DECLARATION OF NON COLLUSION
• Their tender is genuine.
• They have not colluded with any other party to fix or adjust the tender price.
• They have not communicated the tender price or terms to any other party (other than
where this is necessary to prepare the tender).
• That they have not given inducements or rewards to the client or their representatives.
• That similar non-collusion arrangements will be required from their sub-contractors and
suppliers.
FORM OF TENDER
• A legal offer by the tenderer, stating the tender amount and proposed completion time.
• To ensure that the undersigned agrees to the condition of work.
1. Fixed completion period: 8 months
2. Type of contract : Lump sum firm price contract
3. Offer remains valid and shall not be withdrawn within 120 days from final
date of submission of tender.
4. Tender Bond will be forfeited if : -

• The undersigned withdrawn before the Tender Validity Period.
• The undersigned imposes any additional term after the final date fixed for the
tender submission.
• The undersigned refuses to execute the formal Contract Document / deposit

the performance bond and insurance policies.
INSTRUCTION TO TENDERER
To inform tenderer on the rules and procedures to comply during the Tendering process. Any tenderer who fails to comply
may deemed unqualified.
1. Tendering period = 2 weeks from the date of Letter of Invitation.
2. Tender Bond of RM12,000.00 in the form of Bank Guarantee.
3. Tender Document fee of RM800.00 in the form of cash or Banker’s Draft -> Q.S.
4. Work executed by others under separate contract.

Tender document fees – RM800.00, Tender Table document may be inspected
In the office of the Employer, Architect and QS.
Time for Completion

Tendered rates shall allow the tenderer to adhere to the agreed timeline.

Scope of work covered. Adjustment which is not allowed.
Tender validity period

Remain valid and open for consideration for 120 days from the final closing date
of the tender submission.
FINAL SUMMARY OF TENDER
An overview of job scope with all bills listed.
Reference for elemental cost analysis.

APPENDIX E- FORM OF BANK GUARANTEE FOR EARNEST MONEY
The tender bond is for use where a developer is obtaining tenders for a
contract and requires a bond as security against the risk of the
successful bidder failing to enter into contract.
APPENDIX E- FORM OF BANK GUARANTEE FOR PERFORMANCE BOND
The successful Tenderers shall be required to provide a Performance

Bond in the form of cash or an approved Banker's
Guarantee/Insurance Guarantee issued by a bank registered in
Malaysia on the standard form provided equal to 5% of the Contract
Sum (Clause 37.1)
• Submit before the commencement of any work under the Contract.
• To be released after CPC
