i) Age for all posts shall be applicable, as notified by the State (UP) Government from time to
time.-(Maximum – 40 years , Minimum- 18 years) vide Notification no. 18/2/81-Ka-2/2012

ii) Age relaxation shall be applicable, as notified by the State (UP) Government from time to
time.
iii) Cutoff date for age, qualifications and experience
(a) If an advertisement is released between 01st January to 30th June then it will be 1st January
of that year.
(b) If an advertisement is released between 01st July to 31st December then it will be 01st July
of that year.
Reservation:
Reservation Rules shall be applicable, as notified by the State (UP) Government from time
to time. Vide “The U.P. Public services (Reservation for SC,ST and Other Backward Classes) Act,
1994” and “The UP Public Services (Reservation for Economically weaker sections) Act 2020”
Status of the Application:
Will be displayed at the Institute website. www.sgpgims.org.in OR www.sgpgi.ac.in
Screening:
The candidates are advised to go through the requirements of age, educational
qualification, experience, etc. as mentioned in the advertisement and satisfy themselves before
applying that they are eligible for the respective post. In anticipation of a huge number of
applicants, scrutiny of the eligibility criteria e.g. age, qualifications, experience, etc. will not be
undertaken at the time of the Common Recruitment Test (CRT). Applications without application
fee will be rejected. All applications with application fee shall be accepted provisionally and all
candidates will be allowed to appear provisionally in the Common Recruitment Test (CRT).
If any candidate is found not fulfilling the prescribed age, qualification, experience and any other
eligibility criteria as per the advertisement, at any stage of the recruitment process, even if the
candidate figures in the merit list of the Common Recruitment Test (CRT), his/her candidature will
be treated as cancelled without any further notice and the post will be forfeited. Candidature will
be cancelled at any stage if any information or claim is not substantiated on the scrutiny of the
documents by the Institute.
Selection Process:
The selection will be done on the basis of the marks obtained in the Common Recruitment
Test (CRT) only.
Hall Ticket for the Common Recruitment Test (CRT):
The applicants can print their hall ticket for the Common Recruitment Test (CRT) online
from the Institute website www.sgpgims.org.in OR www.sgpgi.ac.in
Common Recruitment Test (CRT):

For all posts, a Common Recruitment Test (CRT) will be held. The Common Recruitment
Test (CRT) will be of 02 hours duration and will be of 100 marks. It will contain multiple choice
questions (MCQs)
60 marks on the subject(s) related to the post and of the level of the qualifications
required

10 marks on General English
10 marks on General Knowledge
10 marks on Reasoning
10 marks on Mathematical Aptitude.
1 (one) mark will be given for the correct answer and 1/3 (one-third) mark will be
deducted for the wrong answer (i.e. there will be negative marking)
Minimum qualifying marks of the Common Recruitment Test (CRT) for all posts will be:-
50% for General, EWS, OBC.
45% for SC & ST
Skill Test/ Technical Examination:
A Skill Test/ Technical Examination will be conducted after the Common Recruitment Test
(CRT), wherever required e.g. for the posts of Stenographer, Personal Assistant (PA), Lower
Division Assistant (LDA) at present. Candidates equal to three times the number of posts
advertised in each category will be shortlisted after the Common Recruitment Test (CRT) to
appear for the Skill Test/ Technical Examination in Stenography/ Typing Test etc. In case of a tie at
the last place, all applicants who tie at the last place at the Common Recruitment Test (CRT) will
be called for the Skill Test/ Technical Examination. This list will be declared in order of Roll No./ in
alphabetical order (NOT in order of merit). In such cases, however, the Skill Test/ Technical
Examination will be only qualifying in nature and such marks (of the Skill Test/ Technical
Examination) shall not be counted in the overall selection procedure i.e. the final selection will be
made on the basis of the marks obtained in the Common Recruitment Test (CRT) only by the
candidates who qualify the Skill Test/ Technical Examination.
Eligibility Status for the Skill Test/ Technical Examination:
The list of applicants eligible for the Skill Test/ Technical Examination (wherever required)
after the Common Recruitment Test (CRT) will be declared on the Institute website.
Final Merit List:
The final merit list will be prepared based on the marks obtained in the Common
Recruitment Test (CRT) only for all categories (i.e. GENERAL, OBC, SC, ST, EWS, etc) separately
and rank will be awarded to all qualified applicants. While preparing the merit list for the General
category, all applicants (including those from the reserved categories) will be taken into
consideration, but while preparing the merit list for a reserved category, only applicants of that
category will be taken into consideration. The same method will be applicable in all reserved
categories.
Resolution of Tie: In cases where more than one candidate secures equal marks, the tie will be
resolved (i) First by using the date of birth, with older candidate placed higher (ii) If not resolved
by the date of birth, it will be resolved by the number of wrong answers/ negative marks, those
with less wrong answers/ negative marks placed higher.
Results:
All results will be declared on the Institute website.
NOTE:
All selections made against a specific advertisement shall be applicable only for that
specific advertisement, and wait list would be prepared as per the provisions of the State (UP)
Government in this regard.

