Résumé

L’article 29 pose l’imprescriptibilité des crimes dont la Cour peut connaître. L’analyse du
fondement et de l’émergence du principe en droit international permet d’évaluer l’apport et la
fonction de sa consécration dans le Statut. L’étendue du principe a divisé et divise encore les
juristes tant sur un plan théorique que pratique.

Abstract

According to Article 29 the crimes within the jurisdiction of the Court are not subject to any
statute of limitations. The commentary analyzes the basis and emergence of the principle in
international law so as to assess the contribution and function of its insertion into the Rome
Statute. It turns out that jurists were and still are divided on the scope of the principle in theory
and in practice.
