Introduction
L’organisation mondiale du commerce constitue une
fameuse organisation qui s’occupe de l’ouverture
commerciale.
Une enceinte où les gouvernements négocient des
accords commerciaux .Elle est venue remplacer le GATT
de 1947.
Le système commercial qu’elle représente était actif bien
longtemps .

Les Accords de l’OMC sont longs et complexes car ce sont des textes juridiques
portant sur un large éventail de domaines d’activité*.
Cependant, un certain nombre de principes simples et fondamentaux constituent le

fil conducteur de tous ces instruments. Ils sont le fondement du système commercial
multilatéral.

II -Les fondements juridiques de l’organisation
mondiale du commerce :
Les accords :
L'OMC est “FONDÉE SUR DES RÈGLES", qui sont des accords négociés ,plus de 60
accords définissent les règles de fonctionnement de l'OMC .
Les accords résultent des négociations menées par les membres. Celles qui sont
actuellement en vigueur découlent des négociations du Cycle d’Uruguay* qui ont donné lieu
notamment à une révision majeure du texte original de l’Accord général sur les tarifs
douaniers et le commerce (GATT).
Le GATT est le principal recueil de règles de l’OMC pour ce qui est du commerce des
marchandises.
Les accords de l’O.M.C :
Ils régissent les marchandises, les services et la propriété intellectuelle .

Ils énoncent les principes de la libéralisation et les exceptions autorisées.
Ils reproduisent les engagements pris par chaque pays pour réduire les droits de douane et d’autres
obstacles au commerce, et pour ouvrir et maintenir ouverts les marchés de services.
Ils définissent les procédures de règlement des différends. Ils prévoient un traitement spécial en faveur
des pays en développement.
Ils font obligation aux gouvernements d’assurer la transparence de leur politique commerciale en notifiant
à l’OMC les lois en vigueur et les mesures adoptées, parallèlement aux rapports périodiques établis
par le Secrétariat au sujet des politiques commerciales des pays .
Présenté comme une annexe à l'acte final du Cycle d'Uruguay*
Il détermine son mode de fonctionnement et comprend de différentes
annexes qui définissent les grandes règlementations en matière de

Il a pour objectif le développement du libre échange.
Cet accord repose sur quatre principes fondamentaux énoncés.
L'accord général sur le commerce des services. («AGCS»)

Services
Il constitue l’annexe de l’accord instituant l’OMC ,Il s'agit d'un accord multilatéral
de libéralisation des échanges de services .
L'accord sur les aspects des droits de propriété intellectuelle qui touche

Intellectuelle
Est un texte annexé à l'Accord instituant l'Organisation mondiale du commerce. Il a pour but
d'intégrer les droits de propriété intellectuelle (droits d'auteur, Marques de fabrique ou de
commerce, brevets, etc.) .
l'acte reprenant les résultats de négociations commerciales du Cycle d'Uruguay* : il reconnait la légitimité de plusieurs autres textes qui modifient en profondeur le cadre institutionnel du commerce international. Le plus
important d'entre eux est l'accord instituant l'Organisation mondiale du commerce .
Les accords de l’OMC :
Le règlement des Mémorandum d’accord sur les règles et procédures régissant le règlement
différends des différends, Organisation mondiale du commerce, 1994 :

Il s’agit des accords qui s’appliquaient à un groupe plus restreint de signataires
plurilatéraux

•L’accord sur les Marchés publics 1981
•L’accord international sur les Produits laitiers et la viande bovine .

Engagement Contraignants : qui doivent être appliqués par tous les membres de l’OMC sans exception .
Les exceptions Générales :

a) Les produits exclus en raison de leurs liens avec les fonctions
souveraines de l’État.
• L’importation ou l’exportation de l’or ou de l’argent .

• Les articles fabriqués dans les prisons
Les produits exclus en raison de leurs caractéristiques propres
• La conservation des ressources naturelles épuisables
• Les produits de base .

-La licéité des objectifs poursuivis .
Les sanctions :

Conclusion
L'Organisation mondiale du commerce (OMC) est la

seule organisation internationale qui s'occupe des
règles régissant le commerce entre les pays. Au cœur
de l'Organisation se trouvent les Accords de l'OMC,
négociés et signés par la majeure partie des
puissances commerciales du monde et ratifiés par
leurs parlements.
