The Special Protection of Children Against
Child Abuse, Exploitation and Discrimination
Act or Republic Act 7610 (Art.1 Sec. 3) defines
child abuse as maltreatment, whether
habitual or not.
A person who is below 18 years old or
those over but are unable to fully take care
of themselves from abuse, neglect, cruelty,
exploitation or discrimination because of
physical or mental disability or condition.


By a person who is responsible for the
child's welfare. Under circumstances which
gravely threaten or endanger the survival
and normal development of children.

CHILD
a person below 18 years of
age
over 18 years of age but is
unable to fully take care of
herself/himself from abuse,
neglect, cruelty, exploitation
or discrimination because of
a physical or mental disability
or condition.

CHILD ABUSE
the maltreatment, whether habitual
or not, of a child, which includes any
of the following:
Psychological and physical abuse,
neglect, cruelty, sexual abuse and
emotional maltreatment;
Any act by deeds or words which
debases, degrades or demeans the
intrinsic worth and dignity of a
child as a human being;

Unreasonable deprivation of
the her/his basic needs for
survival such as food and
shelter;
Failure to immediately give
medical treatment to an injured
child resulting in serious
impairment of her/his growth
and development or in her/his
permanent incapacity or death.

FORMS OF CHILD ABUSE

PHYSICAL ABUSE - an act that includes but
is not limited to lacerations, fractured
bones, burns, internal injuries, severe
injury or serious bodily harm suffered by a
child. This may be classified into slight
physical injury, less serious physical injury,
or serious physical injury.

PSYCHOLOGICAL ABUSE - harm to a childs
psychological or intellectual functioning
which may be exhibited by severe anxiety,
depression, withdrawal or outward
aggressive behavior, or a combination of
said behaviors, which may be
demonstrated by a change in behavior,
emotional response or cognition.

EMOTIONAL ABUSE (CRUELTY) - an act by
word or deed which desists, degrades or
demeans the intrinsic worth and dignity of
a child as a human being.

NEGLECT - failure to provide, for reasons
other than poverty, adequate food,
clothing, shelter, basic education or
medical care so as to seriously endanger
the physical, mental, social and emotional
growth and development of the child.

CHILD LABOR - the illegal employment of
children below 15 years old, or those
below 18 years old in hazardous
occupation.

another person to engage in sexual
intercourse or lascivious conduct, or the
molestation, prostitution, or incest with

RAPE - an act committed:
a. By a man who shall have carnal knowledge of a child
under any of the following circumstances:

when the child is deprived of reason, or otherwise
unconscious;
by means of fraudulent machination or grave abuse of
authority; and
when the offended party is under 12 years of age or is
demented, even though none of the circumstances
mentioned above be present.

b. By any person who, under any of the
circumstances mentioned in par. 1 hereof, shall
commit an act of sexual assault by inserting the
penis into a childs mouth or anal orifice, or any
instrument, object, or any other part of the
body such as fingers or toes into the genital or
anal orifice of a child.

fourth degree of consanguinity or affinity and

children, whether male or female, who for
money, profit, or any other consideration, or
due to the coercion or influence of any adult,

or lascivious conduct.

dealing with children, including but not limited
to, the buying and selling of children for money,

under 18 years of age committed by means of
deceit and persuasion.
