über die Aktualisierung der
Richtlinien für die Prüfung im
Europäischen Patentamt
Mit Verfügung des Präsidenten des
EPA vom 25. Juli 2018 und gemäß
Artikel 10 (2) EPÜ wurden die Richtli-
nien für die Prüfung im Zuge ihrer
alljährlichen Überarbeitung geändert.
Die neuen Richtlinien, die am
1. November 2018 in Kraft treten,
werden als vollständige Neufassung
vom November 2018 veröffentlicht und
lösen die Richtlinien mit Stand
November 2017 ab.
Die Neufassung der Richtlinien wird
elektronisch publiziert und kann in allen
drei Amtssprachen von der EPA-
Website (www.epo.org/law-
practice/legal-texts/guidelines_de.html)
gebührenfrei heruntergeladen werden.
In Anbetracht der häufigen Überar-
beitung der Richtlinien wird die Veröf-
fentlichung in Papierform eingestellt.
Um der Allgemeinheit die Änderungen
so früh wie möglich bekannt zu geben,
wird bereits im Oktober eine Vorabver-
sion der Richtlinien in englischer
Sprache auf der Website des EPA ver-
öffentlicht.
Änderungen wurden in allen acht Teilen
der Richtlinien vorgenommen. Eine
Reihe von Änderungen wurden vor dem
Hintergrund neuer Entscheidungen der
Großen Beschwerdekammer und der
anderen Beschwerdekammern vorge-
nommen. Teil A enthält jetzt Informati-
onen zur Kreditkartenzahlung als neuer
Zahlungsart und wurde an die geän-
derten Vorschriften über das laufende
Konto angepasst, die am
1. Dezember 2017 in Kraft getreten
sind. Außerdem wird in Teil A jetzt auf
die am 1. Dezember 2017 bzw. am
1. März 2018 in Kraft getretenen
Validierungsabkommen mit Tunesien
und Kambodscha verwiesen. In Teil F
wurden das Kapitel über mangelnde
Einheitlichkeit und einige Unterpunkte
zur Klarheit der Ansprüche gründlich
überarbeitet. Gleiches gilt für Teil G und
insbesondere für die Abschnitte zur
Patentierbarkeit von mathematischen
Methoden sowie von Plänen, Regeln
und Verfahren für gedankliche Tätig-
keiten, für Spiele oder für geschäftliche
Tätigkeiten. In diese Abschnitte wurden
neue Unterpunkte aufgenommen, z. B.
zur künstlichen Intelligenz und zum
maschinellen Lernen, um die einschlä-

By decision of the President of the EPO
dated 25 July 2018 and pursuant to
Article 10(2) EPC, the Guidelines for
Examination have been amended in
line with the EPO's policy of updating
them on an annual basis. The amended
Guidelines, which will enter into force
on 1 November 2018, will be published
as a complete November 2018 edition
which will supersede the
November 2017 edition.
The new Guidelines will be published
electronically and will be available in all
three official languages on the EPO
website at www.epo.org/law-
practice/legal-texts/guidelines.html,
where they can be downloaded free of
charge. In view of the frequent revision
of the Guidelines, the print version has
been discontinued.
In order to serve the public interest in
making the amendments available as
soon as possible, an advance "preview"
version of the Guidelines in English will
be published on the EPO website in
October.
Amendments have been made to all
eight parts of the Guidelines. A number
of amendments have been made in the
light of decisions of the Enlarged Board
of Appeal and the other boards of
appeal. Part A has been updated to
include payment by credit card as a
new payment method and to reflect the
changes to the Arrangements for
deposit accounts which entered into
force on 1 December 2017. Part A now
also includes a reference to the
validation agreements with Tunisia and
Cambodia that entered into force on
1 December 2017 and 1 March 2018
respectively. In Part F, the chapter
relating to non-unity, as well as some of
the sub-sections addressing clarity of
the claims, have been thoroughly
revised. The same applies to Part G,
particularly to the sections in respect of
the patentability of mathematical
methods and schemes, rules and
methods for performing mental acts,
playing games or doing business. In
those sections, new sub-sections, e.g.
relating to artificial intelligence and
machine learning, have been created to
define the relevant patentability criteria
more precisely. Furthermore, a number

