPAINTING changing of the color of a motor vehicle. - there is repainting when the new color of the motor vehicle is different from its registered color with the LTO.

BODY-BUILDING a job undertaken on a motor vehicle in order to replace its entire body with a new body. REMODELLING introduction of some changes in the shape or form of the body of the motor vehicle.

DISMANTLING tearing apart, piece by piece or part by part, of a motor vehicle.

OVERHAULING cleaning or repairing of the whole engine of a motor vehicle by separating the motor engine and its parts from its body.

IMPORTANT POINTS
- Registration of sale, transfer, conveyance, substitution
or replacement of a motor vehicle engine with the LTO;
-Assembled or rebuilt motor vehicle, registration within

one-week after completion; secure clearance with the PNP and register with the LTO;
- PNP Clearance for assembly/rebuilding of motor

vehicle;
Imported motor vehicles, Bureau of Customs to report LTO within 7 days;

PENALTIES IMPOSED
1. 2 years to 6 years imprisonment and a fine equal to the acquisition cost of the motor vehicle involved To any person violating provisions of the Act; - for government employee/official, dismissal, disqualification from voting and being voted, and from appointment to any public office; - for alien offenders, deportation after service of sentence;

PENALTIES IMPOSED
2. For Carnapping: a) 14 years and 8 months to 17 years and 4 months imprisonment if committed w/o violence against or intimidation of persons, or force upon things; b) 17 years, 4 months and 1 day to 30 years imprisonment if committed by means of violence against or intimidation of any person, or force upon things; and c) Life imprisonment to Death when the owner, driver or occupant is killed/raped/serious physical injuries inflicted
