JUST CAUSE

Refers to any wrongdoing done by


employee:
Serious misconduct

Willful disobedience to lawful orders

Gross and habitual neglect

Fraud or breach of trust

Commission of crime against the


employer
AUTHORIZED CAUSE

Refers to economic circumstances not


due to the employees fault:
The introduction of labor-saving
measures
Redundancy

Retrenchment to prevent loss

Closure of cessation of business


DUE PROCESS
In cases of JUST cause involves:
Notice to employee of intent to dismiss and grounds
for dismissal
Opportunity for employee to explain

Notice of decision to dismiss


In cases of AUTHORIZED causes:
Written notice of dismissal, specifying the reasons and
be served at least 30 days
PROBATIONARY EMPLOYEE can be dismissed if not
met the STANDARDS given by the employee.
WORK DAYS AND HOURS
Work day refers to any day during which
an employee is regularly required to work

Work Hours refers to all the time and


employee renders actual work, or is
required to be on duty or to be at the
prescribe workplace.

Normal hours of work in a day is 8 HOURS


Wages and Wage Related Benefits
Wage is the amount paid to an employee in
exchange for a task, piece of work, or services
rendered
This includes overtime, night differentials,
rest days, holiday and 13th month.

Minimum wage are determined by the Regional


Tripartite Wage and Productivity Board.

DEDUCTIONS
As authorized by law - Withholding tax, SSS,
PhilHealth, PagIBIG
With consent of employee union dues and
other deductions
COMPUTATION OF WAGES

8 hours of work = daily wage
P 306 minimum daily wage, plus P24.00
Cost of Living Allowance (COLA)

13TH MONTH PAY


Total basic salary earned for the year
divided by 12 = 13th month pay

Non-Agriculture
Establishment with P30M assets P 306 per day + P24.00
COLA = P 330.00
Establishment with below P30M assets P298.50 per day +
P24.00 COLA = P322.50
Retail/Service
Employing 16 or more P295.00 + P24.00 COLA= P 319.00

Employing 16 and below P 281.00+ P24.00 COLA= P305.00

Agriculture
Plantation P 276.00 + 24.00 COLA = P 300.00

Non-plantation- P281.00 + P24.00 COLA= P 305.00

Cottage /Handicraft- P260.00 plus P24.00 COLA= P 284.00


OVERTIME PAY

On ordinary days
Number of hours in excess of 8 hours
(125% x hourly rate)

On rest days, special day or regular


holidays
Number of hours in excess of 8 hours
(130% x hourly rate)
Computing Pay for Work Done
on:
Special day (130% x basic pay)

Special day which is also a scheduled


rest day (150% x basic pay)

A regular holiday (200% x basic pay)

A regular holiday which also a scheduled


rest day (260% x basic pay)
SAFE WORKING CONDITIONS

Employers must provide workers with


every kind of on-the-job protection
against injury, sickness or death through
safe and healthful working condition.