Par décision du Président de l'OEB en

relatives à l'examen ont été modifiées,
en application de la politique de l'OEB

annuelle. La version modifiée des
Directives entrera en vigueur le
1er novembre 2018 et sera publiée sous
la forme d'une édition complète datée
du mois de novembre 2018 qui
remplacera l'édition de novembre 2017.
Les nouvelles Directives seront
publiées sous forme électronique et
seront accessibles dans les trois
langues officielles de l'OEB sur le site
Internet de l'OEB (à l'adresse suivante :

texts/guidelines_fr.html) où elles
pourront être téléchargées
gratuitement. Compte tenu de la
fréquence des révisions des Directives,
celles-ci ne sont plus imprimées au
format papier.
La version anglaise des Directives sera
prépubliée sur le site Internet de l'OEB
en octobre, afin que les changements
soient accessibles au public dans les
meilleurs délais.
Des modifications ont été apportées
aux huit parties des Directives. Un
certain nombre de changements ont été
effectués à la lumière de décisions de
la Grande Chambre de recours et des
autres chambres de recours. La
partie A a été mise à jour pour inclure le
paiement par carte de crédit comme
nouveau moyen de paiement et pour
tenir compte des modifications de la
réglementation applicable aux comptes
courants entrées en vigueur le
1er décembre 2017. La partie A contient
également une référence aux accords
de validation avec la Tunisie et le
Cambodge, entrés en vigueur
respectivement les 1er décembre 2017
et 1er mars 2018. En ce qui concerne la
partie F, le chapitre relatif à l'absence
d'unité, ainsi que certaines sous-
sections traitant de la clarté des

finden. Innerhalb jedes Abschnitts der
HTML-Version lassen sich die Änderun-
gen durch Anklicken des Felds "Ände-
rungen anzeigen" (oben rechts) sicht-
bar machen. Auf der Website sind auch
PDF-Versionen der Richtlinien abrufbar,
darunter eine Reinschrift und eine Fas-
sung, in der alle Änderungen ersichtlich
sind.

Guidelines in PDF format – including a
clean copy and a version showing all
modifications – are also available on

Mit Verfügung des Präsidenten des
EPA nach Artikel 10 (2) EPÜ vom
22. Juni 2018 wurden die Richtlinien für
die Recherche und Prüfung im Europä-
ischen Patentamt als PCT-Behörde
(PCT-EPA-Richtlinien) im Zuge ihrer
alljährlichen Überarbeitung geändert.
Die geänderten PCT-EPA-Richtlinien,
die am 1. November 2018 in Kraft
treten, werden als vollständige Neu-
fassung vom November 2018 veröffent-
licht und lösen die Richtlinien mit Stand
November 2017 ab.
Wie die früheren Ausgaben wird auch
die Neufassung der PCT-EPA-
Richtlinien vom November 2018 nur
elektronisch veröffentlicht und kann in
allen drei Amtssprachen kostenlos auf
der EPA-Website abgerufen werden:
www.epo.org/law-practice/legal-
texts/guidelines-pct_de.html.
Um der Allgemeinheit die Änderungen
so früh wie möglich bekannt zu geben,
wird bereits im Oktober eine Vorab-
version dieser Richtlinien in englischer
Sprache auf der Website des EPA ver-
öffentlicht.
Änderungen wurden in allen Teilen der
PCT-EPA-Richtlinien vorgenommen.
Insbesondere wurde Teil A erweitert,
der nunmehr ein Kapitel mit dem Titel
"Sonderbestimmungen" (Kapitel IV)
umfasst, dessen zwei Unterabschnitte
sich mit dem Dienst PCT-Direkt und mit
Zurücknahmen befassen. Die übrigen
Änderungen in Teil A betreffen vor
allem die am 1. Dezember 2017 einge-
führte Möglichkeit der Gebührenzah-
lung per Kreditkarte und die am selben
Tag in Kraft getretenen Änderungen der
Vorschriften über das laufende Konto
sowie die seit 1. April 2018 geltenden
Gebührenänderungen.

basis. The amended PCT-EPO
Guidelines, which will enter into force
on 1 November 2018, will be published
as a complete November 2018 edition
which will supersede the
November 2017 edition.
Like the previous editions, the
November 2018 edition of the
PCT-EPO Guidelines will be published
only in electronic form and will be
available in all three official languages
on the EPO website at
www.epo.org/law-practice/legal-
texts/guidelines-pct.html, where it can
be downloaded free of charge.
In order to serve the public interest in
making the amendments available as
soon as possible, an advance "preview"
version of the PCT-EPO Guidelines in
English will be published on the EPO
website in October.
Amendments have been made to all
parts of the PCT-EPO Guidelines. The
major change is the expansion of
Part A, which now includes a chapter
entitled "Special provisions"
(Chapter IV). This new chapter
comprises two sections, one dedicated
to the PCT Direct service and one to
withdrawals. Other amendments to
Part A reflect in particular the
introduction of credit card as a fee
payment method as from
1 December 2017, the changes to the
Arrangements for deposit accounts
which entered into force on the same
date and the fee changes which
entered into force on 1 April 2018.

