THE RAJASTHAN IMPOSITION OF CEILING ON
AGRICULTURAL HOLDINGS (AMENDMENT) BILL, 2010
(To be Introduced in the Rajasthan Legislative Assembly)

further to amend the Rajasthan Imposition of Ceiling on
Agricultural Holdings Act, 1973.
Be it enacted by the Rajasthan State Legislature in the
Sixty-first Year of the Republic of India, as follows:-
1. Short title, extent and commencement.–(1) This Act
may be called the Rajasthan Imposition of Ceiling on Agricultural
Holdings (Amendment) Act, 2010.
(2) It extends to the whole of the State of Rajasthan.
(3) It shall come into force at once.
2. Amendment of section 17, Rajasthan Act No. 11 of
1973.–After the existing sub-section (4) of section 17 of the
Rajasthan Imposition of Ceiling on Agricultural Holdings Act,
1973 (Act No. 11 of 1973), the following sub-sections shall be
added, namely :-
"(5) Nothing in sub-sections (1) to (4) shall apply
to a person who acquires, with the prior approval of the
State Government or any other authority appointed by it in
this behalf, any land in excess of the ceiling area applicable
to him, to be used for any of the prescribed non-agricultural
purposes :
Provided that such person shall have to-
(i) apply for conversion of the land for the
proposed non-agricultural use within one
year from the date of such acquisition; and
(ii) commence the proposed non-agricultural use
of the land within a period of three years

from the date of conversion of the land for
the proposed non-agricultural purpose.
(6) Nothing in sub-sections (1) to (4) shall apply to
a person who has acquired, before the coming into force of
the Rajasthan Imposition of Ceiling on Agricultural
Holdings (Amendment) Act, 2010(Act No. ….. of 2010),
land in excess of the ceiling area applicable to him, if such
person applies to the State Government, within one year of
the coming into force of the aforesaid Act, for conversion
of the land for the prescribed non-agricultural purpose and
commences the proposed non-agricultural use of the land
within a period of three years from the date of conversion
of the land for the proposed non-agricultural purpose.
(7) If the person referred to in sub-section (5) or
sub-section (6) contravenes the provisions of sub-section
(5) or sub-section (6), as the case may be, or the conditions,
if any, specified in the approval granted under sub-section
(5), the approval shall be deemed to have been withdrawn,
and the order of conversion of land for non-agricultural use,
if any, shall be deemed to have been cancelled and the
provisions of sub-sections (1), (3) and (4) shall apply to
him mutatis mutandis as if he had acquired the land on the
date of such contravention.
Explanation.-The question as to whether the contravention
as referred to in this sub-section has been
committed or not shall be heard and decided
by the State Government whose decision
thereon shall be final.".

STATEMENT OF OBJECTS AND REASONS

Availability of government land is gradually diminishing,


especially in those areas where the investors usually want to set up
their projects. Therefore, it is gradually becoming difficult for the
State Government to provide government land for various projects
which are important for the economic development of the State or
for providing social infrastructure to the people of the State.
In view of the general environment in the country against
acquisition of agricultural land for use by Companies it is also
becoming difficult to acquire land for such projects under the
provisions of the Land Acquisition Act, 1894 (Central Act. No. 1
of 1894).

In such a situation, the only option available with the


investors is to directly purchase the land from the khatedars on
payment at mutually agreed price. However, the investors are
unable to purchase agricultural land directly from the khatedars
land beyond the maximum limits prescribed under the Rajasthan
Imposition of Ceiling on Agricultural Holdings Act, 1973 because
section 17 of the Act of 1973 prohibits even Companies from
acquiring agricultural land beyond the prescribed ceiling limits.
This provision is causing problems for those people who want to
set up various types of projects in the State after purchasing
agricultural land in excess of the ceiling limits and then getting the
agricultural land converted for the proposed non-agricultural
purpose. In such a situation, the pace of investment in the State is
likely to be adversely affected.
It would be in the larger interests of the State to permit such
persons to purchase agricultural land in excess of the ceiling limits
and thereafter get the same converted for the proposed non-
agricultural purpose for setting up of their project. However, under
the existing provisions of the Act of 1973 the State Government
can grant exemption only in respect of industrial projects. It is not
possible for the State Government to grant exemption for purchase

of agricultural lands in excess of the prescribed ceiling limits for
non-industrial projects like townships, housing projects,
infrastructure projects like dry ports, power plants, tourism units
(hotels & resorts), public utilities etc. which are necessary from the
viewpoint of the economic development of the State. It is,
therefore, proposed to make an amendment in section 17 to
provide for one-time exemption in respect of such lands. It is,
therefore, proposed that an amendment may be made in section 17
for empowering the State Government to grant permission in
individual cases for permitting purchase of agricultural land in
excess of the ceiling limits for the purpose of setting up various
types of projects.

Problems are also being faced by those persons who have,


in the absence of knowledge of the provisions of the above-
mentioned Act of 1973, already purchased agricultural land in
excess of the prescribed ceiling limits with the intention of getting
the land converted for non-agricultural use. Under the existing
provisions of the Act of 1973 it is not possible for the State
Government to grant exemption in respect of such agricultural
lands which have already been purchased in excess of the
prescribed ceiling limits for non-agricultural use. It is, therefore,
proposed to make an amendment in section 17 to provide for one-
time exemption in respect of such lands.

The Bill seeks to achieve the aforesaid objectives.
