TES TRANS ULUSLARARASI NAKLIYAT TIC.LTD.STI. Ce n'est pas le transporteur général et entreprend tous les services qui ne peuvent être modifiés que par écrit par le représentant
autorisé de la Société et uniquement sous réserve des « Conditions » suivantes. Même si un document de déclaration d'acceptation du Client, un bon de commande ou tout autre
document contenant des termes et conditions en plus ou modifiant les présentes Conditions a été reçu par la Société avant ou après la notification des présentes Conditions, ces
dispositions supplémentaires ou les dispositions modifiant les présentes Conditions ne peuvent être valide.
L'attention du Client est attirée sur les dispositions qui excluent ou limitent la responsabilité de la Société et obligent le Client à indemniser la Société dans certaines circonstances.
1. Dans les présentes Conditions ;
Société : TES TRANS ULUSLARARASI NAKLIYAT TIC.LTD.STI.
Ces conditions : Désigne les présentes conditions commerciales standard et les conditions du contrat de stockage, telles que modifiées de temps à autre.
Client : Désigne toute personne à laquelle la Société exerce une activité commerciale ou fournit des conseils, des informations ou des services, à la
demande ou au nom de
Moyenne générale : En cas d'urgence, il s'agit de la situation où la cargaison ou une partie du navire est volontairement sacrifiée et le dommage est partagé par
toutes les parties afin d'éliminer un danger menaçant le navire et la cargaison dans son ensemble en mer voyage.
Cargaison/Marchandises/Marchandises/Expédition : désigne les marchandises du Client (y compris les emballages et équipements associés aux marchandises) soumises aux
présentes Conditions.
Propriétaire : désigne le propriétaire des Marchandises (y compris tout emballage, conteneur ou équipement) auquel se rapporte tout travail conclu en
vertu des présentes Conditions et toute personne qui a ou aura un intérêt ou un intérêt dans les Marchandises.
Personne physique : Designe une personne morale ou une organisation individuelle non constituée en société. Une référence à un article est réputée avoir été
faite à tout article des présentes Conditions.
Délai de levée de marchandise : 3 Jours pour le fret/ 7 Jours pour les conteneurs
Frais d'entrepôt journaliers : 2500Fcfa (4.00 euro )/m3/jour

Max. temps de stockage : 90 jours
2. (A) Sous réserve de l'article 2 (B) ci-dessous, toutes les activités exercées par la Société, à titre gratuit ou gratuit dans le cadre de travaux, sont effectuées sous réserve des présentes
Conditions.
(B) Dans le cas d'une convention internationale concernant le transport international de marchandises ou de toute autre législation qui doit être appliquée pour toute entreprise, les
présentes Conditions sont régies par cette législation en ce qui concerne ces affaires et rien dans ces Conditions ne s'appliquera à tous des actions de la Société en vertu de cette
législation ne doit pas être interprété comme une renonciation à un droit ou à une exemption, et si une partie de ces Conditions est dans une mesure incompatible avec cette
législation, cette partie de ces Conditions sera considérée comme invalide dans une mesure limitée , à condition qu'elle se rapporte à l'entreprise en cause.
Une fois le délai maximal de non levée dépassé TES logistique se garde le droit de nommer un commissaire-priseur afin de procéder à la vente aux enchères des marchandises
non retirées.
3. Le client garantit qu'il est le propriétaire ou le représentant autorisé du propriétaire des marchandises et accepte également les présentes conditions non seulement en son propre
nom, mais également en tant que représentant au nom du propriétaire des marchandises.