Canvassing in any form will be a disqualification.
Any dispute in regard to any matter referred to herein shall be subject to the jurisdiction of
Lucknow Courts only.
Recruitment Cell (under the overall charge of the Joint Director (Administration):
Will conduct the recruitment process including posting of the advertisement on the
Institute website, receiving and screening (regarding submission of application fee only) the
application forms, declaration of the results at various stages of the recruitment process on the
Institute website, sending the formal appointment letters (through email, SMS, speed-
post/registered AD, etc) and any other function related to the recruitment process.
Examination Cell:
The Examination Cell of the Institute will obtain the MCQs for the Common Recruitment
Test (CRT) and will conduct the Skill Test/ Technical Examination, wherever required, with the
concerned Departments/ Sections and coordinate with the Recruitment Cell and the Common
Recruitment Test (CRT) conducting agency.
Supervising Committee:
The Director will constitute a Committee to supervise the recruitment process being
conducted by the Recruitment Cell, Examination Cell and the Common Recruitment Test (CRT)
conducting agency.
Other observations-
1. Higher qualification will not be considered a disqualification for any post.
2. Working experience in Government/ semi government organization wherever applicable
will include experience either on regular post or outsourced/contractual, with
accompanying evidence based certificate. Applicant will submit an affidavit that
experience mentioned in the certificate is true and SGPGIMS may verify the facts from the
concerned Institution/ Party.
3. For posts having experience as an Essential Criteria, the experience which has been
acquired only after obtaining essential qualification will be considered as valid.
4. Any dispute with regard to any matter referred herein shall be subject to the jurisdiction of
Lucknow court alone.
Note:
1. The Notification of “The Uttar Pradesh Direct Recruitment to Junior Level Posts (Discontinuation of
interview) Rules 2017” Notification Miscellaneous No. 4/2017/1/1/2017-Ka-2 Dated 31 August 2017,
the earlier provisions/guidelines in respect of recruitment of group ‘B’ (Non Gazetted), group ‘C’ and
group ‘D’ are superseded by this rule 2017 and recommended to adopt these Rules for recruitment of
group ‘B’ (Non Gazetted), group ‘C’ and group ‘D’ posts of the Institute.
2. Section 4(C) of the said Rule about Skill Test or Technical Examination was discussed in detail. It
currently applies for the following posts
a. Stenographer:- Candidate should be Graduate (above 55%) with speed of 80 w.p.m. in Hindi
& English stenography and 40/35 w.p.m. in English and Hindi typing and knowledge in
computer applications. In absence of candidates with bilingual stenography candidates with
English Stenography may be considered eligible.

b. Personal Assistant (PA):- Graduate (above 55%) with speed of 80 w.p.m. in Hindi & English
stenography and 40/35 w.p.m. in English and Hindi typing and knowledge in computer
application with three years experience. In absence of candidates with bilingual stenography
candidates with English Stenography may be considered eligible.
c. Lower Division Assistant (LDA):- Graduate with knowledge of noting & drafting and 1 year
experience in Govt./ Semi Govt. organization with knowledge of typing having speed of 35
w.p.m. in Hindi & 40 w.p.m. in English and knowledge of Computer.
3. The Certificate for the required skill e.g. stenography speed, typing speed, computer applications, etc
is available from any competent authority/recognized institution, then that certification will suffice.
However, if such a certificate is not available, Skill Test/ Technical Examination will be held.
Candidates equal to three times the number of posts advertised in each category will be shortlisted
after the Common Recruitment Test (CRT) to appear for the Skill Test/ Technical Examination in
Stenography/ Typing Test etc. In case of a tie at the last place, all applicants who tie at the last place
will be called for the Skill Test/ Technical Examination. This list will be declared in order of Roll No./ in
alphabetical order (NOT in order of merit). In such cases, however, the Skill Test/ Technical
Examination will be only qualifying in nature and such marks (of the Skill Test/ Technical Examination)
shall not be counted in the overall selection procedure i.e. the final selection will be made on the basis
of the marks obtained in the CRT only by the candidates who qualify the Skill Test/ Technical
Examination. It may, therefore, so happen that a candidate who stands high in the merit list of the
CRT may not be selected finally because he/she fails to qualify the Skill Test/ Technical Examination.
For this reason, the final merit list of the CRT will be declared after the qualifying Skill Test/ Technical
Examination only. It needs to be noted that the Skill Test/ Technical Examination which is qualifying in
nature has to be held after the written examination because of logistic reasons, considering a large
number of applications.

AN
ACT
further to amend the Uttar Pradesh Pablic. Services (Reservation for
Physically Handicappect Dependants ofFreedom Fighters and Er-Servicemen) Act, 1993.
IT IS HEREBY enacted in the Sixty-ninth Year of the Republic of India as follows :-
1. (1) This Act may be called the Uttar Pradesh Public Services (Reservation for Short title and
Physically Handicapped, Dependants of Freedom Fighters and Ex-Servicemen) (Amendment) commencement
Act, 2018.
(2) It shall be deemed to have come into force on July 23, 2018 .

Amenchnent of 2. In section 2 of the Uttar Pradesh Public Services (Reservation for Physically
section 2 of U.P..
Handicapped, Dependants of Freedom Fighters and Ex-Servicemen) Act, 1993 hereinafter
Act no. 4 of 1993
referred to as the principal Act, forLelause (e) the following clause shall be substituted namely :-
"(e) Physical disability means the disabilities as specified in the Schedule
appended to this' Act."
Amendment of 3. In section 3 of the principal Act, in sub-section (1) for clause (ii) the following clause
section 3
shall be substituted namely:-
"(ii) In such public services and posts as the State Government may, by
notification, identify not less than four percent, of the total number of vacancies in
the cadre strength in each group of posts meant to be filled with persons with
benchmark disabilities of which, one percent each shall be reserved for persons
With benchmark disabilities under clauses (a), (b) and (c) and one percent for
persons with benchmark disabilities under clauses (d) and (e), namely:—
(a) blindness and low vision;
. (b) deaf and hard of hearing; •
locomotor disability including cerebral palsy, leprosy cured,
dwarfism, acid attack victims and muscular dystrophy;
autism, intellectual disability, specific learning disability and
mental illness;
multiple disabilities from amongst persons under clauses (a) to (d)
including deaf-blindness in the posts identified for each disabilities."
Insertion of 4. In the principal Act, the following schedule shall be inserted at the end.
Schedule
"SCHEDULE
[See clause (e) of section 2]
Specified Physical Disability
1- Physical disability:-
A. Locomotor disability (a person's inability to execute distinctive activities associated with
movement of self and objects resulting from affliction of musculoskeletal or nervous system or both),
including—
(a) "leprosy cured person" means a person who haS been cured of leprosy but is suffering
from—
loss of sensation in hands or feet as well as loss of sensation and paresis in the eye
and eye-lid but With no manifest deformity;.
manifest deformity and paresis but having sufficient mobility in their hands and
feet to enable them to engage.in normal economic activity;
extreme physical deformity as well as advanced age which prevents him/her from
undertaking any gainful occupation, and the expression "leprosy cured" shall construed
accordingly;
(b) "cerebral palsy" means a group of non-prOgressive neurological condition affecting
body movements and muscle coordination, caused by damage to one or more specific areas of the
brain, usually occurring before, during or shortly after birth; •
(c) "dwarfism" means a medical or genetic condition resulting in an adult height of 4 feet
10 inches (147. centimeters) or less;
(d) "muscular dystrophy" means a group of hereditary genetic muscle disease that weakens
the muscles that move the human body and persons with multiple dystrophy have incorrect and
missing information in their genes, which prevents them from making the proteins they need for

