NOTIFICATION

No.F- 4-34/Seven-1/2021.⸺ In exercise of the powers conferred by clauses (lxi) and (lxii)
of sub-section (2) of Section 258 of the Chhattisgarh Land Revenue Code, 1959 (No. 20 of
1959), read with Section 240 and 241, and in supersession of the rules regarding
prohibition or regulation of the cutting of trees, Notification No. F.2-8-Seven-sha- 8-94,
dated 29th July, 1997 and the rules regarding regulation of the felling and removal of
timber in villages adjoining Government Forest’s, Notification No 218-6477-Seven-Na (Rule),
dated 06th January, 1960, the State Government, hereby, makes the following rules,
namely: -
RULES
1. Short title, extent and commencement.- (1) These rules shall be called the Rules of
Felling of Trees, 2022.
(2) These rules shall be applicable in whole of the State of Chhattisgarh, where the
Code is in effect.
(3) It shall come into force from the date of its publication in the Official Gazette.
(4) The word "Code" mentioned in rules means the Chhattisgarh Land Revenue Code,
1959 (No. 20 of 1959).
2. No tree shall be cut, felled, girdled or otherwise damaged,-
(a) within 20 metres of the extreme edge of the bank of any water course, spring or a
tank;
(b) over an area covered by a grove within a radius of 20 metres of a sacred place;
(c) in the area under plantation of tree species under the Van Mahotsava programme
or under any other similar scheme;
(d) over an area set apart for an encamping ground, burial or burning ground,
gothan, threshing floor, bazaar or abadi.
 Explanation – for the purposes of clause (a) a water course shall include all streams,
rivers, rivulets and nallas which usually retain water up to the end of December, but
shall not include small temporary channels formed by the run off of water during
the monsoon.

3. Sub-Divisional Officer (revenue) may recommend the cutting of trees specified in rule 2
in the circumstances enumerated below, namely: –
(i) the trees or part thereof are likely to cause any harm or damage to life and
property or that there is likelihood of pollution of drinking water;
(ii) the trees are dead or dying;
(iii) the removal of trees is likely to beautify or increase amenities in a place of
public utility;
(iv) fruit bearing trees, which have become sterile, dried trees;
(v) other than fruit bearing species, which have attained the exploitable girth
(girth fixed by the concerned forest division can be considered as exploitable
girth);
(vi) trees, which are required to be cut in public interest.