4. Bien que le propriétaire des marchandises autorise le client à conclure tout contrat avec la société et/ou à accepter tout document soumis par la société en vertu du contrat, les
« domaines de ces conditions » s'appliquent en son nom et au nom de ses représentants et tout tiers au nom duquel ses représentants autorisés agissent accepte au nom de la
partie. En particulier, mais sans préjudice de la généralité de cet article, la Société accepte et s'engage à ce que la Société puisse tenir toutes ces personnes solidairement responsables
de toute responsabilité du Client découlant des présentes « Conditions générales » et peut percevoir tout montant dû par le Client, à condition qu'il en ait dûment fait la demande
au préalable.
5. Le représentant et l'autorité de la société ;
La Société, dont le siège social est en République de Turquie, est le représentant de la Société dans le pays de destination, TES TRANS ULUSLARARASI NAKLIYAT TIC.LTD.STI Sur la
base du contrat avec, TES (TERANGA EXPRESS SERVICES Suarl. la société ; est le représentant autorisé des produits dans le pays de destination et est pleinement habilité à protéger
les droits et intérêts de l'entreprise.
6. Responsabilité du client ;
La responsabilité du processus depuis la livraison des marchandises à l'entrepôt désigné en Turquie jusqu'à leur livraison à l'entrepôt du pays vers lequel elles sont envoyées relève
de la « responsabilité de l'entreprise ». La responsabilité des marchandises atteignant l'entrepôt en Turquie ou l'entrepôt dans le pays où les marchandises sont envoyées appartient
au client. Dans les cas où les envois, dont la notification d'arrivée a été faite au client, sont oubliés ou le destinataire ne peut pas être joint, à l'expiration du délai libre déterminé par
la société, les frais de stockage, les frais supplémentaires de stockage et de transport déterminés par la société sera reflété au client/destinataire.
Le type de marchandise déclaré par l'expéditeur lors de la livraison de la marchandise est pris en compte par l'expéditeur. (Toutes les responsabilités découlant du transport de
marchandises interdites par des accords et des lois internationales ou soumises à une autorisation spéciale de transport appartiennent au client.) Dans le cas contraire, la
responsabilité incombe entièrement à l'expéditeur et à l'acheteur/client. Elle n'inclut pas la responsabilité de l'entreprise dans les affaires pénales nationales ou internationales qui
peuvent survenir.
Il a dépassé la période gratuite rémunérée et le 'max. L'élimination de toutes les marchandises qui ont dépassé la période de « rester en stockage » est entièrement la propriété de
l'entreprise. Hormis les conditions spécifiées, l'expéditeur et le destinataire ne peuvent revendiquer de droits.
Les « TEMPS LIBRE », « FRAIS DE STOCKAGE », « FRAIS DE TRANSPORT ET DE STOCKAGE » déterminés par la société varient de temps à autre et les parties acceptent la situation dans
ces conditions.
Nb : Aucune marchandise ne peut être levée sans paiement préalable de tous les frais y affairant faute de quoi les pénalités journalières y seront appliquées et ce dans les délais
rappelés ci-dessus.

amended in writing by an authorised representative of the Company. Notwithstanding that a Customer acceptance declaration document, order order or other document containing
additional terms and conditions to these Conditions or amending these Conditions has been received by the Company, whether before or after the notification of these Conditions,
such additional terms or amending provisions shall not be valid.
The Customer's attention is drawn to provisions that exclude or limit the Company's liability and require the Customer to indemnify the Company in certain circumstances.
1. In these Terms and Conditions;
Company : TES TRANS ULUSLARARASI NAKLIYYAT TIC.LTD.STI.
These Conditions : These Standard Commercial Terms and Conditions of Warehousing Agreement as may be amended from time to time.
Customer : means any person to whom the Company undertakes any business or provides advice, information or services on request or on its behalf
Common Average : In an emergency, in order to eliminate a danger that threatens the ship and cargoes as a whole on a sea voyage, it refers to the situation
where the cargo or a part of the ship is sacrificed voluntarily and the damage caused is shared by all parties.
Cargo/Cargo/Goods/Shipment : Means the goods of the Customer (including the packaging and equipment incorporated into the goods) subject to these Conditions.
Owner : means the owner of the Goods (including any packaging, containers or equipment) to which any work concluded under these Condi tions
relates and any person who has or will have an interest in the Goods.
Person Real person : means a legal person or an unincorporated body of persons. A reference to a clause shall be deemed to be a reference to any clause of these
Conditions.
Free time : 3 days for aircraft cargo / 7 days for container cargo
Daily warehouse fee : 2500F/m3/day
Transport and storage costs : ................................................euro/kg for aircraft cargo / ..................................................euro/m3 for container
Max. storage time : 90 jours

