Petitioners seek the annulment of a directive from President Gloria Macapagal-Arroyo enjoining them and other military officers from testifying before Congress without the Presidents consent.
Petitioners pray for the injunctive relief against a pending preliminary investigation against them, in preparation for possible court-martial proceedings, initiated within the military justice system in connection with petitioners violation of the aforementioned directive.

All officers and soldiers in the active service of the AFP are subject to military law.

No constitutional provision or military indoctrination will eliminate a soldiers ability to form a personal political opinion, yet it is vital that such opinions be kept our of the public eye.
Petition is DENIED Because of their honest belief that they defied a direct order of their Commander-in-Chief which can cannot be lightly ignored.

RESOLUTION DIRECTING THE PROPER SENATE COMMITTEE TO CONDUCT AN INQUIRY, ON THE LEGAL AND ECONOMIC JUSTIFICATION OF THE NATIONAL BROADBAND NETWORK (NBN) PROJECT OF THE NATIONAL GOVERNMENT.
Issue: Whether or not the claim regarding the exercise of executive privilege is valid.
Sec. 7, Art. III (The right of the people to information on matters of public concern)
Sec. 1, Art. XI (Public office is a public trust) Sec. 17, Art. VII (The President shall ensure that the laws be faithfully executed)
The first is rooted in the constitutional principle of separation of power and the Presidents unique constitutional role.
Thus, while Congress is composed of representatives elected by the people, it does not follow, except in a highly qualified sense, that in every exercise of its power of inquiry, the people are exercising their right to information.
Petition is GRANTED
A fact worth highlighting is that petitioner is not an unwilling witness. He
manifested several times his readiness to testify before respondent Committees. He refused to answer the three (3) questions because he was ordered by the President to claim executive privilege.