healthy muscles. It is characterised by progressive skeletal muscle weakness, defects in muscle
proteins, and the death of muscle cells and tissues;
(e) "acid attack victims" means a person disfigured due to violent assaults by throwing of
acid or similar corrosive substance.
B. Visual impairment—
(a) "blindness" means a condition where a person has any of the following conditions, after
best correction—
(1) total absence of sight; or
visual acuity less than 3/60 or less than 10/200 (Snellen) in the better eye with
best possible correction; or
limitation of the field of vision subtending an angle of less than IO degree.
(b) "low-vision" means a condition where a person has any of the following conditons,
namely:—
(i) visual acuity not exceeding 6/18 or less than 20/60 upto 3/60 or upto 10/200
(Snellen) in the better eye with best possible corrections; or (ii) limitation of the field of
vision subtending an angle of less than 40 degree up to 10 degree.
C. Hearing impairment—
"deaf' means persons having 70 DB hearing loss in speech frequencies in both ears;
"hard of hearing" means person having 60 DB to 70 DB hearing loss in speech
frequencieS in both ears.
D. "speech and language disability" means a permanent disability arising out of conditions such as
laryngectomy or aphasia affecting one or more components of speech and language due to organic or
neurological causes.
2. Intellectual disability, a condition characterised by significant limitation both in intellectual functioning
(reasoning, learning, problem solving) and in adaptive behaviour which covers a range of every day,
social and practical skills, including—
"specific learning disabilities" means a heterogeneous group of . conditions wherein
there' is a deficit in processing language, spoken or written, that may manifest itself as a difficulty
to comprehend, speak, read, write, spell, or td do mathematical calculations and includes such
conditions as perceptual disabilities, dyslexia, dysgraphia, dyscalculia, dyspraxia and
developmental aphasia;
"autism spectrum disorder" means a neuro-developmental condition typically appearing
in the first three years of life that significantly affects a person's ability to communicate,
understand relationships and relate to others, and is frequently associated with unusal or
stereotypical rituals or behaviours.
3. Mental behaviour,—
"mental illness" means a substantial disorder of thinking, mood, perception, orientation or
memory that grossly impairs judgment, behaviour, capacity to recognise.reality or ability to meet
the ordinary demands of life, but does not include retardation which is a conditon of arrested or
incomplete development of mind of a person, specially characterised by subnormality of
intelligence.
4. Disability caused due to—
(a) chronic neurological conditions, such as—
(0 "multiplesclerosis" means an inflammatory, nervous system disease in which the
myelin sheaths.around the axons of nerve cells of the brain and spinal cord are damaged, leading
to demyelination and affecting the ability of nerve cells in the brain and spinal cord to
communicate with each other;
"parkinson's disease" means a progressive disease of the nervous system marked "by
tremor, •muscular rigidity, and slow, imprecise movement, chiefly affecting middle-aged and

elderly people associated with degeneration of the basal ganglia of the brain and a deficiency of
the neurotransmitter dopamine. -
(b) Blood disorder—
(z) "haemophilia" means an inheritable disease, usually affecting only male but
transmitted by women to their male children, characterised by loss or impairment of the
normal clotting ability of blood so that a minor wound may result in fatal bleeding;
(II) "thalassemia" means a group of inherited disorders characterised by reduced or
absent amounts of haemoglobin.
(iii) "sickle cell disease" means a hemolytic disorder characterised by chronic anemia,
painful .events, and various complications due to associated tissue and organ damage;
Explanation :- "hemolytic" refers to the destruction of the cellmembrane of red
blood cells resulting in the release of haemoglobin.
Multiple Disabilities (more than one of the 'above specified disabilities) including deaf blindness
which means a condition in which a person may have combination of hearing and visual impairments
causing severe communication, developmental, and educational problems.
Any other category as may be notified by the State Government."
Repeal and -5. (1) The Uttar Pradesh Public Services (Reservation for Physically Handicapped,
saving
Dependants of Freedom Fighters and Ex-Servicemen) (Amendment) Ordinance, 2018 is hereby Ordinance
repealed. no. II of
, . 2018
(2) Notwithstanding such repeal, anything done or any action taken under the
provisions of the principal Act as amended by the Ordinance referred to in sub-section
(1) shall be deemed to have been done or taken under the corresponding provisions of the
principal Act as amended by this Act, as if the provisions of this Act were in force at all
material tithes.
STATEMENT OF OBJECTS AND REASONS

