CONSUMER PROTECTION ACT 1986


The CONSUMER PROTECTION ACT came into force on 15th April 1986. The act is applicable on all kinds of goods and services which are the subject matter of consumer affairs. The act is formed with the sole objective of protection of consumers against any kind of exploitation while consuming any goods and services.

OBJECTIVES
The objective of the act is to provide for better protection of the interest of consumers and for that purpose to make provision for the establishment of consumer councils in each state

RIGHTS OF CONSUMER
Right to be protected against marketing

of goods which are hazardous to life and property. Right to be informed about the quality, quantity of goods. Right to be assured of availability of variety of goods at competitive prices. Right to consumer education

Right to heard. Right to seek redressal against unfair

trade practices and exploitation.

SCOPE OF THE ACT


The consumer protection act extends to

whole of India except the state of Jammu & Kashmir. This act applies to all Goods & Services. It covers all sectors public, private and co-operative. The provision of this act are compensatory in nature

A President who is or has been or is

qualified to be a District Judge to be nominated by the State Government. A person of important in the field of education trade and commerce. A lady social worker. Each member or forum will hold office for a term of 5 years or up to the age of 65 years which ever is earlier and will not be eligible or re-appointment.

THE STATE COMMISION


A President who shall be a person who has

been or is a Judge of the High Court to be appointed by the State Government. Two others members who are popular for their knowledge and experience in the field of economics law commerce accountancy industry public affairs where one of these members shall be a women.

THE NATIONAL COMMISSION


A person who is or has been Judge of

the Supreme Court to be appointed by the Central Government as its President. Four others members from the fields of economics law commerce accountancy industry public affairs where one of the members shall be a women.

PERSON WHO CAN FILE A COMPLAINT


A Consumer . Any Voluntary Consumer association

registered under the Companies Act 1956. The Central Government. Any State Government. One or more Consumers.

AWARD OF COMPENSATION
Removal of defects from the goods.
Replacement of the goods. Refund of the price paid. Award of compensation for the loss or

injury suffered. To remove the defects or deficiencies in the services in question.

To discontinue the unfair trade

practice or not to repeat them again

PENALTIES
If a trader or person against whom a complaint is made or the complainant fails or omits to comply with any order made by a redressal agency he shall be punishable with imprisonment for any term not exceeding three years or with fine not exceeding ten thousand rupees or with both.
