RELATED TO THE APPRENTICESHIP
CONTRACT
La présente convention règle les rapports entre les parties dans le cadre du déroulement
de la période de mobilité du bénéficiaire du contrat d’apprentissage, dans une Entreprise ou
institution d’accueil, situé dans ou hors de l’Union européenne, dans le cadre de la mise en
veille du contrat.
This agreement defines the relationship between the parties during the mobility period of the beneficiary of the
apprenticeship contract, in a host company or institution, located inside or outside the European Union, in the
context of the fulfilment of the contract.
Les objectifs généraux de la période de mobilité et les tâches à réaliser dans l’Entreprise ou
institution d’accueil sont déterminés dans l’annexe pédagogique accompagnant la présente
convention. Cette annexe précise également les modalités d’évaluation et de validation des
compétences acquises à l’étranger. Si l’évaluation est certificative, elle est prise en compte
pour la délivrance du diplôme, d’un bloc de compétences, ou d’une unité capitalisable.
The overall objectives of the mobility period and the assignments in the host company or institution are set out
in the pedagogical appendix attached to this agreement. This appendix also specifies the assessment and
validation terms for the skills developed abroad. If the assessment is performed for the purpose of certification,
it shall qualify for the award of either a diploma, a group of skills, or a credited unit.

Cette résiliation ne peut donner lieu à indemnité, et n’a pas de conséquence, par elle-même,

I. Principe de « mise en veille » du contrat d’apprentissage durant la période de mobilité
internationale.
Concept of putting the apprenticeship contract "on standby" during the period of international mobility
Pendant la période de mobilité, le contrat de travail de l'alternant·e est " mis en veille " et
son exécution est suspendue pour une durée limitée et prédéterminée correspondant à la
durée de sa formation au sein de l’Entreprise ou institution d’accueil. L’apprenti·e se voit
appliquer les dispositions légales et conventionnelles en vigueur dans le pays d'accueil en
matière notamment de santé et sécurité au travail, rémunération, durée du travail, repos
hebdomadaire et jours fériés.
During the mobility period, the work-study student's employment contract is "put on standby" and its
performance is suspended for a limited and predetermined period corresponding to the duration of his/her
training within the host company or institution. The legal and contractual provisions applicable in the host
country shall apply to the trainee, particularly as regards health and safety at work, wages, working hours,
weekly rest and public holidays.

Information of the Ministry of Foreign Affairs on countries in the “vigilance areas”:
The Ministry of Foreign Affairs publishes an updated map of the world's vigilance areas for travellers. Four
colours distinguish the different levels of vigilance: green for "normal" vigilance, yellow for "limited" vigilance,
orange for an «inadvisable» area (except for imperative reasons of a professional, family or other nature) and
red for a "formally inadvisable" area where travel is "prohibited". No international mobility can be planned in
the red and orange areas.
Green" countries: countries and territories in which no active circulation of the virus is observed and no
variant of concern is identified.
Orange" countries: countries with active circulation of the virus in contained levels, without the spread of
variants of concern.

Le terme « employeur » désigne le signataire du contrat d’apprentissage en France chez
lequel le bénéficiaire dudit contrat suit sa formation en entreprise.
Le terme « Entreprise ou institution d’accueil » est entendu au sens d’unité économique
ou de structure, quelle que soit sa forme juridique, établie dans un autre Etat dans ou hors
de l’Union européenne et accueillant le bénéficiaire du contrat d’apprentissage dans le cadre
de sa formation.
Le terme « centre de formation d’apprenti·e·s » désigne l’organisme de formation au sein
duquel le bénéficiaire du contrat d’apprentissage suit sa formation théorique en France.
Le terme « centre de formation d’accueil » désigne la structure établie dans un autre Etat

The term "employer" refers to the signatory of the apprenticeship contract in France with which a
beneficiary of the said contract undergoes his training in a company.
The term "host company or institution" is defined as an economic unit or structure, whatever its legal form,
located in another State within or outside the European Union and hosting the beneficiary of the apprenticeship
contract for training purposes.
The term "apprentice training centre" refers to the training body in which the beneficiary of the
apprenticeship contract completes his theoretical training in France.
The term "host training centre" refers to the structure situated in another country within or outside the
European Union and hosting the beneficiary of the apprenticeship contract for theoretical training.
La présente notice a pour objet d’apporter des éléments d’éclairage susceptibles de faciliter
la mobilité des alternant·e·s et d’aider les parties prenantes pour la rédaction de la
convention, concernant :
L’impact sur le contrat de travail ;
Les modalités d’évaluation, de validation et de reconnaissance des compétences acquises
à l’étranger ;
La couverture maladie, maternité, accident du travail/maladie professionnelle, invalidité
et vieillesse ;
Le financement de la mobilité ;
Le rappel des obligations des signataires de la convention de mobilité.
Elle concerne l’ensemble des périodes de mobilité, hormis le cas d’une mobilité n’excédant
pas quatre semaines pour laquelle l’alternant·e peut être “ mis à disposition “, de façon
temporaire par l’entreprise en France auprès d’une entreprise ou d’un centre de formation
situé à l’étranger (cf. convention et notice afférents).

