KATARUNGANG PAMBARANGAY
A system of justice administered at the
barangay level for the purpose of amicably
settling disputes through mediation,
conciliation or arbitration among family
and barangay members without resort to
the courts
 Legal Bases
• PD 1293 (January 27, 1978) – Created Presidential Commission to
conduct a study on the feasibility of instituting a system of amicably
resolving disputes among family & barangay members without
recourse to the courts
• PD 1508 or the Katarungang Pambarangay Law (June 11, 1978)-
recognizes the vital role of the time-honored Filipino tradition of
amicably settling interpersonal disputes at the barangay level
• Batas Pambansa 337 (1983 Local Government Code)
• RA 7160 sec. 399-422, Chapter 7

KP Rules promulgated by the DOJ on June 1, 1992

Administrative Circular No 14-93 (July 15, 1993 by the SC) mandating
compliance with the requirement of prior recourse to KP as a pre-
condition for filing a complaint in court or any government offices
 OBJECTIVES OF THE KP SYSTEM
• To perpetuate and officially recognize the time-
honored tradition of amicably settling disputes at
the barangay level;
• To promote the speedy administration of justice
• To implement the constitutional mandate to
preserve and develop Filipino culture and to
strengthen the family as a basic social institution;
• To relieve the courts of docket congestion caused
by the indiscriminate filing of cases; and
• To enhance the quality of justice dispensed by the
courts

 CONSTITUTION OF LUPONG TAGAPAMAYAPA

• Determine the actual number of Lupon Members

In determining the actual number of members, PB shall consider the
barangay population and the volume of disputes previously brought for
conciliation
• Prepare the “Notice to Constitute Lupon”
(within 15 days from the first day of assumption to office as PB. List should
be at least 5 more than the actual number already determined by the PB.) Notice
to constitute lupon shall include: list of the names of proposed members and an
invitation to the barangay members to endorse or oppose the proposed
appointment of any person included in the list or to recommend other persons not
included in the list. The endorsement, opposition or recommendation shall be
made within the period of posting.

In compliance with section 1(a), Chapter 7, Title One, Book III, Local government Code of 1991, of the Katarungang Pambarangay
Law, notice is hereby given to constitute the Lupong Tagapamayapa of this barangay. The persons I am considering for
appointment are the following:

They have been chosen on the basis of their suitability for the task of conciliation considering their integrity, impartiality,
independence of mind, sense of fairness and reputation for probity in view of their age, social standing in the community, tact,
patience, resourcefulness, flexibility, open-mindedness and other relevant factors. The law provides that only those residing or
working in the barangay who are not expressly disqualified by law are qualified to be appointed as lupon members.
All persons are hereby enjoined to immediately informed me of their opposition to or endorsement of any or all of the proposed
members or recommend to me other persons not included in the list not later than the day of
(last day of posting this notice).

STEPS IN SETTLING DISPUTES
1.Filing of complaint before the PB. [sec. 410(a)]

ARBITRATION
The parties at any stage of the proceedings, may agree to submit the dispute to
arbitration to the lupon chairman or pangkat, and shall agree in writing to abide by
the arbitration award of the lupon or the pangkat. In such a case, arbitration
hearings shall follow the formal order of adjudicative trial.
Steps:
1. Presentation by the complainant of his/her case, and witnesses as well as
submission of evidence
2. Presentation by the respondent of his/her case as well as submission of evidence
3. Issuance of a resolution by the Lupon chairperson or pangkat, based on the merits
of the case, the testimony of the witnesses, and the evidence presented

arbitration award shall be in writing in a langauge or dialect known to both

parties, signed by them and attested to by the lupon chairman or the pangkat
chairman.

The arbitration award shall have the force and effect of a final judgment of a
court upon the expiration of ten (10) days from the date of the amicable settlement
was made, unless repudiation of the settlement has been made.

REPUDIATION
-Is the act of rejecting the validity or refusing to accept the
terms and conditions of an agreement on the ground of
vitiation of consent by fraud, violence or intimidation
In mediation and conciliation, repudiation of the settlement should be done within
the 10-day period from the date of settlement by filing with the lupon or pangkat
chairperson, after which, it shall be deemed a waiver of the right to challenge on said
grounds. The party’s failure to repudiate the settlement within the prescribed period
will result into the latter acquiring the character of having the force and effect of a
final judgment of a court.

In arbitration, repudiation of the agreement to arbitrate should be done within the

5-day period from the date of the agreement, by filing with the lupon or pangkat
chairperson, a statement sworn to before either of them, repudiating the agreement
on the ground that his or her consent was obtained and vitiated for by fraud,
violence or intimidation. Failure to repudiate the agreement to enter into arbitration
will bar the party from questioning the arbitration award unless a petition for
nullification of the award is filed in court