Par décision du Président de l'OEB en
date du 22 juin 2018 et conformément à
l'article 10(2) CBE, les Directives
relatives à la recherche et à l'examen
pratiqués à l'Office européen des
brevets agissant en qualité
d'administration PCT (Directives PCT
de l'OEB) ont été modifiées, en
application de la politique de l'OEB qui
prévoit leur mise à jour sur une base
annuelle. La version modifiée des
Directives PCT de l'OEB, qui entrera en
vigueur le 1er novembre 2018, sera
publiée sous la forme d'une édition
complète datée du mois de
novembre 2018 qui remplacera l'édition
de novembre 2017.
À l'instar des précédentes versions,
l'édition de novembre 2018 des
Directives PCT de l'OEB sera publiée
uniquement au format électronique et
sera accessible dans les trois langues
officielles de l'OEB sur le site Internet

die Änderungen allgemein dazu, die
Praxis des EPA klarzustellen, beispiels-
weise in Teil G, wo es um die Beurtei-
lung von Offenbarungen durch fehler-
hafte Dokumente des Stands der
Technik geht. Andere Änderungen
zielen darauf ab, die Vorläuferfassung
weiter zu verbessern oder zu aktuali-
sieren, etwa um den neuen PPH-
Partnerämtern des EPA oder der Ände-
rung geltender Rechtstexte Rechnung
zu tragen, wie der am 1. Januar 2018 in
Kraft getretenen neuen Vereinbarung
zwischen der Europäischen Patentorga-
nisation und dem Internationalen Büro
der Weltorganisation für geistiges
Eigentum über die Aufgaben des EPA
als internationaler Behörde nach dem
PCT.
Der Inhalt der PCT-EPA-Richtlinien wird
auch künftig bei der nächsten Überar-
beitung erweitert.

Abschnitte mit den entsprechenden
Hyperlinks ist auf der EPA-Website zu
finden. Innerhalb jedes Abschnitts der
HTML-Version lassen sich die Änderun-
gen durch Anklicken des Felds "Ände-

gestellt: eine mit sichtbaren Änderun-
gen und eine Reinschrift.
Part B has been updated too, for
instance to reflect the fact that the
provision of an information sheet on
search strategies with all search reports
became a permanent service on
1 January 2018. In general,
amendments have been made to
several parts with a view to clarifying
the EPO's practice, for instance to
Part G on the topic of assessing the
disclosure made by prior-art documents
containing errors. Other amendments
aim at further improving the text of the
previous edition or at updating it, for
instance to include the EPO's new
Patent Prosecution Highway partner
offices or to reflect changes to the
applicable legal provisions (e.g. the
entry into force on 1 January 2018 of
the new Agreement between the
European Patent Organisation and the
International Bureau of the World
Intellectual Property Organization in
relation to the functioning of the EPO as
an International Authority under the
PCT).

in the next revision.

D'autres modifications visent à
améliorer encore le texte de l'édition
précédente ou à le mettre à jour,

offices partenaires de l'OEB dans le

ou pour refléter les modifications des

Den Haag – Informationen für
Besucher und Teilnehmer an
mündlichen Verhandlungen
Ab 8. Oktober 2018 erfolgt der Zugang
zum neuen EPA-Gebäude in Den Haag
über den offiziellen Haupteingang in der
Veraartlaan, wo sich auch der neue
Besucherparkplatz befindet. Der
Eingang zum alten Hauptgebäude und
der provisorische Eingang in der
Van Benthemlaan 16 werden geschlos-
sen. Teilnehmer mündlicher Verhand-
lungen melden sich bei der neuen
Empfangsloge an und durchlaufen die
üblichen Sicherheitskontrollen, bevor
sie sich zu den Verhandlungsräumen
begeben. Allen Besuchern wird
empfohlen, ausreichend Zeit für die
verschiedenen Wege innerhalb des
neuen Gebäudes einzuplanen.

As of 8 October 2018, the EPO's new
building in The Hague will be accessed
through the new main entrance on the
Veraartlaan, where the new visitors' car
park is situated. The entrance to the old
main building and the temporary
entrance at Van Benthemlaan 16 will be
closed. Parties attending oral
proceedings must first report to the new
reception desk and then go through the
usual security checks before heading to
their meeting room. Since the distances
to be covered within the new building
may be longer, visitors are advised to
arrive as early as possible to ensure
they have enough time.

l'intention des visiteurs et des

À compter du 8 octobre 2018, l'accès
au nouveau bâtiment de l'OEB à
La Haye se fera par la nouvelle entrée
principale dans la Veraartlaan, où se
trouve également le nouveau parking
visiteurs. L'entrée de l'ancien bâtiment
principal et l'entrée provisoire sise Van
Benthemlaan 16 seront fermées. Les
parties qui assistent à une procédure
orale doivent d'abord se signaler au
nouveau bureau d'accueil et se
soumettre aux contrôles de sécurité
usuels avant de se rendre dans leur
salle de réunion. Comme les distances
à parcourir dans le nouveau bâtiment
peuvent être plus grandes, il est
recommandé aux visiteurs de prévoir
assez de temps pour leurs
déplacements.