The Uttar Pradesh Public Services (Reservation for Physically Handicapped, Dependents of
Freedom Fighters and Ex-servicemen) Act, 1993 has been enacted to provide for 'reservation of posts in
favour of physically handicapped, dependents of freedom fighters and ex-servicemen. In clause (e) of
section 2 of the said Act the words "physically handicapped" have been defined and clause (ii) of •
sub-section (1) of section 3 of the said Act provides that in such public services and posts in connection
with the affairs of the State, the State Government may, by notification, 'identify one percent of vacancies
each for person suffering from (a) blindness and low vision, (b) hearing impairment; and (c) locomotors
disability or cerebral palsy.
The Rights of Persons with Disabilities Act, 2016, has been enacted by the Government of India
in which the words Icersons with disability" have been defined.
It has been decided to amend the Uttar Pradesh Public Services (Reservation for Physically
Handicapped, Depenaents of Freedom Fighters nd Ex-Servicemen) Act, 1993 to make the provisions of
the said Act identical to the provisions of the said Central Act with respect to the persons with disabilities.
Since the State Legislature was not iut session and immediate Legislative action was necessary to
implement the eforesaid- decision, the Uttar Pradesh Public Services (Reservation For. Physically Handicapped,
Dependants of Freedom Fighters and Ex-Servicemen) (Amendment) Ordinance, 2018 (UP. Ordinance no. 11 of -
2018) was promulgated by the Governor on July 23,2018:

तर पद पर चयन हे तु सा ा कार को व हत कया जाना यायोिचत पाता है तो
शासक य वभाग सरकार के कािमक वभाग को समुिचत ताव तुत करे गा, जो ऐसे

and in supersession of all existing rules and orders on the subject, the Governor is pleased to
make the following rules:
THE UTTAR PRADESH DIRECT RECRUITMENT TO JUNIOR LEVEL

POSTS (DISCONTINUATION OF INTERVIEW) RULES, 2017
Short title, 1- (1) These rules may be called the Uttar Pradesh Direct Recruitment To
Commencement Junior Level Posts (Discontinuation Of Interview) Rules, 2017.
and application
(2) They shall come into force at once.
(3) They shall apply to direct recruitment to junior level posts under the
rule making power of the Governor under the proviso to Article 309 of
the Constitution, except the posts and Departments, which are excluded
from application of these rules by the Government by notified order.
Overriding 2- These rules shall have effect notwithstanding anything to the contrary
effect contained in any other rules or orders.
Definitions 3- In these rules, unless there is anything repugnant in the subject or
context:
(a) "appointing authority" means the authority empowered to make

(b) "Constitution" means the constitution of India;
(c) "Government" means the State Government of Uttar Pradesh;
(d) "Governor" means the Governor of Uttar Pradesh;
(e) "Junior Level Posts" means the posts as classified in group 'B' (non-
gazetted), group 'C' and group 'D' by the Government from time to
time.
Discontinuation 4- The provision of interview prescribed in the selection procedure in

in the marks prescribed for written examination. In case there is no

provision for written examination, the marks prescribed for

interview shall be presumed as the marks prescribed for written
examination.
(c) For selection to the posts where skill test or technical examination is
required, the marks prescribed for such test/examination shall be
only qualifying in nature and such marks shall not be counted in the
overall selection procedure.
(d) If prior to commencement of these rules, the advertisement for
selection to any junior level post has been made and the selection
process is ongoing, such selection shall remain unaffected and shall
be made in accordance with the advertisement issued in this behalf.
(e) If in special circumstances, the Administrative Department of the
Government finds a justification to prescribe the interview for
selection to a particular junior level post, the Administrative
Department will submit the appropriate proposal to the Personnel
Department of the Government, which will take a well-considered
decision on such proposal.

केवल पूणाक को ह सं ान म िलया जायेगा तथा िभ न ( ै शन) को नजरअंदाज (इ नोर)
कया जायेगा। उदाहरणाथ य द ितशत के आधार पर आर त र य क सं या 1.5 आती है ,

Subject: Relaxation of terms and conditions of selection while selecting disabled

Ex-servicemen and dependents of Armed Forces Personnel killed in
action for recruitment in CPSEs - regarding.
The undersigned is directed to refer to % Ex-servicemen Welfare OM No.

28( 48)/2017 /D(Res-I) dated 04-09-2017and 13-10-2017 on above stated subject vide
which OPE has been requested to make provisions in the extent guidelines for relaxed
standards in respect of disabled ex-serviceman/ dependents of ex-servicemen killed in
action for recruitment in Central Public Sector Enterprises (CPSEs). As per extent
reservation policy for recruitment of ex-servicemen in CPSEs, there is a reservation to .
the extent of 14.5% and 24.5 % in non-executive level posts comparable with Group
'C' & '0' posts respectively in Government setup. This includes 4.5% reservation for
disabled ex-servicemen and dependents of servicemen killed in action.
2. In view of above mentioned OMs' No. 28(48)/2017 /D(Res-I) dated 04-09-

2017 .and 13-10-2017 of % Ex-servicemen Welfare, all Administrative Ministries /
Departments concerned with CPSEs are requested to advice CPSEs under their
jurisdiction to consider making provisions for relaxed standards in respect of disabled
ex-serviceman/ dependents of servicemen killed in action, if sufficient number 'of'
candidates belonging to these categories are not available on the basis of general
standards to fill up all the vacancies reserved for them. The candidates belonging to .
these categories may be selected under a relaxed standard of selection in terms of
DoPT notification no.15012/8/82-Estt.(D) dated 12-02-1986 (copy enclosed) to make
P.T.O.

up the deficiency in the reserved quota subject to the condition that such relaxation
will not affect the level of performance by such candidates.

pleased to order the publication of the following English translation of the Uttar Pradesh Lok Seva
(Shark& Roop Se Viklang, Swatantrata Sangram Senaniyon Ke A shrit Aur. Bhotpurva Sainikon Ke Liye
Arakshan) (Sanshodhan) Adhyadesh, 2018 (Uttar Pradesh Adhyadesh gankhya 11 of 2018) promulgated
by the Governor:—
THE UTTAR PRADESH PUBLIC SERVICES (RESERVATION FOR PHYSICALLY
HANDICAPPED, DEPENDANTS OF FREEDOM FIGHTERS AND EX-SERVICEMEN)
(AMENDMENT) ORDINANCE, 2018

AN
ORDINANCE
further to amend the Uttar Pradesh Public Services (Reservation for Physically Handicapped, Dependants
of Freedom Fighters and Ex-Servicemen) Act, 1993.
WHEREAS the State Legislature is not in session and the Governor is satisfied that circumstances exist
which render it necessary for him to take immediate action;
Now, THEREFORE, in exercise of the powers conferred by clause (1) of Article 213 of the Constitution of
India, the Governor is pleased to promulgate the following Ordinance:-
1. This Ordinance may be called the Uttar Pradesh Public Services (Reservation for Short title
Physically Handicapped, Dependants of Freedom Fighters and Ex-Servicemen) (Amendment)
Ordinance, 2018.

