Rule XVI of the Omnibus Rules

Definition of Terms
Leave of absence is generally defined as a right
granted to officials and employees not to report for
work with or without pay as may be provided by
law and as the rules prescribe in Rule XVI hereof.

Immediate family refers to the spouses, children,


parents, unmarried brothers and sisters and any
relative living under the same roof or dependent
upon the employee for support. (Amended by CSC
MC 6, s. 1999)
Definition of Terms
Sick leave refers to leave of absence granted only
on account of sickness or disability on the part of
the employee concerned or any member of his
immediate family.

Vacation leave refers to leave of absence granted


to officials and employees to personal reasons, the
approval of which is contingent upon the
necessities of the service.

Maternity leave refers to leave of absence granted
to female government employees legally entitled
thereto in addition to vacation and sick leave. The
primary intent or purpose of granting maternity
leave is to extend working mothers some measure
of financial help and to provide her a period of rest
and recuperation in connection with her
pregnancy.

Paternity leave refers to the privilege granted to a
married male employee allowing him mot to
report for work for seven (7) days while continuing
to earn the compensation thereof, on the condition
that his legitimate spouse has delivered a child or
suffered a miscarriage, for purposes of enabling
him to effectively lend care and support to his wife
before, during and after childbirth as the case may
be and assist in caring for his newborn child.
Leave of Absence
Section 6 Teachers leave Teachers shall
not be entitled to the usual vacation and sick
leave credits but to proportional vacation pay
(PVP) . The total PVP that shall be earned by
teachers shall be based on the computation to
be provided by the Department of Education
(DepEd) every school year.
Leave of Absence
Section 9 - Vacation service credits of teachers
Teachers vacation service credits refer to the leave
credits earned for services rendered on activities
during summer or Christmas vacation, as authorized
by proper authority. These vacation service credits are
used to offset absences of a teacher due to illness or to
offset proportional deduction in vacation salary due to
absences for personal reasons or late appointment.
The manner by which service credits may be earned by
teachers is subject to the guidelines issued by the
DepEd.
Rule XVI Section 11
Conditions for the grant of maternity leave
Rendered an aggregate of two (2) or more years of
service.
Delivery occurs during long vacation both the
maternity benefits and the proportional vacation
pay shall be received by the teacher concerned.
Rendered one (1) year or more but less than two (2)
years of service shall be computed in proportion to
their length of service, provided, that those who
have served for less than one (1) year shall be
entitled to 60-day maternity leave with half pay.
Rule XVI Section 19
Conditions for the grant of paternity leave
Married male employee is entitled to
paternity leave of seven (7) working days for
first four (4) deliveries of his legitimate
spouse with whom he is cohabiting.
Married male employees with more than one
(1) legal spouse shall be entitled to avail
paternity for an absolute maximum of four
deliveries regardless of whichever spouse
gives birth.
Rule XVI Section 20
Paternity Leave non-cumulative /
non-commutative
Paternity leave of seven (7) days shall be non-
cumulative and strictly non-convertible to cash.
Paternity leave of seven (7) days may be enjoyed
either in a continuous or in an intermittent
manner by the employee on the days immediately
before, during and after the childbirth or
miscarriage of his legitimate spouse.

Tardiness and undertime are deducted
against vacation leave credits. - Tardiness
and undertime are deducted from vacation
leave credits and shall not be charged
against sick leave credits, unless the
undertime is for health reasons supported
by medical certificate and application for
leave.
Rule XVI Section 53
Application for sick leave All application for sick
leave of absence for one full day or more shall be made
on the prescribed form and shall be filled immediately
upon employees return from such leave. Notice of
absence, however, should be sent to the immediate
supervisor and/or to the agency head. Application for
sick leave in excess of five (5) successive days shall be
accompanied by a proper medical certificate.
Can file in advance in cases of medical examination or
operation or advices to rest in view of ill health duly
supported by a medical certificate.

Unsatisfactory or Poor Performance An
official or employee who is given two (2)
consecutive unsatisfactory ratings may be
dropped from the rolls after due notice.
An official or employee, who for one
evaluation period is rated poor in
performance, may be dropped from the
roles after due notice.
Rule 19 Section 93 (RRACCS)
Physically Unfit
1. An officer or employee who is continuously absent for
more than one (1) year be reason of illness may be
declared physically unfit to perform his/her duties and
the head of office in exercise of his/her duties and the
head of office in exercise of his/her sound judgement
may consequently drop him/her from the rolls.
2. An officer or employee who is intermittently absent by
reason of illness for at least two hundred sixty (260)
working days during a twenty four (24) month period
may also be declared physically unfit by the head of
office.

3. An officer or employee who is behaving abnormally
and manifests continuing mental disorder and incapacity
to work as reported by his/her co-workers or immediate
supervisor and confirmed by a competent or immediate
supervisor and confirmed by a competent physician, may
likewise be dropped from the rolls.
4. For the purpose of the three (3) preceding paragraphs,
notice shall be given to the officer or employee concerned
containing a brief statement of the nature of his/her
incapacity to work.
Policy on Undertime
1. Any officer or employee who incurs undertime, regardless
of the number of minutes/hours, ten (10) times a month
for at least two months in a semester shall be liable for
Simple Misconduct and/or Conduct Prejudicial to the
Best Interest of the Service, as the case may be; and
2. Any officer or employees who incurs undertime,
regardless of the number of minutes/hours, ten (10) times
a month for at least two (2) consecutive months during
the year shall be liable for Simple Misconduct and/or
Conduct Prejudicial to the Best Interest of the Service, as
the case may be.
Policy on Half Day Absences
Any officer or employee who is absent in the
morning is considered to be tardy and is
subject to the provision on Habitual
Tardiness; and
Any officer or employee who is absent in the
afternoon is considered to have incurred
undertime, subject to the provisions on
Undertime.
