 Introduction

Chaque jour,des différends de plus en plus nombreux surviennent entre des

personnes physiques et morales exigeant des résolutions rapides et équitables.
Linguistiquement le mot arbitrage vient du latin arbitrer, spectateur, témoin, arbitre,
juge, maître qui dispose à son gré.
Juridiquement l’arbitrage est le fait d'arbitrer, de régler un différend en le
soumettant à la décision d'un tiers, l'arbitre et il constitue l’un des modes
alternatifs de résolution de conflits les plus fréquents .

Avec l’essor des échanges commerciaux internationaux, l’arbitrage s’est révélé être
le recours de prédilection en matière de transactions internationales .Ses
caractéristiques répondent en effet de manière particulièrement aux besoins de sui
generis de règlement des différends en matière de contrats internationaux. Son
développement résulte largement d’une interaction entre la pratique commerciale
du XXe et les différents systèmes juridiques nationaux.

▷ * La neutralité : il permet aux parties de choisir le lieu de règlement du
litige, de choisir les arbitres et la langue du règlement du litige. Ce choix
n’existe pas devant la justice administrative.
▷ * La confidentialité : la justice étatique est publique alors que l’arbitrage
est secret et discret. * L’efficacité : l’arbitre est choisi selon ses
compétences. Il est plus efficace que le juge qui se voit confronter à un
litige. Le fait d’avoir un généraliste (le juge) et non un spécialiste pourrait
avoir des effets néfastes.
▷ * La rapidité : en principe la justice arbitrale est plus rapide car l’arbitre est
souvent un expert dans le domaine. Cette rapidité est également liée à
l’attitude des parties.
▷ * Le coût : la justice arbitrale est moins coûteuse que la justice étatique.
