REZUMAT

Recentele cazuri de malpraxis din Romania si practica instantelor judecatoresti de a nu acorda

despAgubiri decat in foarte putine dintre aceste situatii, ne face s5 ne gandim uncle anume gresim. Ce
este prost reglementat? Ce prejudicii se pot repara si cum se determine acestea? La ce anume este
indreptatita o persoana atunci cand ii este vat5mata sanAtatea? De ce nu este protejat mult mai bine
pacientul? De ce abuzurile din partea medicilor nu sunt sanctionate in cea mai mare parte din cazuri?
Acestea sunt Intrebari la care am cautat sa dau un rAspuns, prin prisma noilor reglementAri,
incercand totodatA sA detaliez drepturile pacientilor si prejudiciile la care acestia sunt Indreptatiti.

RESUME

Les cas recentes de faute professionnelle enregistrees en Roumanie et la jurisprudence reticente

en matiere de dedommagements nous oblige refleter aux possibles erreurs commises. Quel est le point
faible de la reglementation actuelle? Quels sont les prejudices qui peuvent etre repares et comment
sont-ils etablis? Quels sont les droits d'un personne dont on a blesse la sante? Pourquoi le patient n'est -
il mieux protégé? Pourquoi les abus des medecins ne sont pas sanctionnes dans la plupart des cas?
Ce sont des questions auxquelles j'ai cherche a dormer une reponse, de la perspective des
nouvelles reglementations, en essayant de detainer, au meme temps, les droits des patients et les
dommages-interets auxquels ils ont droit.

ABSTRACT

Recent malpractice cases in Romania and the courts' practice to award compensations only in
very few cases makes us wonder what we are doing wrong. What is poorly regulated? What damage
can be repaired and how is it determined? To what is a persons entitled to when her health is injured?
Why isn't the patient being more protected? Why are the doctors' abuses not penalized in most of the
cases?
These are the questions that I sought to give an answer to, regarding the new regulations, while
trying to detail the patient's rights and the damages to which they are entitled to.
