The Narcotic Drugs and

Psychotropic Substances
Act, 1985 and Rules, 1985

INTRODUCTION :

Coca, opium & Hemp are the excellent drugs when


used for the medicinal purpose but these drugs are
also miss used for euphoria, addiction etc.
These type of drugs when used for longer time
causes sever effects on brain & nervous system.
These effect including apathy, forgetfulness , lack of
self respect , physical & mental injury & therefore
miss use of these drugs is very injurious with social
point of view.
With this view of dangerous effect of drug. The govt.
of different country are decide to restrict these use
for bonafide medical purpose only.

OBJECTIVE:

To prohibit or control or to regulate the


operation relating to narcotic drugs and
psychotropic substances.
It provide licensee system for whole central &
state Govt.
It prescribe the procedure for preventing illicit
traffic & abuse of narcotic drugs & psychotropic
substances.
Act also provide penalties illicit traffic of these
drugs.

DEFINATIONS :

Narcotic Drugs: It mean Coca leaves, opium, hemp, poppy


straw, & including all manufacture drugs.
PSYCHOTROPIC SUBSTANCES: :
1. Any substances natural or synthesis or any salt.
2. Preparation of such substances which are included in a list of
Psychotropic substances in the schedule to the NDPS Act 1985.
Eg. N-N Dimethyltryptamine , N-N diethyltryptamine , LSD
(Lysergic acid diethylamide) , Alprazolam , Nitrazepam And other
benzodiazepam Derivative.
COCA LEAF:
Leaves of any plant of genus Erythroxylon coca ,Excluding leaves
from which cocaine ecgonine And other egonine alkaloids is
removed. Any mixture there of with or without any neutral
material except any preparation containing Less than 0.1% of
cocaine.

1. Cannabis (Indian Hemp)


It contains leaves and flowering tops of pistillate plants
of Cannabis sativa (c. indica) : Family-Cannabinaceae.

2. Cannabis Products
(a) Charas is the crude or purified resin obtained from
the cannabis plant and also includes concentrated
preparation and resin known as Hashish oil.
(b) Ganja is from the flowering or fruiting tops of the
cannabis plant (excluding the seeds and leaves not
accompanied by the tops), by whatever name they
may be known or designated and
(c) Any mixture with or without any neutral material of
any of the above forms of cannabis or any drink
prepared therefrom.

Illicit Traffic:
In relation to narcotic drugs and psychotropic substances, it
means:
(a) cultivating any coca plant or gathering any portion of coca
plant,
(b) cultivating the opium poppy or cannabis plant,
(c) engaging in the production, manufacture, possession, sale,
purchase, transportation, ware-housing, concealment, use or
consumption, import inter-state, export interstate, import into
India, export from India or transhipment of narcotic drugs or
psychotropic substances,
(d) dealing in any activities in narcotic drugs or psychotropic
substances other than those referred to under subclauses
(a) to (c) as above,
(e) handling or letting out any premises for carrying on any of the
activities referred to in subclauses (a) to (d) given above.

Controlled Substances
Any substance which the Central Government may, having regard to
the available information as to its possible use in the production or
manufacturing of the narcotic drugs or psychotropic substances or to
the provisions of any International Convention by notification in
Official Gazette, declare to be a controlled substance.
Manufactured Drug
(a) It means all coca derivatives, medicinal cannabis, opium
derivatives and poppy straw concentrate,
(b) Any other narcotic substance or preparation which the Central
Government may having regard to the available information as
to its nature or to a decision if any under any International
Convention by notification in Official Gazette declare to be a
manufactured drug but, does not include any narcotic substance
or preparation which the Central Government may, having
regard to the available information as to its nature by notification
in Official Gazette declare not to be a manufactured drug.

Opium
It means:
(a) Medicinal opium-the opium in powder, granulated or any other
form which has undergone the processes necessary to adopt it
for medicinal use in accordance with the requirements of Indian
Pharmacopoeia or any other Pharmacopoeia.
(b) Prepared opium-any product of opium obtained by series of
operations designed to transform opium into any extract suitable
for smoking,
(c) Phenanthrene alkaloids namely, morphine, thebaine, codeine
and their salts,
(d) diacetyl morphine i.e., the alkaloid known as diamorphine or
heroine and its salts, and
(e) all prepatations containing more than 0.2% of morphine or
containing any diacetyl morphine.
10. Opium Poppy
It is the plant of the species of Papaver somniferum L.(Papaveraceae)
and the plant of any other species of Papaver from which opium or
any phenanthrene alkaloid can be extracted and which the Central
Government may by notification in the Official Gazette declare to be
opium poppy for the purposes of this Act.