students and to help the parties involved to draw up the agreement, with regard to:
Dans ce cadre, c’est le centre de formation et/ou l’entreprise du pays d’accueil qui
devien(nent)t seul(s) responsable(s). L’apprenti·e se voit donc appliquer les dispositions
légales et conventionnelles en vigueur dans le pays d’accueil en matière notamment de
santé et sécurité au travail, rémunération, durée du travail, repos hebdomadaire et jours
fériés.
La “ mise en veille “ du contrat constitue une opération entraînant la suspension temporaire
du contrat de travail liant le salarié à l’entreprise d’origine qui l’emploie initialement.
L’alternant·e appartient toujours au personnel de l’entreprise d’origine mais ne conserve pas
le bénéfice des droits légaux ou conventionnels dont il aurait bénéficié s’il avait exécuté son
travail dans l’entreprise prêteuse durant l’intégralité de la période de transfert temporaire
au sein de l’Entreprise ou institution d’accueil.
La suspension du contrat de travail n’interrompt pas le décompte de la durée du contrat et
de l’ancienneté du salarié.
During the mobility period, the work-study student's employment contract is "put on standby" and its
performance is suspended for a limited and predetermined period corresponding to the period of training within
a company or training centre located abroad. The contractual relationship between the employer and the work-
study student is "put on standby".
In this context, the training centre and/or the company in the host country becomes/are solely responsible. The
apprentice is therefore subject to the legal and contractual provisions in force in the host country, particularly
with regard to health and safety at work, wages, working hours, weekly rest and public holidays.
The contract's "standby" effect is a temporary suspension of the employment contract between the employee
and the company of origin that initially employed him/her.
The work study employee still belongs to the staff of the company of origin but does not retain the legal or
contractual rights that he/she would have enjoyed if he/she had worked in the lending company during the
entire period of temporary transfer to the host company or institution.
The suspension of the employment contract does not affect the calculation of the contract duration and
seniority of the employee.
The contribution of mobility to the award of a diploma, a vocational qualification or a certificate of vocational
qualification (only in the context of a vocational training contract for the latter) and the delegation of part of
the assessment to the host structure is becoming more widespread. The evaluation and validation of this
mobility is intended to be carried out together with the host company or institution.
Thus, if the assessment is certifying, i.e. if it is considered for the issue of the diploma or certification, the
methods of assessing the skills acquired abroad must be examined with the certifier.
The apprentice training centre in France may thus:
ensure that all or part of a block of skills can be assessed abroad as part of the mobility, and identify the
conditions under which this assessment is possible: for national education vocational diplomas in particular, this
assessment abroad is possible as part of the in-course assessment (CCF) and provided that the apprentice
training centre is authorised to carry it out;
send to the foreign partners the documents needed for the assessment (identification of the activities to be
carried out, the skills to be worked on, and if necessary, to be assessed, and identification of the assessment
criteria, and of the methods for transmitting the results of this assessment);
check that the mobility timetable is compatible with that of the examinations, so that the apprentice can, if
necessary, be assessed in the form of one-off tests in France.
It should be noted that, for national education vocational diplomas, in addition to the possibility that all or part
of a block of skills may be assessed abroad as part of the mobility, there is also an optional "mobility" unit
(UFM), corresponding to an optional block of skills in the vocational diploma, and validating the results of a
period of training carried out abroad as part of the preparation for this diploma. Thus, in the context of the
preparation of a national education vocational diploma, it is possible to assess the results of a period of mobility
abroad, within the framework of the CCF for the blocks of competences making up the diploma and/or within
the framework of this optional unit (optional block).
The supervision of a mobility including an evaluation abroad is based on the principles of the European ECVET
system which provides that a partnership agreement between the participating organisations must be drawn
up, as well as a pedagogical contract defining the training and evaluation objectives and the follow-up terms.
The host training centre can thus assess the individual learning outcomes obtained during a mobility and after
validation and recognition by the sending organisation, these outcomes can be recognised.
La couverture sociale appliquée aux étudiants prévoit les assurances maladie, maternité et
accidents du travail et maladies professionnelles.
Assurance maladie/maternité : en tant qu’assuré résidant en France, le bénéficiaire du
contrat d’apprentissage en mobilité bénéficie de la prise en charge de ses frais de santé en
cas de maladie et de maternité et par le mécanisme du maintien des droits, des indemnités
journalières.
Montant des cotisations : La cotisation étudiante a été supprimée en 2018, néanmoins, en
fonction de ses éventuels revenus d’activité et du patrimoine, un·e apprenti·e peut être