Amendment of • 2. In section 2 of the Uttar Pradesh Public Services (Reserv . ation for Physically
section 2 of UP. Act Handicapped, Dependants of Freedom Fighters and Ex-Servicemen) Act, 1993 hereinafter
no. 4 of 1993
referred to as the principal Act, for clause (e) the following clause shall be substituted,
namely :-
"(e) Physical disability means the disabilities as specified in the Schedule
appended to this Act."
Amendment of 3. In section 3 of the principal Act, in sub-section (1) for clause (ii) the following
section 3 clause shall be substituted namely :-
"(ii) In such public services and posts as the State Government may, by
notification, identify not less than four percent, of the total number of
vacancies in the cadre strength in each group of posts meant to be filled with
persons with benchmark disabilities of which, one percent each shall be
reserved for persons with benchmark disabilities under clauses (a), (b) and (c)
and one percent for persons with benchmark disabilities under clauses (d) and
(e), namely:—
blindness and low vision;
deaf and hard of hearing;
locomotor disability including cerebral palsy, leprosy cured,
dwarfism, acid attack victims and muscular dystrophy;
autism, intellectual disability, specific learning disability and
mental illness;
multiple disabilities from amongst persons under clauses (a) to (d)
including deaf-blindness in the posts identified for each disabilities."
Insertion of 4. In the principal Act, the following Schedule shall be inserted at the end.
Schedule
The Schedule
[see clause (e) of section 21
Specified Physical Disability
1. Physical disability:-
A. Locomotor disability (a person's inability to execute distinctive activities associated with
movement of self and objects resulting from affliction of musculoskeletal or nervous system or both),
including—
(a) "leprosy cured person" means a person who has been cured of leprosy but is suffering
from—
loss of sensation in hands or feet as well as loss of sensation and paresis in the eye and
eye-lid but with no manifest deformity;
manifest deformity and paresis but having sufficient mobility in their hands and feet to
enable them to engage in normal economic activity;
extreme physical deformity as well as advanced age which prevents him/her from
undertaking any gainful occupation, and the expression "leprosy cured" shall be construed
accordingly.
(b) "cerebral palsy" means a group of non-progressive neurological condition affecting body
movements and muscle coordination, caused by damage to one or more specific areas of the brain,
usually occurring before, during or shortly after birth;
(c) "dwarfism" means a medical or genetic condition resulting in an adult height of 4 feet 10
inches (147 centimeters) or less;
(d) "muscular dystrophy" means a group of hereditary genetic muscle disease that weakens the
muscles that move the human body and persons with multiple dystrophy have incorrect and
missing information in their genes, which prevents them from making the proteins they need for
healthy muscles. It is characterised by progressive skeletal muscle weakness, defects in muscle
proteins, and the death of muscle cells and tissues;

(e) "acid attack victims" means a person disfigured due to violent assaults by throwing of acid
or similar corrosive substance.
B. Visual impairment—
(a) "blindness" means a condition where a person has any of the following conditions,
after best correction—
total absence of sight; or
visual acuity less than 3/60 or less than 10/200 (Snellen) in the better eye with best
possible correction; or
limitation of the field of vision subtending an angle of less than 10 degree.
(b) "low-vision" means a condition where a person has any of the following conditons,
namely:—
visual acuity not exceeding 6/18 or less than 20/60 upto 3/60 or upto 10/200 (Snellen)
in the better eye with best possible corrections; or
limitation of the field of vision subtending an angle of less than 40 degree up to 10
degree.
C. Hearing impairment—
"deaf' means persons having 70 DB hearing loss in speech frequencies in both ears;
"hard of hearing" means person having 60 DB to 70 DB hearing loss in speech
frequencies in both ears;
D. "Speech and Language Disability" means a permanent disability arising out of conditions such
as laryngectomy or aphasia affecting one or more components of speech and language due to organic or
neurological causes.
2. Intellectual disability, a condition characterised by significant limitation both in intellectual
functioning (reasoning, learning, problem solving) and in adaptive behaviour which covers a range of
every day, social and practical skills, including—
"specific learning disabilities" means a heterogeneous group of conditions wherein there
is a deficit in processing language, spoken or written, that may manifest itself as a difficulty to
comprehend, speak, read, write, spell, or to do mathematical calculations and includes such
conditions as perceptual disabilities, dyslexia, dysgraphia, dyscalculia, dyspraxia and
developmental aphasia;
"autism spectrum disorder" means a neuro-developmental condition typically appearing
in the first three years of life that significantly affects a person's ability to communicate,
understand relationships and relate• to others, and is frequently associated with unusual or
stereotypical rituals or behaviours.
3. Mental behaviour,—
"mental illness" means a substantial disorder of thinking, mood, perception, orientation or
memory that grossly impairs judgment, behaviour, capacity to recognise reality or ability to meet the
ordinary demands of life, but does not include retardation which is a conditon of arrested or incomplete
development of mind of a person, specially characterised by subnormality of intelligence.
4. Disability caused due to—
(a) chronic neurological conditions, such as—
"multiple sclerosis" means an inflammatory, nervous system disease in which the
myelin sheaths around the axons of nerve cells of the brain and spinal cord are damaged,
leading to demyelination and affecting the ability of nerve cells in the brain and spinal coal
to communicate with each other;
"parkinson's disease" means a progressive disease of the nervous system marked by
tremor, muscular rigidity, and slow, imprecise movement, chiefly affecting middle-aged and
elderly people associated with degeneration of the basal ganglia of the brain and a
deficiency of the neurotransmitter dopamine.

