If arrest is legal but the 12, 18, 36 hours delivery of persons arrested to the proper judicial authorities (in compliance with Article 125; 12 light penalties; 18-correctional penalties and 36- afflictive penalties) has not been complied with, request for immediate release as the case is not proper for inquest but for regular preliminary investigation; D. If arrest is legal but there’s a good defense which warrant dismissal, request for Preliminary Investigation; F. Explain to respondent meaning of probable cause; and the affidavits of the PC/arresting officers; G.