Assurance accident du travail et maladie professionnelle (AT-MP) : en tant qu’étudiant, le
bénéficiaire contrat d’apprentissage en mobilité bénéficiera de la prise en charge de ses frais
de santé en cas d’accident du travail, survenu sur son lieu de travail ou de maladie
professionnelle. La personne étant considérée comme en stage, le risque trajet sera couvert
pour les accidents survenus sur le parcours direct entre le lieu de travail et l’établissement
d’enseignement. En revanche, le mécanisme de maintien de droit n’existant pas pour les
indemnités journalières en cas d’AT-MP, le bénéficiaire du contrat d’apprentissage en
mobilité ne bénéficiera pas de ces indemnités. Enfin, une rente pourra être versée lorsque le
taux d’incapacité lié à un AT-MP est égal ou supérieur à 10 %.

Montant des cotisations : la cotisation AT/MP est due par le centre de formation et,
concernant les bénéficiaires d’un contrat de professionnalisation, l’organisme de formation
principal ou, à défaut, l’employeur lorsqu’il dispose d’un service de formation. Le taux net
moyen national de la cotisation AT-MP (soit 2,22 % en 2019) est appliqué à une assiette
constituée, au prorata de la durée de la période de mobilité, du salaire minimum des rentes
(18 576 € annuels en 2019). A titre indicatif, le montant annuel de la cotisation AT/MP
s’élève à 412 € en 2019 ;
En revanche, le statut d’étudiant ne permet pas l’accès aux assurances invalidité et
vieillesse dont bénéficient, en tant que salarié, les titulaires de contrat d’apprentissage ou de
professionnalisation.
Or, la mise en veille de leur contrat initial suspend ces couvertures pendant la période de
mobilité.
Pour acquérir des droits à la retraite à faire valoir à la fin de sa carrière professionnelle, il est
proposé que le bénéficiaire du contrat de professionnalisation ou d’apprentissage en
mobilité souscrive pendant cette période à l’assurance volontaire invalidité-vieillesse auprès
de la caisse primaire d’assurance maladie (CPAM) de son lieu de résidence. Pour bénéficier
de cette couverture, le bénéficiaire du contrat de professionnalisation ou d’apprentissage en
mobilité doit justifier qu’il a relevé pendant au moins 6 mois avant son départ d’un régime
de sécurité sociale obligatoire et qu’il cesse de remplir les conditions d’assujettissement à ce
régime en tant que salarié·e ou apprenti·e.
La cotisation trimestrielle d’assurance volontaire vieillesse invalidité, sera de 441 € par
personne.
During this period of mobility abroad, the work-study student is covered by:
The social security cover of the host country if they have employee status or equivalent in that country;
The French social security cover provided for students when they do not have employee status in the host
country. This cover concerns the risks of illness, maternity, accidents at work and occupational diseases, old age
and invalidity;
For mobility outside the European Union, cover may be provided in accordance with the provisions of
international social security agreements and the social legislation of the host country and/or by joining a
voluntary insurance scheme (such as the Caisse des français de l'étranger or private insurance). In this case, it is
advisable to contact the Centre des liaisons européennes et internationales de sécurité sociale
(https://www.cleiss.fr/) and to consult the list of bilateral social security agreements
(https://www.cleiss.fr/docs/textes/index.html).
Social security coverage for students includes sickness, maternity and work-related accident and occupational
disease insurance.
On the other hand, student status does not allow access to the disability and old-age insurance from which
holders of apprenticeship or professionalization contracts benefit as employees. However, the suspension of
their initial contract suspends these coverages during the mobility period.
In order to acquire pension rights at the end of their professional career, it is proposed that the beneficiary of a
professionalization or apprenticeship contract in mobility should take out voluntary invalidity and old age
insurance with the local health insurance fund (CPAM) during this period. To be eligible for this cover, the
beneficiary of the mobile professionalization or apprenticeship contract must prove that he/she was covered by
a compulsory social security scheme for at least six months prior to his/her departure and that he/she ceases to
meet the conditions for affiliation to this scheme as an employee or apprentice.
The quarterly voluntary old-age and disability insurance contribution will be € 441 per person.
during the period(s) of mobility, the employer indicates in the nominative social declaration (DSN) that the
contract is on hold;
the beneficiary of the apprenticeship contract must make a declaration to his or her health insurance fund to
inform it of his or her change of status and, if necessary, apply for a European health insurance card.
the apprentice training centre assists the work-study student in drawing up and sending letters to the health
insurance fund.