(b) Blood disorder—
"haemophilia" means an inheritable disease, usually affecting only male but
transmitted by women to their male children, characterised by loss or impairment of the
normal clotting ability of blood so that a minor wound may result in fatal bleeding;
"thalassemia" means a group of inherited disorders characterised by reduced' or
absent amount of haemoglobin.
"sickle cell disease" means a hemolytic disorder characterised by chronic anemia,
painful events, and various complications due to associated tissue and organ damage;
Explanation: "hemolytic" refers to the destruction of the cellmembrane of red blood cells resulting
in the release of haemoglobin.
Multiple Disabilities (more than one of the above specified disabilities) including deaf
blindness which means a condition in which a person may have combination of hearing and visual
impairments causing severe communication, developmental, and educational problems.
Any other category as may be notified by the State Government.

IT IS HEREBY enacted in the Seventy second year of the Republic of India as
follows:-
I. This Act may be called the Uttar Pradesh Public Services (Reservation For Short title
Physically Handicapped, Dependents of Freedom Fighters And Ex-Servicemen)
(Amendment) Act, 2021.
2. In section 3 of the Uttar Pradesh Public Services (Reservation for Physically Amendment of
section 3 of
Handicapped, Dependents of Freedom Fighters and Ex-Servicemen)Act, 1993 in sub-
U.P. Act no. 4
section (1) for the existing clause (i-a), the following clause shall be substituted, of 1993
namely:-

(i-a) in pubh cservices and posts other than Group 'A' posts, on and from the date
on which the Uttar Pradesh Public Services (Reservation for Physically Handicapped,
Dependents of Freedom Fighters and Ex-Servicemen) (Amendment) Act, 2021 is
published in the Gazette, five percent of vacancies for ex-servicemen.
STATEMENT OF OBJECTS AND REASONS

Freedom Fighters and Ex-Servicemen)Act, 1993 has been enacted to provide for reservation of posts in
favour of physically handicapped, dependents of freedom fighters and Ex-Servicemen. The aforesaid Act
was amended vide the Uttar Pradesh Public Services (Reservation for Physically Handicapped,
Dependents of Freedom Fighters and Ex-Servicemen) (Amendment) Act, 1999 whereby five percent
reservation of ex-servicemen is permitted on posts other than Group "A" and Group "B" posts.
With a view to providing representation to ex-servicemen in State subordinate public services
and posts, it has been decided to provide five percent reservation to them in Group "B" posts also.
Freedom Fighters and Ex-Servicemen) Bill, 2021 is introduced accordingly.

PHYSICALLY HANDICAPPED, DEPENDENTS OF FREEDOM
FfGHTERS AND EX-SERVICENIEN) ACT, 1993

AN
ACT
to provide for the reservation of posts in favour of physically handicapped,
dependents of freedom-fighters and ex-servicemen and for matters connected
therewith or incidental thereto.
IT IS HEREBY enacted in the Forty-fourth Year of the Republic of
India as follows :-
Short title and 1. (1) This Act may be called the Uttar Pradesh Public Services
ComMenCEMent
(Reservation for Physically Handicapped, Dependents of Freedom Fighters
and Ex-Servicemen) Act, 1993.
(2) It shall be deemedito have come into force on December II, 1993.
Definitions 2. In this Act—
(a) "Backward Classes" means the backward classes of citizens
specified in Schedule Ito the Uttar Pradesh Publie Services (Reservation
for Backward Classes) Act, 1989.
(b) "dependent" with reference to R freedom fighter means,=
son and daughter (married or unmarried),
grandson (son of a son) and unmarried grand daughter
(daughter of a son),
of the freedom-fighter.
(c) "ex-serviceman" means a person who has served in any rank,
as a combatant or non-combatant, in the Indian Army, Navy or
Airforce, and—
has retired from such service alter earning his pension, or
has been released frofli. such service on medical grounds, ;
in accordance with the requirements of such service, or because
of circumstances beyond his control and has been grant ed
-medical or disability pension, or
has been released, otherwise, than on his own request, as
a consequence of reduction in the establishment of such
service, or
has been released from such service after a fixed specific
period, but has not been released on his own request or has •
not lx.en dismissed or discharged on account of miSconduct or 11
inefficiency and has been granted gratuity;
and includes the following categories or territetial Army personnel
who—
(i) get pension for continuous embodied service,
(n) have become medically unfit owing to military service, and
(iii) arc winners of gallantry award.

(d)
"freedom fishier" means a person domiciled in Uttar Pradesh who
had paiticipatod in the freedom struggle of India and had—
(i) laid down his life; or
undergone sentence of imprisonment for .a period of at
least two months; or
been detained in prison as an undertrial or a detend for a
period of at least three months ; or
been sentenced with at least ten canes ; or
been declared as an absconder ; or
sustained bullet injuries ; or
participated in 'Peshawar Kand' ; or
been a member of Indian National Army ; or
been a certified member of India Independence League ; or
been released under the 'Gandhi Irwin Pact'.
Explanation—For the purposes of this clause, a person who
had sought and had been pardoned shall not be deemed to be a
freedom fighter.
(e) "physically handicapped" means a person—
who suffers from total absence of eyesight or from limitation

of the field of vision
subtending an angle of 20 degrees or worse
or whose visual acuity does not exceed 62C60 or 20/200 (snellen) in
the better eye with correcting lense ; or
whose sense of hearing is non functional for ordinary

purposes of life or who suffers from hearing loss of more than 90
decibels in the better ear (Profound impairment) or total loss of
hearing in both ears ; or
(iii) who has a physical defect or deformity which causes an
interference with the normal functionings of the bones, muscles
and joints.
(f)
"year of recruitment" means a period of twelve-months commenc-
ing on the first of July.
3. (I) In public services and posts in connection with the affairs of the Reservation o I

