The Chamber noted that both parties were content to approach the matter on the basis that each conviction was based solely or to a decisive degree on the two witnesses concerned and it proceeded on the same basis. The Chamber then considered the counterbalancing factors which the Government relied on in each case. First, it considered the counterbalancing factors that, in each case, the trial judge correctly applied the relevant statutory test and that the Court of Appeal reviewed the safety of each conviction. It found these factors to be of limited weight since the very issue in each case was whether the trial judges and the Court of Appeal had acted compatibly with Article 6 1 and 3 (d) of the Convention. 91. En premier lieu, elle sest penche sur largument selon lequel, dans chaque affaire, le juge avait correctement appliqu les critres lgaux pertinents et la Cour dappel avait examin la solidit du verdict de culpabilit. Elle a estim toutefois que ces considrations taient dun intrt limit ds lors que la question essentielle dans chacune des affaires tait celle de savoir si le juge du premier degr et la Cour dappel avaient respect larticle 6 1 et 3 d) de la Convention.
