L'art. 107 du CPC
c. Le droit de la défense
Toute personne arrêtée ou placée en garde à vue a le droit
d'être informée des motifs de son arrestation et de ses droits,
y compris le droit d'informer son avocat ou toute autre
personne de son choix. Ce droit est mentionné dans un
procès-verbal d'interrogatoire par l'enquêteur. 11
L'entretien par l'enquêteur ou le procureur est le principal
car, dans la procédure, il est considéré comme une phase
essentielle de l'enquête de police (le premier maillon de la
longue chaîne qui constitue le processus pénal), de l'enquête
préliminaire ou même du procès. Elle conduit, lorsqu'elle est
correctement menée, à la recherche de la vérité juridique.
Cela implique, comme vous pouvez l'imaginer, une
préparation.
I.3. Phase préparatoire de l'entretien avec le suspect
Il est important de respecter les règles suivantes :
• garder à l'esprit tous les faits connus ;
• Vérifiez tous les détails ;
• ayez à portée de main toutes les déclarations écrites et
tous les échantillons disponibles afin de pouvoir les
utiliser si nécessaire ;
• une connaissance approfondie du casier judiciaire de
l'accusé, en effectuant des vérifications dans le service
du casier judiciaire et en menant des enquêtes sur la vie
sociale.
I.3.1. Connaissance du casier judiciaire de l'accusé
A. Questions positives
Une question positive est une question à laquelle une
personne ne peut avoir peur de répondre. Il est donc
recommandé à l'enquêteur de poser ces questions de
manière positive et d'éviter les questions accusatrices,
sarcastiques ou menaçantes.
Par exemple : "Qu'est-ce que vous (voulez) dire ?" Au lieu
de : "Je ne comprends pas ce que vous essayez de dire.
Pourriez-vous essayer de me l'expliquer d'une autre
manière ?"

