An Investigation
Introduction
On the 14
th
August, 2013 a complaint of Noise
Nuisance was filed by Mrs. So-and-so and Mrs.
Whatever against Mr. A of 28 Sandy Babb
Street. Mr. A possesses a liquor licence and is
the owner/manager of the Underground
Station a discothque situated at the same
location. On August 16
th
2013 the Commander
of the Kitty Policy Station requested the
CH&PA to conduct an investigation into the
matter and advise them on an appropriate
course of action. This report details the results
of the investigation conducted by CH&PA
Officers T. Selby & K. Moseley.

Mr. A holds a valid Liquor Restaurant
License (License# A156CDG issued January
1 2010 and expires December 31 2015)
which allows him to operate for Bar, sales,
consumption, etc
Noise nuisance is a result of loud music
emanating from The Underground Station
which operates from 18:00hrs with no
apparent fixed closing hours.
The Underground Station is an open
Bar/Discothque
While there are two other bars on the street,
there is no noise nuisance from these as the
buildings are sound proof

Mr. A has obtained permission from
the EPA under The Environmental
Protection (Noise management)
Regulations 2000 to operate the Bar.
However he is violation of the
permission which requires that the
bar be closed at 12midnight and that
the music emitting from the premises
should not be plainly audible at a
distance of fifty feet from the
premises .

Conclusion/Recommendations
Given the fact that Mr. A is in
violation of; 00:00 hrs closing and
music being audible at a distance
of fifty feet from the premises .
Mr. A will have to close his
establishment at 00:00 hrs; and
Mr. A will have to make his
establishment soundproof.
The complaint of Noise Nuisance
is therefore valid.

Lessons for practice
Periodic site visits to discothque
license holders should be made to
ensure compliance to specified
permissions;
Periodic site visits to other liquor
license holders should also be
made to ensure compliance;
A review of applications for late
closing of discothques should be
made.