Lemonl of 4. (I) If any difficulty arises M giving effect to the provisions of this
cifficultins Act, the State Government may, by a notifiec order, make such provisions
not incolasistent with the provisions of this Act as appears to It to be
necessary or expedient for removing the difficulty.
No order under sub-section (1) shall be made after the expiration of
the period of two years from, the commencement. of this Act.
Every order made under sub. seetion(1) shall be laid, as soon as may
be, before both the Houses of State Legislature and the provisions of sub-
section (1) of section 23-A of the Uttar Pradesh General Clauses Act, 1904
shall apply as they apply in respect of rules made by the State Government
under any Uttar Pradesh Act.
Savings $. The provisions of this Act shall not apply to cases In which
selection process has started before the commencement of this Act.
Repeal and 6. (1) The Uttar Pradesh Public Services (Reservation for Physically
Savings Handicapped etc.) Ordinance, 1993 is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken
under the provisions of the Ordinance referred to in sub-section (1) shall be
deemed to have been done or taken under the corresponding provisions of
this Act as if the provisions of this Act were in force at all material times.

अ धसू चना दनांक 12.01.2019 के मा यम से भारत का सं वधान म 103वां संशोधन करते हु ये
सरकार सेवाओं क सभी े णय म नयु ि त के लये व अ पसं यक सं थाओं को छोड़कर
सरकार व नजी शै णक सं थान ( अनु दा नत एवं गैर अनु दा नत ) म वेश के लये आ थक
प से कमजोर वग के लये अ धकतम 10 तशत का आर ण अनु म य कया गया है।
2. त म म समाज क याण वभाग के आदे श सं या-325/26-3-2019, दनांक-22.01.
2019 वारा रा य सरकार क सरकार सेवाओं क सभी े णय म नयु ि त के लये तथा
अ पसं यक सं थाओं को छोड़कर सभी सरकार व नजी शै णक सं थाओं (अनु दा नत एवं गैर
अनु दा नत) म वेश के लये आ थक प से कमजोर वग के लये अ धकतम 10 तशत
आर ण दान करने का नणय लया गया है।
3. सामािजक याय एवं अ धका रता मं ालय, भारत सरकार, नई द ल के कायालय- ाप
दनांक-17.01.2019 के म म का मक एवं श ण मं ालय, भारत सरकार वारा कायालय
ाप सं या-36039/1/2019-Estt.(Res.), दनांक-19.01.2019 के मा यम से आ थक प से
कमजोर वग को भारत सरकार क स वल पो ट ए ड स वसेज म आर ण दये जाने क
यव था क गयी है, जो न नवत ् है :-
"Reference is invited to Ministry of Social Justice and Empowerment O.M.No. F.No.
20013/01/2018-BC-II dated 17.01.2019 on the above mentioned subject, which, inter-alia, reads
as under:-
"1. In pursuance of insertion of clauses 15(6) and 16(6) in the constitution vide the
Constitution (One Hundred and Third Amendment)Act, 2019 and in order to enable the
Economically Weaker Sections (EWSs)who are not covered under the existing scheme of
reservations for the Scheduled Castes, the Scheduled Tribes and the Socially and
Educationally Backward Classes, to receive the benefits of reservation on a preferential
basis in civil posts and services in the Government of India and admission in Educational
Institutions, it has been decided by the Government to provide 10% reservation to EWSs
in civil posts and services in Government of India and admission in Educational
Institutions.
2. Persons who are not covered under the existing scheme of reservations for the
Scheduled Castes, the Scheduled Tribes and the Socially and Educationally Backward
Classes and Whose family has gross annual income below Rs. 8.00 lakh are to be
identified as EWSs for the benefit of reservation. Family for this purpose will include the
person who seeks benefit of reservation, his/her parents and siblings below the age of

18 years as also his/her spouse and children below the age of 18 years. The income
shall include income from all sources i.e. salary, agriculture, business, profession etc. and
it will be income for the financial year prior to the year of application. Also persons
whose family owns or possesses any of the following assets shall be excluded from
being identified as EWSs, irrespective of the family income:
i 5 acres of Agricultural Land and above;
ii. Residential flat of 1000 sq. ft. and above:
iii. Residential plot of 100 sq. yards and above in notified
municipalities:
iv. Residential plot of 200 sq. yards and above in areas other than
the notified municipalities.
3. The income and assets of the families as mentioned in para 2 would be required
to be certified by an officer not below the rank of Tehsildar in the States/UTs. The
officer who issues the certificate would do the same after carefully verifying all relevant
documents following due process as prescribed by the respective State/UT.

5- Instructions regarding reservation in employment and admission to educational
institutions will be issued by DOPT and Ministry of HRD respectively."
2. In pursuance of the above office Memorandum, it is hereby notified that 10%
reservation would be provided for Economically Weaker Sections (EWSs) in Central
Government posts and services and would be effective in respect of all Direct
Recruitment vacancies to be notified on or after 01-02-2019
3. Detailed Instructions regarding operation of roster and procedure for
implementation of EWS reservation will be issued separately. "
4- The Constitution (One Hundred and Third Amendment)Act, 2019 के म म

रा याधीन लोक सेवाओं और पद पर आर ण दान करने हे तु न नवत ् यव था / मानक
नधा रत कये जाने का नणय लया गया हैः-
(क) आ थक प से कमजोर वग के ऐसे यि तय जो अनु सू चत जा त, अनु सू चत
जनजा त तथा अ य पछड़े वग के लए आर ण क वतमान यव था से
आ छा दत नह ं है, को उ र दे श सरकार क लोक सेवाओं और पद क सभी
े णय म सीधी भत के म पर 10 तशत का आर ण दान कया जाय।
(ख) उ र दे श सरकार क लोक सेवाओं और पद क सभी े णय म सीधी भत के
म पर आ थक प से कमजोर वग के लये अनु म य कये गये 10 तशत
आर ण का लाभ ा त करने हे तु ऐसे यि त, पा /अह ह गेः-
(i) िजनके प रवार क सम त ोत से ा त होने वाल कु ल वा षक आय 0-8.00 लाख
से कम होगी। सम त ोत से आय म वेतन, कृ ष, यापार, यवसाय आ द से ा त

