employee employer
The most typical mobbing situations:

Forcing to work overtime, even though it is not necessary

Not paying for overtime hours
Denying holiday - although others do not have such problems
Frightening with the perspective of dismissal
Malicious remarks and jokes from the superior
Entrusting tasks to which the employee is not prepared, and then criticizing
their performance
Punishing without listening to employee's explanation
Criticizing, humiliating
Punishing for claiming one's rights

What is not a mobbing?

rare situation where someone loses temper, has a bad
mood and in a result - argues with co-worker,
situation where the employer humiliate his employee only
once,
situation in which employees equal in the position and
education lead a dispute,
situation where an employee violates workers' rights and
does not fulfill his duties, takes her incompetence or
irresponsibility.
Single conflict is not bullying!

To become one, it has to meet additional conditions:

period of problem existence greater than 6 months
(associated with the experience of post-traumatic stress)
systematic action against the same person

Mobbing and Discrimination differences

The difference lies in the differing elements, such as sex, age,

which in the case of mobbing is not significant

In discrimination the employer must prove that they do not
discriminate against an employee
Discrimination is not intended to exclude the employee from the
labor market

A mobber is a person who:

treat others instrumentally,

do not feel remorse for exploitation and humiliation of others
do not have the capacity of empathy
depreciating and demeaning to other extents
has exaggerated self-esteem
refuses to acknowledge criticism of their actions
is an egoist and an autocrat
is deceitful, coward and hypocritical

Reasons for persecution?

want to build its image as a responsible person

want to focus the attention of the team,
want to eliminate from among the staff people uncomfortable,
often - allegedly - that threaten their position,
recognize that the best way to introduce discipline
revenge for their failures such as in family life (the destruction
of coercion),
reduce the negative emotions,
draw, satisfaction with complete control over the worker andthe
environment,
experiencing sexual satisfaction
feel of impunity

Mobbing versus Law

In Poland in 2004 a concept of mobbing was introduced into

Labor Law.
Art. 94 3 clearly obliges employers to prevent mobbing