Q1. Now I would like to hear your responses to the charges against you. The
charges levelled against you are as follows:
-Formation of a criminal gang for the purpose of preparing offences against
persons or property (in Kinyarwanda: kurema umutwe w'abagizi ba nabi
bagambiriye kugirira nabi rubanda n'ibyabo), provided for under Articles 681-
682 of Organic Law № 01/2012/OL of 02/05/2012 instituting the Penal Code (of
Rwanda).
- Fraudulent withdrawal of electronic data (in Kinyarwanda: Icyaha cyo
gutwara ibintu biri muri mudasobwa nta burenganzira), provided for under
Article 307 of Organic Law № 01/2012/OL of 02/05/2012 instituting the Penal
Code (of Rwanda).
R1. Forming a gang, I di not do such thing. Fraudulent withdrawal of electronic data, I
did not do such things and I do not know anybody in ACCESS Bank Rwanda; the
3rd chage: Using electronic data for granting property, I did not do such thing, I
even do not have an idea on how to hack, etc.
Q2. You have told me that you first came to Rwanda for visa change, does it mean that
you wanted to get a Rwandan passport
R. No, the first change of Visa I made it was in Kish in Iran; it was a 03 months’ visa, and when
I came to Rwanda I needed a resident permit.
Q3. You mean that you first came to Rwanda from Iran or from Nigeria?
R. I came to Rwanda from Dubai, when UAE visa expired, then I came to Rwanda to enable
my agent in Duabai to process my residence visa in UAE. The Process in Dubai is that when
your visa to live there expires, you have to exit, to leave the country. In order to renew the visa,
or get another one, you choose any country of your choice, and from that country, you can apply
for another visa to enter in UAE. That is what happened, I chose Rwanda because someone told
me that it was beautiful place, in terms of country and people
Q4. Was it in what year?
R. It was in 2014, then they gave me a one month visa to enter into Rwanda at the Kigali
international airport immigration office; before coming to Rwanda, I had applied for residence
visa while in Dubai; after the one month in Rwanda, I requested for extension because my visa
in Dubai was being delayed, then I was given another 3 months in Rwanda. My agent in Dubai
told me that there were some documents I should sign because the rules had changed, that is
why I went back to Dubai from Rwanda, to sign those papers, then I came back to Rwanda.
Since the 03 months were still valid, I stayed in Rwanda, in a hotel called Mount Kigali Hotel
situated in Nyamirambo. (from lawyer: now it is called HEART LAND HOTEL). Meanwhile,
the Resident Permit or Visa was issued in UAE, I quitted Rwanda for UAE to live there until
today.
Q5. While in Rwanda, you continued doing business, so that you needed to open bank
accounts in Randa, can you confirm that?
R. I was not doing business, because I did not expect to stay this long; but I needed to receive
money so as to pay my Hotel bills, and feeding bills, and so on. So I had to open an account;
and I opened it in ECOBANK; I opened one account in my name, but in three parts: in Dollars;
local currency account; and personal accounts, even if the account numbers are different, but
they are under one name.
Q6. Since you were staying in hotel without doing anything as a job, can you tell us who
was to transfer money to those accounts in Ecobank for you ?
R.My cousin Chris ANYAGALIGBO, who lives in USA, his company is called SAN –VAL
Inc. He wa an aeronautical engineer.
Q7. While in Rwanda you got connected to Mr. Azubuike Ejike Jude and Mr. Emeka,
who were in Rwanda at that time. Do you have any family relationship with them?
R. I got connected to them, but there is no family relationship with any of them; I asked the
staff of the hotel where I was if there could be some Nigerians around, then they showed me a
shop where those Nigerian guys were selling second hand items. Then I realized that I share the
same tribe with them.
Q8. Coming back to the fraudulent acts that affected the ACCESS Bank, before that
fraud, you personally telephoned some people in Rwanda asking them to provide their
bank accounts to you: tell us what did you do with those accounts?
R. Like I have said before, I did not initiate to call anybody to give me accounts; rather, Mr.
Emeka called me asking if He can use my account to receive money, I do not know from
where; then I called the Ecobank manager to help me find the status of my accounts; his
number was not going through; then I called Mrs. Gloria, who was the account officer who
opened the account for me; She picked and confirmed that the manager is no longer in the bank;
and herself also is no longer in the bank. Then she suggested that she directs me to somebody
else in the bank who will help me check the status of the account. She gave the phone number
and name of an officer called Fred. Then I called Fred; Fred confirmed that my account was
dormant, but could be reactivated. He now requested I send my passport, and fill in the Bio –
data Form, and send them back to him. Since he had sent me that form, I filled it in, and sent it
back to him together with a copy of passport. After about 2 or 3 weeks, my account was not
reactivated, them Emeka was repeatedly calling, asking me to give account; then I called Fred
who told me that he has done his job, he had passed the files to other tables for approval. I told
Emeka, that if my account cannot be used until it is reactivated, I can ask this man (Fred) if you
can use his account, if he accepts will you use it, then Emeka said yes.
Then I called Fred and I told him that there are in Rwanda some brothers, Nigerians, who want
to receive money using my account, then since it is not reactivated, can you help them by
collecting the money from them, and they told me that you would get a commission of 5% of
the sent money. Fred accepted to provide his own account to me, then I provided it to Emeka.
Then I gave them the phone number of Fred and I gave to Fred the phone numbers of Emeka
and of Ejike. I remember Fred told me that he had two (02) accounts, one in Ecobank the other
in another Bank; He told me that he was going to provide them with an account with that other
bank, but I cannot remember the concerned bank
Q9. Can you tell us full identification of Emeka ?
R. I only know the name of Emeka, nothing else, but for sure Ejike Jude knows him very well,
because they live together and they have a shop which they pay together.
Q10. After playing this role of connecting, Fred to Ejike and Emeka, did you once again
enter into contact with friend Gloria?
R. Initially I tried to call her by phone and by WhatsApp, it went through but without for her
picking.
Q11. Let me tell you one thing: Gloria confirmed that after directing you to Fred, you
continued to talk to each other, by phone and by WhatsApp chat. Is she lying?
R. I have said: when Fred stopped picking phone; it is the same for Ejike and Emeka and Gloria;
they all stopped picking phone. Otherwise, before I used to talk to her
Q12. Do you know the date when access bank account in BNR was hacked?
R. No, I don ‘know
Q13. It is on one night some where in November 2017, and you are suspected to be behind
all those operations from Dubai; what do you say about it ?
R. I am not behind any Operation with ACCESS bank.
Q14. The account that Fred provided to you received more than Frw 70, 000,000. Do you
think that this amount of money was sent by Emeka, or Ejike, if you deny having done
so?
R. Emeka asked me to provide an account; and I connected him to Fred; Fred is a banker, if the
money is mine I would ask him to pay it in my account, he who is in the process of activating
my account; if I am the one who sent the money., I would allow Fred to put it into my account
which is in the process of being activated, or as a banker he is the one who has the capability
and ability and experience to handle money transfer, why will I then connect him to Emeka and
Ejike and ask them to collect money for me. I would have asked him to send it to me anywhere.
Q15. Ejike and Fred (KAMUSHANA) are now in pre – trial detention for this matter.
They claim that they are innocent; while Fred received, as said above, more than 70
million frw, part of hacked money of ACCESS bank from BNR what is your opinion
regarding their claim?
R. If I give my honest opinion, Fred does not know where the money came from. Because I was
also asked to provide my account, and it is in that process I wanted to reactivate my account
which was not possible and then I asked Fred to provide his to those that had asked me to
provide mine being Emeka.
Q16. You, who asked you to provide your account?
R. Emeka asked me, and he was in Rwanda
Q18. You told Fred and Gloria that you wanted to open a business in Rwanda. Did you
not?
R. No, I did not tell them that.
Q19. When you met in Rwanda a Nigerian person called OLUBUNMI ADEBISI Jaiyeola
what did you speak about?
R.I do not know him, and I did not see him before; I left Rwanda back in 2015, and I had not
met that person.
Q20. Can you describe to us briefly how you got to know a Nigerian person who is called
Yemi Bello?
R. I confirm that I do not know him, nor have I seen him before; I he tells you that he knows
me, the all what I have told you, take it as lie.
Q21. Let us stop here, for continuing later if possible, but before ending, do you have
something to add on?
R. There is no link whatsoever between me and those name like Adebisi and Yemi Bello. I want
to plead that I be acquitted of this accusation, because I don’t know anything on how this money
was hacked, or have a pre-knowledge that this money was to be a hacked money; what I did is
to make my account reactivated AND THANK God that it was not possible.