होगी। इस उ दे य के लये लाभ ा त करने वाले यि त के प रवार म उसके/उसक
माता- पता व 18 वष से कम आयु के भाई-बहन के साथ-साथ उसका/उसक , प त/प नी
और 18 वष से कम आयु के उसके ब चे सि म लत ह गे। पर तु ;
(ii) ऐसे यि त, आ थक प से कमजोर वग क ेणी म पा नह ं ह गे :-
(अ) िजनके प रवार के वा म व अथवा क जे म 05 एकड़ या इससे अ धक
कृ ष भू म हो, या
(ब) 1000 वग फ ट या इससे अ धक े का आवासीय लैट हो, या
(स) अ धसू चत नगर पा लकाओं म 100 वग गज या अ धक े का
आवासीय भू-ख ड हो, या
(द) अ धसू चत नगर पा लकाओं के े से भ न े म 200 वग गज या
अ धक े का आवासीय भू-ख ड हो।
(iii) प रवार क आय और प रस प का माण प स बि धत े के तहसीलदार से
अ न न अ धकार वारा जार / मा णत कया जायेगा।
(iv) उ र दे श सरकार क लोक सेवाओं और पद क सभी े णय म सीधी भत के
म पर आ थक प से कमजोर वग के लये नयु ि तय म आर ण क
यव था दनांक 01.02.2019 या इसके उपरा त अ धसू चत / व ा पत होने वाल
रि तय पर भावी होगी।

दनांक 17.01.2019 वारा आ थक प से कमजोर वग के ऐसे यि तय जो अनु सू चत जा त,
अनु सू चत जन जा त एवं अ य पछड़े वग जो वतमान म लागू आर ण यव था से आ छा दत
नह ं है, के लए के य श ण सं थान म अ धकतम 10 तशत आर ण दे ने के लए आदे श
जार कया गया है, जो न नवत ् है :-
In accordance with the provisions of the Constitution (One Hundred and Third
Amendment) Act 2019. and the reference of Ministry of Social Justice and Empowerment vide
OM No. 20013/01/2018-BC-II dated-17th January 2019, enabling provision of reservation for the
Economically Weaker Sections (EWSs) who are not covered under the existing scheme of
reservations for the Scheduled Castes, the Scheduled Tribes and the Socially and Educationally
Backward Classes, It has been decided to provide reservation in admission to educational
institutions subject to a maximum of ten percent of the total seats in each category. This would
not apply to the minority educational institutions referred to in clause (1) of Article 30 of the
Constitution of India.
2. The provision of reservations to the Economically Weaker Sections shall be in
accordance with the directions contained in the OM No. 20013/01/2018-BC-II dated-17th January
2019 of the Ministry of Social Justice & Empowerment and shall be subject to the following:
a) The reservations shall be provided to EWSs for admission in Central Educational
Institution, (as defined in clause (d) of section (2) of the Central Educational Institutions
(Reservation in Admission) Act, 2006) from the academic year 2019-20 onwards.

b) The above reservation would not be applicable to the 8 Institutions of excellence,

research institutions, institutions of national & strategic importance as specified in the Schedule
to The Central Educational Institutions (Reservation in Admission) Act, 2006, as amended from
time to time, and appended to this OM, and to the minority educational institutions referred to in
clause (1) of article 30 of the Constitution.
c) Every Central Educational Institution shall, with the prior approval of the appropriate
authority (as defined in clause (c) of section 2 of The Central Educational Institutions
(Reservation in Admission) Act, 2006), increase the number of seats over and above its annual
permitted strength in each branch of study or faculty so that the number of seats available,
excluding those reserved for the persons belonging to the EWSs, is not less than the number of
such seats available, in each category, for the academic session immediately preceding the date
of the coming into force of this O.M.
d) Where, on a representation by any Central Educational Institution, the appropriate

authority is satisfied that for reasons of financial, physical or academic limitations or in order to
maintain the standards of education, the annual permitted strength in any branch of study or
faculty of such institution cannot be increased for the academic session following the
commencement of this Act, it may permit such institution to increase the annual permitted
strength over a maximum period of two years begining with the academic session following the
commencement of this Act; and then, the extent of reservation for the Economically Weaker
Sections shall be limited for that academic session in such manner that the number of seats
made available to the Economically Weaker Sections for each academic session shall not reduce
the number and the percentage of reservations provided for SC/ST/OBC categories.
e) The scheme for implementing the reservation for the EWS shall be displayed on the
website of the institution as soon as possible, but no later than 31st March 2019.
3. The Chairman UGC, Chairman AICTE and Chairperson NCTE and the Bureau Heads of
the Depratment of Higher Education in the Ministry of Human Resource Development responsible
for management of the Institutions of National Importance are requested to ensure immediate
compliance of this OM.

़ के लये वतमान म
लागू रा य सरकार क योजना/नी त से आ छा दत नह है, उ ह अ ययन क
येक शाखा अथवा संकाय म उपल ध कु ल सीटो के सापे अ धकतम 10
तशत का आर ण अनु म य कया जाय। दे श म उ कृ टता ा त अनु संधान
सं थान, द से ल इ ट यू शन ( रजवशन इन एड मशन) ए ट, 2006 के
अंतगत इ ट यू शन आफ नेशनल ए ड े टिजक इ पॉरटे स िज ह भारत
सरकार के आ फस मेमोरे डम दनांक 17.01.2019 म सि म लत कया गया है,
उन पर यह आर ण यव था भावी नह ं होगी।

ता वत यव था आगामी शै क स -2019-20 से लागू क जाय।
4) आ थक प से कमजोर वग के लए पा ता का मानक तर-4 के उप
तर(ख) के अनु सार ह होगा।