Poppy Straw
It represents all parts except, the seeds of the opium poppy after
harvesting, whether in their original form or crushed or powdered
and whether or not juice has been extracted therefrom.
Poppy Straw Concentrate
It means the material arising when poppy straw has entered into a
process for the concentration of its alkaloids.
Psychotropic Substance
It is a natural or synthetic substance or its salt or preparation or any
natural material included in the list of psychotropic substances
specified in the Schedule to the Act.
The list of some of the psychotropic substances covered under the
Schedule to the Act include, tetrahydrocannabinol, amphetamine,
etycyclidine, rolicyclidine, psilocybine, tenocyclidine,
dexamphetamine,
camazepam, clonazepam, clotizepam, diazepam, cloxazolam,
ketozolam, alprazolam, estazolam, bromazepam, haloxazolam,
amobarbital, pentobarbital, secobarbital, barbital, allobarbital, LSD,
LSD-25, mesocarb, cathine, tetrazepam, triazolam, prazepam,
oxazepam, loprazolam, lorazepam, mazindol, meprobamate and
others.

AUTHORITY & OFFICERS:


Under this act the central govt. has to
appoint a narcotic commissioner and other
officers to
Measure for preventing and combating
abuse of Narcotic drugs and illicit traffic
there in.
Officers of central government.
The Narcotic Drugs and Psychotropic
Substances Consultative Committee.
Prohibition, control, and regulation.

The Central Government has to:


Measure for preventing and combating abuse of
Narcotic drugs and illicit there in.
1. fulfil obligations under International Conventions,
2. coordinate with international agencies,
3. coordinate actions of Central Government and State
Government Officers,
4. extend assistance to foreign authorities when asked
for,
5. undertake identification of problem, treatment of
addicts, education against drug abuse, after-care of deaddicted persons, rehabilitation and social registration
of de-addicted persons,
6. other matter for effective implementation of this act
and preventing and combating the abuse of narcotic
drug and psychotropic substances, and illicit traffic.

Officers of central government. The central government may appoint


Narcotic commissioner and such other officers, for the supervision of the
cultivation of the opium poppy; and Production of opium and Other
functions as may be entrusted to him by the central Government.
The Narcotic Drugs and Psychotropic Substances Consultative
Committee.
An advisory committee.
Chairman and such other members not exceeding 20.
The committee shall advice the central government on the matters
relating to the administration of this act.

a] Prohibition of certain operation As per sec.8. No person shall :
1. Cultivate any coca plant or gather any portion of coca plant; or
2. Cultivate the opium poppy or any cannabis plant; or
Produced manufactured, possess, sale, purchase, transport,ware house,
use,consume,interstate export , interstate import, Import into India,
export from India or transshipment any narcotic drugs or psychotropic
substances.

Power of central Government


B] Central government may ,by rule permits and regulates:
1. The cultivation, or gathering, of any portion of coca plant or the production of,
sale purchase ,transport.
2. The cultivation of the opium (only an account of central government)
3. The production and manufacture of opium and production of poppy straw.

The sale of opium derivative from the central government factories for export
from India or sale to state Government or to manufacture chemist . Manufacture
of manufacture drug other than opium but not including manufacture of
medicinal opium or any preparation containing any manufactured drug from
material which the maker is lawfully entitled to possess.

The manufacture ,possession ,transport, import , inter state, export inter state,
sale,purchase,consumption,or use of psychotropic substances. The import into
India and export, from India and transshipment of narcotics drugs and
psychotropic substances.

Control of certain operation by central government: According to the rules: The
limits within which licenses may be given for the cultivation of opium poppy. All
opium, the product of land cultivated with the opium poppy shall be delivered by
the cultivator to the officer authorities on behalf of central government . Fix the
price to be paid to the cultivator for the opium delivered.
