CONFERENCES & INQUEST

PRE-LITIGATION CONFERENCES
A. Complainant comes to office; if complaint has merit,
schedule a mediation conference between the parties;
B. Conference can be scheduled up to 3x if it appears that the
parties are willing to settle amicably;
C. Form is available (soft and hard copy);
D. Service of Notice to respondent may be coursed thru the
barangay chairman of the barangay having jurisdiction of
the residence of the locality having jurisdiction of the
residence of the respondent/s. It may also be coursed thru
the PNP.
E. Explain advantages of mediation over litigation
to encourage amicable settlement:
 Parties decide on outcome of the case instead
of the Judge (voice and choice)
 Simpler and faster;
 Can vent anger which could not be done in an
adversarial proceeding
 personal peace and healing of relationships
INQUEST

A. Persons arrested without warrant;


B. Determine if arrest is legal; if not talk to Pros for immediate
release because it falls under regular PI;
• In some District inquest is done at the Prosecutor’s Office
C. If arrest is legal but the 12, 18, 36 hours delivery of persons
arrested to the proper judicial authorities (in compliance with
Article 125; 12 light penalties; 18-correctional penalties and
36- afflictive penalties) has not been complied with, request
for immediate release as the case is not proper for inquest
but for regular preliminary investigation;
D. If arrest is legal but there’s a good defense which
warrant dismissal, request for Preliminary
Investigation;
F. Explain to respondent meaning of probable cause;
and the affidavits of the PC/arresting officers;
G. Arrested persons may already post full
recommended bail; reduction of the bail can only
be done in court;
• Remember to fill out the inquest form