En cas d’accident de l’alternant·e, soit au cours du travail, soit au cours du trajet, l’Entreprise
ou institution d’accueil ou le centre de formation d’accueil s’engage à faire parvenir, pour les
apprenti·e·s, au centre de formation en France ou, à défaut, à l’employeur, les éléments
d’information permettant à ce dernier d’effectuer la déclaration d’accident auprès de la
caisse du régime de sécurité sociale dont relève le bénéficiaire du contrat d’apprentissage,
conformément à la législation française.
Le formulaire de déclaration d’accident (CERFA 14463*02) est téléchargeable sur le site
ameli.fr.
In the event of an accident to the alternating work-study student, either during work or during the journey, the
host company or institution or the host training centre undertakes to send, in the case of apprentices, to the
training centre in France or, failing that, to the employer, all the information required to enable the employer to
file an accident declaration with the social security fund to which the beneficiary of the apprenticeship contract
is affiliated, in accordance with French legislation.

the employer's skills operator covers the costs related to the international mobility of apprentices provided for
in § 10 of article L. 6231-2 as long as they are borne by the apprentice training centre, according to a fixed
amount determined by the skills operator, by type of activity and by geographical area, which is identical for all
the apprentice training centres concerned;
the employer's skills operator may also cover all or part of the costs generated by the mobility abroad. In fact,
the skills operator may, depending on its guidelines, finance costs of all kinds, including those corresponding to
social security contributions and, where applicable, remuneration and ancillary costs generated by the mobility
outside national territory; these may include travel costs, accommodation, etc;
European programmes, in particular Erasmus+: published every year, the Erasmus call for proposals will
provide funding for the travel and accommodation costs of work placements (https://info.erasmusplus.fr/);
the regions: they often offer mobility grants; these vary according to the region.
the Franco-German Youth Office (OFAJ): throughout the year, the OFAJ publishes calls for projects
(https://www.ofaj.org/);- Pro Tandem : ProTandem supports and coordinates Franco-German exchanges of
young people and adults in vocational training (https://protandem.org/fr/) ;
the Franco-Quebec Youth Office (OFQJ): supports young people in carrying out a compulsory or non-
compulsory work placement as part of higher education or vocational training (all levels are concerned)

Note that if the mobile work-study student does not have employee status in the host country, the amount of
any "remuneration" paid by the host company or institution must be considered as ancillary to the amount of
the Erasmus grant, the contribution of the skills operator or any other French financer, with the risk that the
status of the work-study student may be requalified in the event of an inspection by the host company or
institution.

taking the necessary steps to obtain support and funding from the various funding bodies;
ensuring follow-up and support for the work-study student during the mobility period, particularly in the event
of difficulties
ensuring, if necessary, a successful return to the company of origin after the mobility period.
to perform the assignments entrusted to him/her by the host institution in accordance with the terms of this
agreement and its pedagogical annex, in the context of his/her practical and/or theoretical training
regularly and spontaneously submit the reporting tools (assessments, pedagogical notes, etc.) to the host
institution;
direct and control the beneficiary in his activities by appointing a "tutor", with the necessary pedagogical and
professional skills and moral integrity, in charge of this supervision;
keep a record of the hours worked by the person in mobility, evidenced by a record of hours sent to the
employer;
have the beneficiary perform work corresponding to both his/her skills and the objectives of the training
during this mobility period;
train the beneficiary about safety, inform him/her about the specific risks he/she will encounter in the
company during the mobility period, and shall provide him/her with the necessary collective and individual
protection equipment, inform the beneficiary about the risks specific to his/her company. Provide collective and

if the work is dangerous or involves the use of dangerous machines or products by young people under 18, the
host institution must declare that it complies with the regulations applicable in the host country concerning
exemptions to the prohibition of certain types of work (for periods of mobility within the European Union, see
the rules in force in the host country in application of EU directive 94/33 on the protection of young people at
work, art. 7. 3 on work prohibitions and art. 8, 9 and 10 on working and rest periods; see administrative annex;
for mobility periods outside the EU, see rules in force in the host country);
in case of beneficiaries' housing, provide decent accommodation that meets the health, safety and comfort
standards of the host country;
allow the beneficiary to complete his/her reporting tools or to write his/her report (if requested), by giving
him/her the necessary time.