2. (A) Subject to Clause 2(B) below, all activities of the Company carried out in the course of business, with or without consideration, shall be governed by these Conditions.
(B) In the event that there is any international convention on the international carriage of goods or other legislation which is mandatorily applicable to any business undertaken,
these Conditions shall be governed by such legislation in respect of such business and nothing in these Conditions shall be deemed to apply to such business, It shall not be construed
as a waiver of any of the Company's rights or exemptions under such legislation and if any part of these Terms and Conditions is contrary to such legislation to any extent, such part
of these Terms and Conditions shall be deemed invalid to the extent that it relates to the business in question.
If the maximum storage period is exceeded, TES LOGISTIC reserves the right to sell the goods not received back and to sell the goods by auction or to appoint an auctioneer in
order to deduct the proceeds from the sale from the current debt of the customer.
3. The Customer undertakes that he is the owner of the goods or the authorised representative of the owner and further undertakes to accept these Terms and Conditions not only
on his own behalf, but also as his representative on behalf of the owner of the goods.

4. The Owner of the Goods, when authorising the Customer to enter into any contract with the Company and/or to accept any document presented by th e Company under the
contract, accepts "These Conditions" on its own behalf and on behalf of its representatives and any third party on whose behalf its authorised representatives act. In particular, but
without prejudice to the generality of this clause, the Customer acknowledges and agrees that the Company may hold all of these parties jointly and severally liable for any and all
liability of the Customer arising under "These Terms" and may recover from each of them any amount due by the Customer, provided that the Customer has duly requested the
same in advance.
5. Representative and authorisation of the Company;
The representative of TES TRANS ULUSLARLARARASI NAKLIYYAT TIC.LTD.STI, headquartered in the Republic of Turkey, in the country of destination, (TES) TERANGA EXPRESS SERVICES
Suarl. is the authorised representative of the products in the country of destination and has full authority to protect the rights and interests of the company.
6. Customer responsibility;
From the delivery of the goods to the designated warehouse in Turkey until the goods are delivered to the warehouse in the co untry of dispatch, the responsibility for the process
'belongs to the company'. The responsibility of the goods that have arrived at the warehouse in Turkey or the warehouse in the country where the goods are sent belongs to the
customer. In the event that the shipments whose arrival has been notified to the customer are forgotten to be received or the recipient cannot be reached, if the free period
determined by the company expires, the warehouse costs, extra storage and transport expenses determined by the company will be reflected to the customer / recipient.
During the delivery of the goods by the sender, the type of goods declared by the sender is taken into account. (all responsibilities arising from the transport of cargoes that are
prohibited by international agreements and laws or whose transport is subject to special permission belong to the customer) In case of a contrary situation, the responsibility is
entirely the responsibility of the sender and the buyer / customer. In case of national or international criminal cases, the company does not bear any responsibility.
The savings of all goods that have exceeded the free period and have exceeded the 'max. warehouse stay' period determined by the company belongs entirely to the company.
Except for the specified conditions, the sender and the buyer cannot claim rights.
The 'FREE TIME', 'STORAGE COST', 'TRANSPORT AND STORAGE EXPENSES' determined by the company vary from time to time and the parties accept the situation under these
conditions.
Note: No goods will be delivered until all relevant costs have been paid in advance, otherwise daily penalties will be applied within the periods mentioned above.

