Evidences:

There can be flowing types of evidence under


evidence Act 1872-
1.Oral Evidence (Section 60).
2.Documentry evidence (section 3)
3.Primary Evidence(Section 62)
4.Secondry Evidence (section 63)
List of Evidence (Plaintiff):

Mr. Ador is the owner of the land.


Mr. Ador has title of the land.
Mr. Ador has the possession of land.
Mr. Sabuj had threat to Mr. Ador
Mr. Sabuj had dispossessed to Mr. Ador without any
consent.
Mr. Sabuj has disposed form the land without due course
of law.
The land area is 15 decimal.
The possession took place within six months before
institution of the suit.
Who can be witness:

As per section 118 of the evidence act, 1872 1.All


persons competent to testify unless prevented from -
a. understanding the question
b. or from giving rational answers to those question,
By reason of-
tender years ,disease of body and mind extreme old
age, any other similar cause.

Mr. Ador
Witness of the deed.
Neighbor of Mr. Ador.
Documents (Mutation, Registration, and Land
Revenue).
Mr. ador did not serve any notice.
Land area is 15 decimal.

Intuition Of Suits:
9 of CPC States that the courts have jurisdiction try
all suits of civil nature excepting suits third
cognizance is either expressly or impliedly barred.
Section 26 Every suits instituted by the presentation
of plaint or in such other manner prescribed
Section 15 of CPC states that every suit shall be
instituted in the court lowest grade competent to try
it.
Specific Relief Act 1877

Section 9 of Specific Relief Act, 1877 states in that,


That he was in possession of that land.
That he has been dispossessed.
That the dispossession took place without consent.
That the dispossession took place within 6 month
before the institution of suit.
Court Fees Act 1870

Ad valorem Court fee :


To obtain a court fee where no consequential relief is
prayed 300 taka ad valorem court fee shall be paid.
Fixed court fee:
It shall be fixed by the court.
Jurisdiction of the court:

District Judge Court- Revisional jurisdiction , appeal of civil


matters valuation of which is upto five crore taka, Probate matters
etc.
Additional District Judge Court- Try cases transferred to this
Court by District Judge.
Joint District Judge Court- i) Original Jurisdiction- hearing of
civil suit of which valuation is from more 4 lac taka to unlimited,
ii)Try succession matter,
ii) Revision- which case is transferred to this Court by District
Judge,
iii)Appeal which case is transferred to this Court by District judge.
Senior Assistant Judge Court- try suits of civil nature of which
valuation is within 4 lac to twenty five lac taka.
Assistant Judge Court- to try civil suits of which pecuniary
jurisdiction is within 2 ,lac taka.