4. Trees of the following species which are dead or dying can be cut with written
recommendation, given by the Gram Panchayat after valid resolution passed in the
Gram sabha constituted under the Chhattisgarh Panchayat Raj Adhiniyam, 1993 (No.
1 of 1994): –
(i) Mango (Mangifera indica)
(ii) Indian Blackberry (Syzygium Cumini)
(iii) Tamarind (Tamarindus Indica)
(iv) Mahua (Madhuca Latifolia)
(v) Chandan (Santalum Album)
(vi) Chhind, Taad and all other species of palm except Khajur
(vii) Harra (Terminalia Chebula)
(viii) Neem (Azadirachta Indica)
(ix) Kadamb (Anthocephalus Kadamba)
Provided that in any other circumstances, that is, other than when they are
dead or dying, the trees of the above species shall not be cut without the written
recommendation of the Sub-Divisional Officer (revenue).
5. Trees standing on Government or unoccupied land shall not be cut without the
recommendation of the Sub-Divisional Officer (revenue):
Provided that the Gram Panchayat through a valid resolution passed in its
duly convened meeting, may recommend cutting and removal of trees or parts thereof of
Babool species from unoccupied lands in the village, for bonafide use of the residents of
that village, in accordance with the Nistar Patrak Prepared under Section 234 of the
Code.
6. Registration, in Tahsil office, of trees.- (1) If the land of any Bhumiswami has, tree,
naturally grown or planted, as agriculture, before or after the coming into force of this
rule, and it is not recorded in the relevant revenue records, the Bhumiswami shall give
intimation in form-A to the Tahsildar and the forest range officer, within six months of
the coming into force of this rule.
(2) On receiving the intimation in form-A, the Tahsil office shall register in From-B after
field verification. Tahsildar shall ensure the entries of the registered trees in the revenue
(Panchsala khasra). The entries of current status shall be made in annual crop- survey
also.
7. Felling of naturally grown trees. – (1) Bhumiswami shall give application in form-C,
for felling of naturally growth trees on his land, to Sub-Divisional Officer (revenue), who
will forward it for joint inspection to revenue officer/staff not below Revenue Inspector
and forest officer/staff not below Vanpal. Inspection report in form-D, including the title
of Bhumiswami with respect to the trees, registration in revenue records,
death/maturity of trees, indispensability of felling for agriculture/business of
Bhumiswami etc, within 30 workdays shall be sent. Sub-Divisional Office (revenue) may
proceed without getting inspection report within prescribed period, also.
(2) Sub-Divisional Officer (revenue) shall send his recommendation in form-E, to
applicant and Divisional Forest Officer, within 45 workdays of receiving the application.
If the applicant does not receive written decision of Sub-Divisional Officer (revenue) on
his application within 45 workdays, he may give reminder by another written
application. If any written decision of Sub-Divisional Officer (revenue) is again not
received in further period of 30 workdays, then it shall be deemed that the
recommendation has been given on the application and the applicant shall be free for
felling of asked trees. The Sub-Divisional Officer (revenue) shall be answerable for the
delay and the contravention of rules, if any.
(3) The felling of naturally grown trees may be recommended for maximum 04 trees per
acre and maximum 10 trees in total over a land holding, in a calendar year.
(4) Bhumiswami may cut down trees subject to the provisions of the Chhattisgarh
Transit (Forest Produce) Rules, 2001, framed under the Chhattisgarh Van Upaj (Vyapar
Viniyaman) Adhiniyam, 1969 (No. 9 of 1969) and Indian Forest Act, 1927 (No. 16 of
1927) within 30 workdays of receiving competent recommendation. Divisional Forest
Officer, ensuring the felling of trees and transit to depo and calculating the value of log
as per fixed rates, shall deposit 90% of total value in bank account of the Bhumiswami,
and remaining 10% value shall be deposited in a fixed account of forest department.
From deposited amount, forestation and their upkeep by forest department shall be
done in number 10 times of each felled tree. Trees of minimum 6 feet shall be planted
by forest department and the report of plantation shall be given to Collector, through
Sub-Divisional Officer (revenue), each year.
(5) The recommendation, received under these rules, shall be valid till one calendar year
from the date of application.
8. Felling of planted trees.- (1) Bhumiswami may cut down trees planted as agriculture in
his land, subject to the provisions of the Chhattisgarh Transit (Forest Produce) Rules,
2001, framed under the Chhattisgarh Van Upaj (Vyapar Viniyaman) Adhiniyam, 1969
(No. 9 of 1969) and Indian Forest Act, 1927 (No. 16 of 1927). The intimation in from-F
clearly mentioning the reason of cutting, species and number, is necessary to be given,
one month prior to the cutting, to the Sub-Divisional Officer (revenue) and Forest
Range Officer. The revenue record related to registration and self-declaration in form-G
are to given with the intimation. Sub-Divisional Officer (revenue) shall ensure, through
Patwari and Vanpal, the documentary and physical verification of the intimation and
the self-declaration provided by Bhumiswami, before the felling of trees.
(2) The forest department, on written expression by the Bhumiswami, may cut down
trees planted as agriculture in his land, within 30 workdays of the expression.
Divisional Forest Officer, ensuring the felling of trees and transit to depo and
calculating the value of log as per fixed rates, shall deposit 90% of total value in bank
account of the Bhumiswami, and remaining 10% value shall be deposited in a fixed
account of forest department. From deposited amount, forestation and their upkeep by

9. Punishment on contravention.- (1) When any revenue officer has reason to believe
that a tree has been cut in contravention of the provisions of these rules, such tree
may be seized by or under the written order of the revenue officer.
(2) Where the revenue officer is an officer other than the Sub-Divisional Officer (revenue)
a report of such seizure shall, within 07 workdays, be made by him to the Sub-
 Divisional Officer (revenue), for such action as he may deem fit under Section 253 of the
Code.
10. The appeal, revision and review, against the order/recommendation issued under these
rules, may be in the manner, as provisioned in the Code.
11. The provisions of the Chhattisgarh Adim Janjatiyon ka Sanrakshan (Vraksho me Hit)
Adhiniyam, 1999 (No. 12 of 1999) shall be applicable in relation to the Bhumiswami of the
Scheduled Tribes class of the State.

Chhattisgarh Transit (Forest Produce) Rules, 2001, framed under the Chhattisgarh Van
Upaj (Vyapar Viniyaman) Adhiniyam, 1969 (No. 9 of 1969) and Indian Forest Act, 1927 (No.
16 of 1927).