TES TRANS ULUSLARARASI NAKLIYAT TIC.LTD.STI.. Genel taşıyıcı değildir ve sadece Şirketin yetkili temsilcisi tarafından yazılı olarak değiştirilebilen ve yalnızca aşağıda belirtilen “İşbu
Koşullar”a tabi olan tüm hizmetleri üstlenir. İşbu Koşulların bildirilmesinden önce veya sonra, “İşbu Koşullar”a ilave hüküm ve koşulları içeren veya İşbu Koşulları değiştiren bir Müşteri
kabul beyanı dökümanı, sipariş emri veya başkaca bir belge Şirket tarafından alınmış olsa da, sözkonusu ilave hükümlerin veya İşbu Koşulları değiştiren hükümlerin geçerliliği
olmayacaktır.

Müşteri’nin, Şirket'in sorumluluğunu hariç tutan veya sınırlayan ve Müşterinin belirli durumlarda Şirketi tazmin etmesini gerektiren hükümlere dikkati çekilmektedir.
1. İşbu Koşullar’da;
Şirket : TES TRANS ULUSLARARASI NAKLIYAT TIC.LTD.STI.’ ifade eder.
İşbu Koşullar : Zaman zaman değiştirilebilen, bu Standart Ticari Koşulları ve Depolama Sözleşmesi Koşullarını ifade eder.
Müşteri : Şirketin, talep üzerine veya adına herhangi bir işi üstlendiği veya tavsiye, bilgi veya hizmet sağladığı herhangi bir kişi anlamına gelir
Müşterek Avarya : Acil bir durumda, bir deniz seferinde gemiyi ve yükleri bütün olarak tehdit eden bir tehlikeyi bertaraf etmek için, gönüllü olarak yükün veya
geminin bir kısmının feda edildiği ve oluşan zararın tüm taraflarca paylaşıldığı durumu ifade eder.
Yük/Eşya/Mallar/Gönderi : İşbu Koşullara tabi olan Müşteri’nin mallarını (mala birleşik ambalajı ve ekipmanı dahil) ifade eder.
Malik : İşbu Koşullar kapsamında sonuçlandırılan herhangi bir işin ilgili olduğu Malların sahibi (her türlü ambalaj, kap veya ekipmanı dahil) ve mallar
üzerinde menfaati veya ilgisi bulunan veya bulunacak olan herhangi bir kişiyi ifade eder.
Kişi Gerçek kişi : tüzel kişi veya tüzel kişiliği olmayan şahıs kuruluşlarını ifade eder.Bir maddeye yapılan atıf, İşbu Koşulların herhangi bir maddesine yapılmış sayılır.
Serbest süre : 3 gun ucak kargolar icin/ 7 gun konteyner kargolari icin
Günlük ardiye ücreti : 2500F/m3/gun
Taşıma ve depolama giderleri : ……………………………...euro/kg ucak kargo icin / …………………….………euro/ m3 konteyner icin
Max. depoda kalma süresi : 90 jours
2. (A) Aşağıdaki Madde 2 (B) 'ye tabi olarak, Şirket’in iş akışı süresince ivazlı veya ivazsız olarak yürttüğü tüm faaliyetleri İşbu Koşullara tabi olarak gerçekleştirilir.
(B) Malların uluslararası taşınmasına ilişkin herhangi bir uluslararası konvansiyonun veya üstlenilen herhangi bir iş için zorunlu olarak uygulanması gereken başka bir mevzuatın olması
durumunda, İşbu Koşullar, bahse konu işlere ilişkin olarak sözkonusu mevzuata tabidir ve İşbu Koşullardaki hiçbir hüküm, Şirketin söz konusu mevzuat kapsamındaki herhangi bir
hakkından veya muafiyetinden feragat ettiği şeklinde yorumlanmayacak ve İşbu Koşulların herhangi bir kısmının söz konusu mevzuata herhangi bir ölçüde aykırı olması halinde, bahse
konu işle ilgili olmak kaydıyla İşbu Koşulların bu kısmı sadece bu kapsamla sınırlı olmak üzere geçersiz kabul edilecektir.
Azami depolama süresi aşıldığında, TES LOGISTIC, geri-teslim alınmayan malların satisini yapma ve satistan elde edilecek gelir ile musterinin cari borcundan dusmek amaci ile
mallarin müzayedes yolu ile satisina veya bir müzayedeci atama hakkını saklı tutar.
3. Müşteri, malların sahibi veya sahibinin yetkili temsilcisi olduğunu ve ayrıca bu İşbu Koşulları sadece kendi adına değil, aynı zamanda malların sahibi adına onun temsilcisi olarak
kabul ettiğini taahhüt etmektedir.

