DUTIES AND POWERS OF CHIEF INSPETOR

Appointment,powers,duties of inspector
APPOINTMENT - For enforcement of the provisions

of the act, the state govt is empowered to appoint Inspector having prescribed qualifications.This may be done by notification. They may be assigned such local limit as the state govt may think fit.

Six types of inspectors


1.Chief inspector 2.Additional chief inspector 3.Joint chief inspector 4.Deputy chief inspector 5.Inspector and additional chief inspector

Status
Every chief inspector , additional chief inspector,joint chief inspector ,deputy chief inspector, inspector and other officer appointed shall be deemed to be public servant within meaning of indian penal code,[1860], and shall be officially subordinate to such authority as the state govt may specify in this behalf.

POWERS OF INSPECTORS according to section9, an inspector is vested with the following powers, which he may exercise within the local limits under his control.the powers are to be exercised in accordance with the roles framed for this purpose.

1.He may enter any premises which is used or which he has reason to believe is used,as a factory. He may be accompanied by such assistants, who are in the service of the govt or any local or public authority or with an expert as thinks fit; 2. Make examination of the premises, plant,machinary ,articles or substanace. 3.Inquire in to any accidents or dangerous occurence , whether result in in bodily injury, disability or not, and take on the spot or otherwise statements of any person which he may consider necessary for such enquiry;

4.Require the production of any prescribed register or any other document relating to the factory. 5.Seize or take copies of register, record or other documents or any portion thereof as he may consider necessary in respect of any offence under this act,which he has reason to believe, has been committed; 6.Direct the occupier that any premises or any part thereof or anything lying therein shall be left undistributed [whether generally or in particular aspects] for so long as is necessary for the purpose of any examination ;

7. Take measurements and photographs and make such recording as he consider necessary for the purpose of any examination ,taking with him any necessary instrument or equipment; 8. In case of any article or substance found in any premises,being an article or substance which appears to him as having caused or is likely to cause danger to the health or safety of the workers, direct it to be dismantled or subject it to any process or test [but not so as to damage or destroy it unless the same is in circumstances necessary for carrying out the purpose of this act] and take possession of any such article or substance or apart thereof and detain it for so long as is necessary for such examination; 9. Exercise such other power as may be prescribed;

Duties of Inspector
1.to carry out duties as laid down under section

2.to ensure that statutory provisions and rules

framed are carried out properly;and 3.to launch prosecutions against factory -owners under the provisions of chapter x of the act.

Certifying surgeons
APPOINTMENT Section 10 empowers the state govt to appoint qualified medical practitioners as certifying surgeons for the purpose of the act.these surgeons are appointed to discharge duties within the local limits placed under their control or for such factory or class or discription of factories as may as may be assigned to them . The certifying surgeons with the approval of the state govt may appoint qualified medical practitioners to exersize any of his power for such period as he may specify.

Duties of certifying surgeons--the certifying surgeons shall caarry out such duties as may be prescribed in connection with1.Examination and certification of young persons under the act; 2.the examination of persons engaged in such dangerous occupations or processes as may be prescribed; 3.the exercising of such medical supervision for any factory or class or descripcrtion of factories where-

3.The exercising of such medical supervision for any factory or class or description of factories wherea. cases of illness have occurred which it is reasonable to believe are due to the nature of the manufacturing process carried on, other conditions of work prevailing therein; b. By reason of any change in the manufacturing process carried on or in the substances used therein or by reason of the adoption of any manufacturing process; there in a likelihood of injury to the health of workers employed in the manufacturing process;

c. young persons are about to be employed in any

work which is likely to cause injury to their health
