Old legal Basis

- Regulations on Safety Supervision of Boilers and

Pressure Vessels, promulgated by the State Council of the
P.R. China on February 6, 1982

Either existing or old legal basis establishes the general

and principal requirements/provisions with which all
parties concerned should comply in the scope governed
by the Regulations.

Seven stages are involved

design, manufacture, installation, alternation,
maintenance and repair, in-service, inspection and test

Objective of the New Regulations

- Safeguard safety of peoples lives and property
- Promote economic development

Scope of the New Regulations

Special equipment refers to boilers, pressure vessels, pressure
pipelines, elevators, lifting appliances, passenger ropeways and
large amusement devices

- pressure-bearing steam boiler with volume no less than 30

litres

- pressure-bearing hot water boiler with outlet water pressure no

less than 0.1Mpa (gauge pressure) and rated power no less
than 0.1MW

- Pressure vessel refers to enclosed equipment which is capable of

holding gas or liquid and carrying a certain pressure.

- It ranges from stationary vessel or transportable vessel for

gas or liquefied gas whose maximum working pressure is no less
than 0.1MPa ( gauge pressure) and the P.V is no less than
2.5MPa.L or for liquid whose maximum working temperature is no
less than its standard boiling point,

- Gas cylinder for gas or liquefied gas whose nominal working

pressure is no less than 0.2Mpa and the P.V is no less than
1.0MPa.L or for liquid whose standard boiling point is no more
than 60

- Pressure pipeline refers to pipe-shaped equipment which is

capable of transmitting gas or liquid under certain pressure
- It is used to transmit gas, liquefied gas, steam medium whose
maximum working pressure is no less than 0.1Mpa (gauge
pressure),

- or liquid media which are flammable, explosive, toxic, corrosive

and whose maximum working temperature is no lower than the
standard boiling point and whose nominal diameter is larger than
25mm

Features of each level

- 1st level is the New Regulations, which is the ultimate base of
the legislation system and promulgated by the State Council

- 2nd level represents the specific regulations and rules which

establish purely supervisory requirements in the field of special
equipment, which are drafted and adopted and
promulgated ,generally, in form of decree by AQSIQ

- 3rd level represents the STCs, which are specific

regulations or rules, even procedures
e.g. Safety Technical Supervision Regulations on steam boilers

- 4th level represents the relevant standards, which

support STCs in mandatory or voluntary manner
depending on the forms of their reference made in STCs.

Legal Status
Article 10 and 44 of the New Regulations gives STCs legal
status
What is STCs
STCs are specific regulations or rules, which provided for the essential
requirements in detail concerning the phases of design, production,
inspection, installation, alternation etc. All manufacturers and
installers or end users are obliged to meet the essential requirements
set by STCs in question.

In principle, the STCs are prepared for each kind of special equipment.

Role of STCs
- elaboration of the requirements provided in the New
Regulations

- establishment of the concrete and essential requirements for

which manufacturers and installers as well as other partied
involved must fulfill

Development of STCs
- STCs are not prepared by AQSIQ, actually, it is CSEI, Centre of Special
Equipment Inspection and Research, an independent organization
specialized in the area of conformity assessment, special equipment
inspection and relevant research, who prepares the STCs.

- AQSIQ entrusts CSEI with the preparation of STCs by issuing a mandate

- The Special Equipment Safety Technical Board (STB) comprising

competent experts in different sectors is responsible for the adoption of
STCs

- AQSIQ approves and issues the STCs after the adoption by the STB above

Procedure of the Development of the STCs

1. A mandate is drawn up by AQSIQ, following consultation with

relevant parties.
2. The mandate is transmitted to CSEI.
3. CSEI accepts the mandate and organizes a working group to draft.
4. A working group organizes by CSEI elaborates the STCs.
5. CSEI and the working group organize a public enquiry.
6. The working group considers comments.
7. CSEI transmits STCs to STB for adoption.
8. AQSIQ approvals and issues the STCs.