4. Malların Sahibi, Müşteri’yi Şirket ile herhangi bir sözleşme yapma konusunda ve/veya sözleşme kapsamında Şirket tarafından sunulan herhangi bir belgeyi kabul etmesi konusunda
yetkilendiriken, “İşbu Koşullar”ı kendi adına ve temsilcileri adına ve yetkili temsilcilerinin adına hareket ettiği herhangi bir üçüncü taraf adına kabul etmektedir. Bilhassa ve fakat bu
maddenin geneline halel gelmeksizin, Şirketin bu şahısların hepsini, Müşterinin “İşbu Koşullar” altında doğan her türlü sorumluluğu için müştereken ve müteselsilen sorumlu
tutabileceğini ve Müşterinin ödemesi gereken herhangi bir tutarı öncesinde usulünce talep etmiş olmak kaydıyla bunların hepsinden tahsil edebileceğini kabul ve taahhüt eder.

5. Şirketin temsilcisi ve yetkisi;

Merkezi Türkiye Cumhuriyeti'nde olan TES TRANS ULUSLARARASI NAKLIYAT TIC.LTD.STI Şirket'inin varış ülkesindeki temsilcisi, (TES) TERANGA EXPRESS SERVICES Suarl., ürünlerin
varış ülkesindeki yetkili temsilcisidir ve şirketin hak ve menfaatlerini korumak için tam yetkiye sahiptir.
6. Müşteri sorumluluğu;
Malların Türkiyede belirlenen depoya tesliminden, gönderildiği ülkeyedeki depoya teslim alınıncaya kadar olan süreçteki sorumluluk ‘şirkete aittir’. Varışı Türkiye depoya veya malın
gönderidiği ülkedeki depoya ulaşmış malların sorumluluğu müşteriye aittir. Varışı gerçekleşmiş bildirimi müşteriye yapılmış olan gönderilerin alınmaması unutulması veya alıcıya
ulaşılamayan durumlarada şirket tarafından belirlenen serbest sürenin dolması taktirinde, şirket tarafından belirlenmiş ardiy e masrafları, ekstra depolama ve taşıma giderleri
müşteriye/alıcıya yansıtılacaktır.
Gönderici tarafından mal teslimı sırasında göndericinin beyan ettiği mal cinsi dikkate alınır. (uluslararasi anlasmalar ve kanunlarca tasinmasi yasakli olan veya tasimasi ozel izne tabii
olan kargolarin tasinmasindan dogacak tum sorumluluklar musteriye aittir) Aksi bir durum söz konusu olursa sorumluluk tamamen gönderici ve alıcı/ müşteri sorumluluğundadır.
Oluşacak ulusal veya uluslararası cezai durumlarda şirket sorumluluğu içermez.
Birdirimi yapılmış serbest süresini aşmış ve şirketin belirlediği ‘max. depoda kalma’ süresini geçmiş tüm malların tasarrufu tamamen şirkete aittir. Belirlenen koşullar dışında gönderici
ve alıcı hak idda edemez.
Şirket taradından belirlenen ‘SERBEST SÜRE’, ‘ARDİYE MASRAFI’, ‘TAŞIMA VE DEPOLAMA GİDERLERİ’ zaman zaman değişkenlik gösterir ve taraaflar iş bu koşullarda durumu Kabul
etmiş olur.
Not: İlgili tüm masraflar önceden ödenmeden hiçbir mal teslim edilmez, aksi takdirde yukarıda belirtilen süreler içinde günlük cezalar uygulanacaktır.
