Punuant to resolution WHA46.40 adopted by the World Health Assembly on 14 May 1993, and in accordance with Article 96, paragraph 2, of the Charter of the United Nations, Article 76 of the Constitution of the World Health Organization, and Article X, paragraph 2, of the Agreement between the United Nations and the World Health Organization, 1 have the honour ta lay bfore the International Court of Justice for its advisory opinion the following question: "ln view of the health and environmental effects, would the use of nuclear weapons by a State in war or other armed connict be a breach of i obligations under international law including the WHO Constitution?" 1 attach the tex&. in Enalish and French. of the resolution as well as the Basic I)ocumentsl of th; ~ o a Health 0rga"ization containing lhc WHO texts d referrcd 10, together with the documents' and records' ofthc Forty-sixrh World Health Assembly related ta that question.

En application de la rsolution WHA46.40 adopte par l'Assemble mondiale de la Sant le 14 mai 1993, et conformment aux dispositions du paragraphe 2 d e l'article 96 de la Charte des Nations Unies, de l'article 76 de la Consttution de l'Organisation mondiale de la Sant et du paragraphe 2 de I'ariicle X de l'accord entre l'Organisation des Nations Unies et l'Organisation mondiale de la Sant, j'ai l'honneur de soumettre la Cour internationale de Justice, pour avis consultatif, la question suivante: Compte tenu des effets des armes nuclaires sur la sant et l'environne: ment, leur utilisation par un Etat au cours d'une guerre ou d'un. autre conflit arm constituerait-elle une violation d e ses obligations au regard du droit international, y compris la Constitution de l'OMS? 11. RESOLUTION WHA46.40 ADOPTED ON 14 MAY 1993 AT THE 13TH PLENARY MEETING OF THE FORTY-SIXTH WORLD HEALTH ASSEMBLY
HEALTH ENVIRONMENTAL OF NUCLEAR AND EFFEC~S WEAWNS The Forty-sixth World Health Assembly, Bearing in mind the principles laid down in the WHO Constitution: Noting the report of the Director-General on health and environmental effects of nuclear weaponsl; Recalling resolutions WHA34.38, WHA36.28 and WHA40.24 on the effects of nuclear war on health and health services; Recognizing that it has been established that no health service in the world can alleviate in anv sianificant way a situation resulting from the use of even one single n u c ~ e a r w e ~ ~ o n ~ ; Recalling resolutions WHA42.26on WHO'S contribution Io the international efforts towards susminable devclopmcnt and WHA45.31 which draws anenlion to the effects on health of envionmental dearadation and recomizina the short- and long-temi environmental consequence<of the use of nuclear weaeons that would affect human health for generations; Recalling that primary prevention is the only appropriate means to deal with the health and environmental effects of the use of nuclear weapons2; Noting the concern of the world health community about the continued threat to health and the environment from nuclear weapons; Mindful ofthc roleof WHO a defincd in its Constitution to a n asthcdirens ing and coordinating authority on international hcalth work (Article 2 (a,): to propose conventions, agreementi and regulations (Article 2 (k)); to report on administrative and social techniques affecting public health from preventive and curative points of view (Article 2 (p)): and to take al1 necessary action to attain the objectives of the Organization (Article 2 (v)): Realizing that primary prevention of the health hazards of nuclear weapons rcauires clarity about the status in international law of their use. and that over thelast 48 veas marked differences of ooinion have been exvressed bv Member States a b o h the lawfulness of the use O nuclear weapons;' f 1. Ayant prsents l'esprit les principes noncs dans la Constitution de I'OMS: Prenant note du rapport du Directeur gnral sur les effets des armes nuclaires sur la sant eil'cnvironnement ': Rappelant les rsolutions WHA34.38, WHA36.28 et WHA4024surleseffe de la guerre nuclaire sur la sant et les services de sant: Reconnaissant qu'il a t tabli qu'aucun service de sant au monde n'tait capable &amliorer de manire significative une situation rsultant de I'utilisation ne serait-ce que d'une seule arme nuclaire2; Rappelant la rsolution WHA42.26 sur la contribution de I'OMS aux efforts internationaux en faveur &un dveloppement durable et la rsolution WHA45.31 oui annelle l'attention sur les efets de la dgradation de I'environ>~ nement sur la sant. et reconnaissant les consquences COUR et i long terme se sur l'environnement de l'utilisation &armes nuclaires, q u ~ feront sentir sur la sant de I'homme vendant des enrations: Rappelant que la prvention primaire est le seul moyen appropri de mditriser les effets sur la sant et I'environnement de l'utilisation d'armes nuclaires2: Notant la proccupation des milieux de la sant partout dans le monde devant la menace permanente que wnstituent les armes nuclaires pour la sant et I'environnment : Considrant oue le rle de I'OMS tel au'il est dfini dans sa Constitution est d'agir en tant q;'autorit directrice et &ordonnatrice, dans le domaine de la sant, des travaux ayant un caractre international (article 20)): de proposer des conventions. accords et rdements (article 2 k n : de faire connatrelestechniques adminiskives et socTales wn&rnant 13higinepublique et les soins mdicaux prventifs et curatifs (article 2p)): et, d'une manire gnrale, de prendre toute mesure ncessaire pour atteindre le but assign l'organisation (article 2 v)); Consciente du fait que la prvention primaire des risques pour la sant constitus var les armes nuclaires s u v w s e de vrciser comment la auestion de cours des leur utilisaiion esr envisagce au regard du droit'international et quarante-huit derni6res annes les Eta Membres ont exprim des vues trs divergentes quant la licit d e l'utilisation des armes nucltaires: 1.
