The present volume contains the Applications, the. Memorials,
the Preliminary Objections and the Observations filcd in the
South West Africa cases. The proceedings in these cases, whiçh were
entered on the Court's General List on 4 November 1960 under
numbers 46 and 47, were joined by an Order of the Court of zo May
1961 (South West Africa, Order of 20 May 1961. I.C. J . Reports
1961, p. 13). Two Judgments have been delivered, the first on
21 December 1962 (South West Africa, Preliminary Objections,
Judgment, I.C.J. Reports 1962. p. 319), and the second on 18 July
1966 (South West Africa, Second Phase, Judgment, I.C.J . Reports
1966, p. 6).
The page references originaüy appearing in the pleadings have

PROCEEDINGS
Sir:
The undersigned, being duly authorized by the Government of
Ethiopia (hereinafter sometimes referred to as "Applicant") hereby
submit to the International Court of Justice an Application on
behalf of the Govemment of Ethiopia to institute proceedings
against the Government of the Union of South Africa (hereinafter
sometimes referred to as the "Union") for causes stated below.
r. The subject of the dispute is the continued existence of the
pute Mandate for South West Africa and the duties and performance of
the Union, as Mandatory, thereunder.
3n 2. The Applicant, having regard to Article 80, paragraph I, of
the United Nations Charter, founds the jurisdiction of the Court on
Article 7 0 f the Mandate for German South West Africa made a t
Geneva on December 17, 1920, and on Article 37 of the Statute of
the Intemational Court of Justice.
3. Subsequent to the war of 1914-1918. the Principal Allied and
Associated Powers agreed that a Mandate for the former German
protectorate of South West Africa should be conferred upon His
Britannic Majesty to be exercised on his behalf by the Government
of the Union of South Africa. His Britannic hfajesty, for and on
behalf of the Government of the Union of South Africa, agreed to
accept the Mandate, and undertook to exercise it on behalf of the
League of Nations in accordance with the proposed terms. On
December 17, !gzo, the Council of the League of Nations confirmed
the Mandate, and defined its terms.
The duties of the Union as Mandatory are stated, generally, in
Article 22 of the Covenant of the League of Nations (hereinafter
sometimes referred to as the "Covenant") and, more specifically, in
the Mandate for German South West Africa, made a t Geneva on
the 17th day of December, 1920 (hereinafter sometimes referred t o
as the "Mandate"), and in rules adopted by the Council of the
League of Nations on January 31, 1923, relating to petitions from
mandated territories (hereinafter referred to as the "Leaaue of
Nations rules").
Article 22 of the Covenant of the League of Nations States:
"that the well-being and development of such peoples [peoples
governed under mandates] form a sacred trust of civilization".

Monsieur le Greffier,
Les soussignés, dûment autorisés par le Gouvernement d'Ethio-
pie (ci-après dénommé parfois le .requérant in), soumettent ici à
la Cour internationale de Justice, au nom du Gouvernement
d'Ethiopie, une requête introductive d'instance contre le Gouverne-
ment de l'union sud-africaine (ci-après dénommé parfois l'n Union »)
pour les raisons exposées ci-dessous.
I. L'objet du différend réside dans l'existence persistante du Objet
Mandat pour le Sud-Ouest africain et les devoirs et le comportement
de l'Union, en sa qualité de Mandataire, découlant de ce Mandat.
z. Le requérant, se référant à l'article 80. paragraphe 1, de la Cnmpe
Charte des Nations Unies, prétend établir la compétence de la Cour de la (
sur l'article 7 du Mandat pour le Sud-Ouest africain allemand établi
à Genève le 17 décembre 1920 ainsi que sur l'article 37 du Statut de
la Cour internationale de Justice.
3. A la suite de la guerre de 1914-1918, les Principales Puissances Les fai
alliées et associées sont convenues de conférer à S. M. britannique
un Mandat pour l'ancien protectorat allemand du Sud-Ouest afri-
cain, qui serait exercé en son nom par le Gouvernement de l'union
de l'Afrique du Sud. S. M. britannique, pour le Gouvernement de
l'union sud-africaine et en son nom, est convenue d'accepter le
Mandat et de l'exercer au nom de I;i Société des Nations conformé-
ment aux termes proposés. Le 17 décembre 1920 le Conseil de la
Société des Nations a confirmé le Mandat et en a défini les termes.
Les devoirs de l'union en qualité de Mandataire sont exposés,
d'une façon génbrale, dans l'article 22 du. Pacte de la Société des
Nations (ci-après dénommé parfois le «Pacte »), et. plus précisé-
ment, dans le Mandat pour le Sud-Ouest africain allemand établi à
Genève le 17 décembre 1920 (ci-après dénommé parfois le K Man-
dat »), et dans certaines règles adoptées par le Conseil de la Société
des Nations le 31 janvier 1923 au sujet des pétitions émanant des
temtoires sons Mandat (ci-après dénommées srhgles de la Société
des Nations n).
L'article 22 du Pacte de la Société des Nations déclare:

Thc Mandate States:
1. "The Mandatory shail promote to the utmost the material
and moral well-being and the social progress of the inhabitants
of the territory subject to the present mandate." (Article 2.)
Facts and 4. The Applicant alleges, on the basis of the following, that the

Mandate and Article 22 of the Covenant of the-League of Nations:
(a) The Union has not promoted to the utmost the material
and moral well-being and social progress of the inhabitants of
the Temtory, in that the Union has not only failed to adopt
measures necessary and appropriate for the effectuation of
Article z of the Mandate and Article zz of the Covenant, but
it has taken affirmative action which denies their fulfilment.
(b) The Union, by law and in practice, distinguishes as t o
race, color, national and tribal origin in establishing the rights
and duties of the peoples of South West Africa. This official
practice is referred to as apartheid.
(c) The Union, in administering the Temtory, has adopted
and applied legislation, regulations, proclamations and adminis-
trative decrees which are by their terms and in their application
arbitrary, unreasonable, unjust, and detrimental to human
dignity.
(d) The Union, in administering the Temtory, has adopted
and applied legislation, administrative regulations, and official
actions which have suppressed rights and liberties of inhabi-
tants of the Territory essential to their orderly evolution
toward self-government.
(e) As examples of the above, the Union-

Le Mandat déclare :
I. .Le Mandataire accroîtra, par tous les moyens en son
pouvoir, le bien-être matériel et moral ainsi que le progrès
social des habitants du temtoire soumis au présent Mandat. 1,
(Article 2 . )
2 . uLe Mandataire devra envoyer au Conseil de la Société
des Nations un rapport annuel satisfaisant le Conseil et conte-
nant toutes informations intéressant le territoire et indiquant
les mesures prises pour assurer les engagements pris suivant les
articles 2, 3, 4, 5. II (Article 6 . )
3. K L'autorisation du Conseil de la Société des Nations est
nécessaire pour modifier les dispositions du présent Mandat. II
(Article 7.)
Les règles de la Société des Nations déclarent que:
«Toutes les pétitions adressées à la Société des Nations par
des communautés ou des éléments de la population des terri-
toires sous Mandat seraient transmises au Secrétariat de la
Société des Nations par l'intermédiaire du Gouvernement man-
dataire intéressé. Ce dernier joindrait aux pétitions les obser-
vations qu'il jugerait convenables. »
4. Le requérant allègue, en se fondant sur ce qui suit, que l'union, Faits et au&-
agissant par I'intermhdiaire d'organes officiels créés par ses soins ~ ~ t i o nqui s
pour administrer le territoire, a violé et continue à violer l'article 2 ;,Y,trappor-
du Mandat et l'article 22 du Pacte de la Société des Nations:
a) L'Union n'a pas accru le bien-être matériel et moral, ni
le progrès social des habitants du Territoire par le fait que non
seulement elle n'a pas adopté les mesures nécessaires et appro-
priées pour donner effet à l'article 2 du Mandat et l'article 22
du Pacte, mais qu'elle a pris des mesures positives qui en inter-
. .disent la réalisation.
b) L'Union, en droit et en pratique, établit une distinction
fondée sur la race, la couleur, l'origine nationale et tribale en
fixant les droits et les devoirs des peuples du Sud-Ouest afri-
cain. Cette pratique officielle est connue sous le nom d'apartheid.
c) L'Union a adopté et appliqué dans l'administration du
Territoire une législation, des règlements, des proclamations et
des ordonnances administratives qui, par leurs termes et dans
leur application, sont arbitraires, déraisonnables, injustes et
contraires à la dignité humaine.
d j L'Union a adopté et appliqué dans l'administration du
Territoire une législation, des règlements administratifs et des
mesures officielles qui ont supprimé les droits et les libertés des
habitants du Territoire, essentiels à leur évolution régulière
vers l'autonomie. .. .

5 . The Applicant alleges that the Union has violated, and con-
tinues to violate, Article 6 of the Mandate, by its failure to render
to the General Assembly of the United Nations annual reports
containing information yith regard to the Temtory adindicating
the measures it h a s taken to carry out its obligations under the
Mandate.
6. The Applicant alleges that the Union haç violated, and con-
tinues to violate, Article z of the Mandate and Article 22 of the

l'intérêt public général, ordonner le trpsfert de toute tribu
ou fraction de tribu, ou de tout indigène, d'un lieu dans un
autre lieu situé dans les limites du Temtoire sous Mandat,
