SAFETY LEGISLATION

Safety legislationisastatementoflawthatprotectsthehealth,
safetyandwelfareofthegeneralpublicandcertaindefinedsectorsofthe
populationsuchasemployees.

Itregulatetheconditionsofemployment,workenvironmentandother
welfarerequirementsofcertainspecificindustries.Theseenactmentsdeal
withfactoriesandworkshops;minesandminerals;plantations;shopsand
establishmentsaswellastransportation.

THEFACTORIESACT,1948-istheumbrellalegislationenactedtoregulate
theworkingconditionsinfactories.

TheActisadministeredbytheMinistryofLabourandEmployment through
itsMinistry of Labour and Employment
PLANTATION ACT

PLANTATION LABOUR ACT, 1951-providesforthewelfareof


plantationlabourandregulatestheconditionsofworkinplantations.

AccordingtotheAct,theterm'plantation'means"anyplantationtowhich
thisAct,whetherwhollyorinpart,appliesandincludesoffices,hospitals,
dispensaries,schools,andanyotherpremisesusedforanypurpose
connectedwithsuchplantation

millionskilledcraftworkers.

ItplayasignificantroleintheIndianeconomyintermsofitssharein
employment,contributiontoGDPpreservationofculturalheritage.

Occupationalsafetyandenvironmentalhazardsseverelyaffectthevulnerableand
marginalizedworkingpopulation

Therapidlychangingeconomicscenariothreatensthehealthandlivelihoodsof
industrialworkersinIndia.TheGovernmentandIndustryneedtoplayaproactive
roleingeneratingawarenessonthehazardsinvolvedintheproductionprocesses
andincreatingasetofsectorwidebasicminimumstandardsprotectingthe
worker.

Bhopal gas Tragedy

ItwasagasleakincidentinIndia,consideredoneoftheworld'sworstindustrial
disasters.

Itoccurredonthenightof23December1984attheUnionCarbideIndia
Limited(UCIL)pesticideplantinBhopal,MadhyaPradesh.Over500,000
peoplewereexposedtomethylisocyanate(MIC)gasandotherchemicals.The
toxicsubstancemadeitswayintoandaroundtheshantytownslocatednearthe
plant.

3787killed,38478injuried.

therewasanexplosioninDhoricollierynearDhanbad,whichledtofireinthe
