Notification

No. S.O. 68/H.A. 2008/25/Ss.8,9, 10 and 83/2011.— In exercise of the powers conferred by Section 8 of the
Haryana Police Act, 2007 (25 of 2008) and in supersession of Haryana Home Depart ment Notification
No. S.O. 68/H.A. 2008/25/Ss. 8, 9, 10 and 83/2011 dated the 9th August, 2011, the Governor of Haryana hereby
establishes the office of Commissionerate of Police fo r the area falling within the limits and the jurisdiction of the
revenue district of Panchkula, known as the Commissionerate of Police of Panchkula and appoints an officer, not
below the rank of the Inspector General of Police as the Commissioner of Police , who shall be the head of police
force in the said Commissionerate of Police;
Further, in exercise of the powers conferred by Section 9 of the said Act, the Governor of Haryana hereby
declares that for the purpose of administration and supervision of the police force, the Commissionerate of Police of
Panchkula shall be a Police Range;
Further, in exercise of the powers conferred by Section 10 of said Act, the Governor of Haryana hereby
declares that the Commissionerate of Police of Panchkula shall be divid ed into the following police district, to be
headed by a Deputy Commissionerate of Police in the rank of Superintendent of Police, namely: -

Further, in exercise of the powers conferred by clause (ii) of Section 8 of the said Act, the Governor of
Haryana hereby to empower the Commissioner of Police to exercise and perform, within the jurisdiction of Police
Commissionerate of Panchkula, the powers and duties of a District Magistrate for the purpose of Section 22 and 23 of
the Code of Criminal Procedure. 1973 (Act 2 of 1974), in relation to the officers subordinate to him and for the acts
mentioned in the Schedule;
Further, in exercise of the powers conferred by the first proviso to clause (ii) of Section 8 of the said Act, the
Governor of Haryana hereby directs that any of the powers, functions and duties, responsibilities or authority,
exercisable or to be performed or discharged by the Commissioner of Police shall be exercisable or to be performed
or discharged by the Commissioner of Police shall be exercised or discharged subject to the control of the Director
General of Police;
Further, in exercise of the powers conferred by Sub-section (1) of Section 20 of the Code of Criminal
Procedure, 1973 (2 of 1974), the Governor of Haryana hereby appoints Commissioner of Police, Panchkula as
Executive Magistrate to exercise the powers and discharge duties under the Sections 107 to 122 and 124 of Chapter
VIII and of a District Magistrate under Sections 133 and 144 of Chapter X of the Code of Criminal Procedure, 1973
(2 of 1974), in the Commissionerate of Police of Panchkula;
Further, in exercise of the powers conferred by Sub-section (1) of Section 20 of the Code of Criminal
Procedure, 1973 (2 of 1974), the Governor of Haryana hereby appoints the officers subordinate to the Commissioner
of Police (not below the rank of Assistant Commissioner of Police) as Executive Magistrate for the purposes of
Sections 107 to 122,124, 133 and 144 of the said Code and fu rther declares that e very such officer subordinate to the
Commissioner of Police shall, exercise and perform powers and duties of an Executive Magistrate, subject to the
general control of the Commissioner of Police;
Further, in exercise of the powers conferred by clause (d) of Section 2 of the Arms Act, 1959 (54 of 1959), the
Governor of Haryana hereby appoints Deputy Commissioner of Police heading a police district to exercise the powers
and perform the functions and duties of the District Magistrate under the said Act withi n his jurisdiction;
Further, in exercise of the powers conferred by Section 83 of the Haryana Police Act, 2007 (25 of 2008), the
Governor of Haryana hereby authorizes the Deputy Commissioner of Police in charge of a police district to exercise
powers and perform functions and duties of the District Superintendent of Police within his jurisdiction.

The Commissionerate of Panchkula shall start functioning from the date on which the Commissioner of Police
appointed by the State Government assumes charge of Commissionerate. The police system prevailing in the revenue
district of Ambala before issuance of the Haryana Government, Home Department, Notification No. S.O 68/H.A.
2008/25/Ss.8,9,10 and 83/2011, dated the 9th August, 2011 is restored and shall start fu nctioning with immediate
effect.
