SEX CRIMES IN THE

REVISED PENAL CODE

It is one of the ancient and universal crimes


There is close physical contact between the offender and
the victim
In general, it is committed by one sex against opposite
sex
It is usually committed in strict privacy and many go
unreported
Rape is the highest form of sex crime
RAPE
When and How Rape is committed?

1. By a man who shall have carnal knowledge of a woman


under any of the circumstances
a) Through force, threat, or intimidation
b) When the offended party is deprived of reason or otherwise
unconscious
c) By means of fraudulent machinations or grave abuse of
authority
d) When the offended party is under (12) years of age or is
demented, even though none of the circumstances mentioned
above is present (Art. 226-A & 26-B, Revised Penal Code).
2) By any person who, under any of the circumstances
mentioned in paragraph (1) hereof, shall commit an act of
sexual assault by inserting his penis into another persons
mouth or anal orifice or any instrument or object into the
genital or anal orifice of another person.

MARITAL RAPE
Marital rape is now explicitly recognized in the provision on
pardon in RA. 8353:
In case it is the legal husband who is the offender, the
subsequent forgiveness by the wife as the offended party
shall extinguish the criminal action or the penalty. Provided,
that the crime shall not be extinguished or the penalty shall
not be abated if the marriage is void ab initio.
CARNAL KNOWLEDGE
It is the act of a man in having sexual bodily connection
with a woman. There is carnal knowledge if there is the
slightest penetration in the sexual organ of the female by
the sexual organ of the male.
SEDUCTION
Is the art of a man enticing women to have unlawful
intercourse with him by means of persuasion, solicitation,
promises, bribes or other means without employment of
force.
ACTS OF
LASCIVIOUSNESS
This crime can be committed against persons of either sex.
The elements of this crime are almost similar to rape
(1) that the offender commits any act of lasciviousness or
lewdness;
(2) that it is done by using force or intimidation or when the
offended party is deprived of reason or otherwise
unconscious or when the offended party is under 12 years of
age;
(3) that the offended party is another person of either sex.

Statistics on the incidence of rape are usually
based on available police records. Often, these
are inaccurate and not a true representation of
the problem, for cultural and social
stigmatisation associated with rape act as
significant barriers to women reporting rape.
Furthermore, women are more likely not to report
rape if there is little support from their families,
law enforcement agencies and the health sector.
In thePhilippines, The
Asian Women's Resource Exchange (AWORC),
an Internet-based women's information service,
reports that 794 rapes occurred in the
Philippines in the first four months of 1997. [3]
During the first semester of 1999 alone, there
were 2,393 children who fell prey to rape,
attempted rape, incest, acts of lasciviousness
and prostitution. [4] As of 2006, Rape continued
to be a problem, with most cases going
unreported. During the year, the PNP reported
685 rape cases There were reports of rape and
sexual abuse of women in police or protective
custodyoften women from marginalized
groups, such as suspected prostitutes, drug
users, and lower income individuals arrested for
minor crimes. .[5] The situation continued in
2007, with the number of reported rape cases
increasing to 879

Sexually Transmitted Diseases
Rape is always associated with the risk of
sexually transmitted diseases, particularly
Human Immunodeficiency Virus (HIV).

Rape of Children
Research studies conducted in schools show that for every 3
Filipino children, one child experiences abuse. During the
first semester of 1999 alone, there were 2,393 children who
fell prey to rape, attempted rape,incest, acts of
lasciviousness and prostitution.
GOVERNMENT
ACTIONS
PNP and DSWD
The PNP and DSWD both maintained help desks to assist
victims of violence against women and to encourage the
reporting of crimes. With the assistance of NGOs, officers
received gender sensitivity training to deal with victims of
sexual crimes and domestic violence. Approximately seven
to eight percent of PNP officers were women. The PNP has a
Women and Children's Unit to deal with these issues.

ACTION
NGOs
The womens group GABRIELA provides counseling for
battered women, rape victims and other victims of violence
against women. TheBathaluman Crisis Centre Foundation
helps victims of rape and incest. The Support Group
Volunteers provide assistance, and psychological
interventions may also be initiated at the centre. Where
appropriate, cases are referred to other agencies for more
specialist assistance. The Women's Crisis Centre (WCC)
provides temporary shelter, medical assistance and advocacy,
legal assistance and advocacy, and stress management, it has
two particularly innovative components - Feminist
Counselling, and a Survivors Support Group to rape victims.