Briefly what I can say on allegations brought against my client is that he never
participated in any of those allegations, depending to what himself has told the
prosecution. We request the prosecution, in its integrity to carry on serious
investigation, on the actual people that committed those crimes. Because, they are
hiding themselves behind other people’s names like Emmanuel OHIRI. The next
thing, we humbly request the prosecution, to provisionally release my client Ohiri,
referring to Art 105 of the Crim Procedure; interpreting it using Art 89 of the Crim
Procedure, that sets the main principle of a suspect to remain freed during
investigation. But in the interest of Justice, we request also the prosecution to refer
to Art 107 of the Criminal Procedure, that sets up the judicial supervision to a
suspect that is in a provisional release. This would enable my client to well follow
on his health situation, because he has a problem of diabetes, and cholesterol, that
is escalating to a risk zone on his life.

• Il faut également se demander si le témoin est intelligent, s'il a
écouté le récit des événements par d'autres personnes ou par les

affecter sa capacité à raconter un événement.
• Y a-t-il des divergences entre ce que le témoin a dit à la police/au
Bureau d'enquête du Rwanda (RIB), au Bureau du procureur ou
au procès et ce qu'il a dit, par exemple, dans une déclaration
extrajudiciaire ?
• Le témoin a-t-il un souvenir indépendant des événements ou
s'appuie-t-il uniquement sur des notes ? Les notes pourraient
même être les affaires de quelqu'un sur lesquelles le témoin se
base !
• Il ne s'agit pas d'une liste exhaustive de considérations ; de
nombreux autres facteurs peuvent affecter la fiabilité,
comme par exemple le témoignage d'un témoin qui a été
soudoyé, sous l'influence de l'alcool ou de drogues au
moment des faits.
• En ce qui concerne la crédibilité, il existe certains indices
de crédibilité qu'un enquêteur peut utiliser pour déterminer
la véracité d'un témoin.
• Il peut s'agir par exemple d'un casier judiciaire contenant
des infractions de malhonnêteté, d'un certain motif ou d'un
intérêt pour l'issue du procès.
• D'autres comportements tels que la partialité, la conduite,
le comportement, la collusion ou des incohérences flagrantes
dans des déclarations antérieures peuvent coûter la
crédibilité d'un témoin et faire échouer votre affaire.
• Certains ou tous ces facteurs peuvent se combiner pour
amener un enquêteur à conclure que la déposition d'un
témoin peut être acceptée ou non dans le cadre du
• Après avoir donné leurs coordonnées personnelles, les témoins
sont interrogés un par un sans la présence du suspect. La main
droite levée, le témoin prête le serment suivant : "Je....................
jure de dire la vérité. Si je ne respecte pas ce serment, je subirai
les rigueurs de la loi". Le témoin qui refuse de prêter serment
est passible des peines prévues par le Code pénal du Rwanda.
Les déclarations du témoin sont consignées par écrit. Toute
personne ayant participé à la commission d'une infraction peut
être entendue comme témoin2 .

La fiabilité et la crédibilité sont deux aspects importants
pour déterminer la véracité et l'exactitude du
témoignage d'un témoin.
Il est également important de noter qu'un témoin
crédible n'est pas nécessairement toujours un témoin
fiable et qu'un témoin dont le témoignage n'est pas
crédible sur un point particulier ne sera pas non plus un
témoin fiable sur ce même point.
La fiabilité d'un témoin peut être affectée par un certain
nombre de facteurs.
II.1.18.Types de questions pour les témoins
1. Questions ouvertes
Ces questions encouragent le client à fournir un
récit des événements ou une explication détaillée ou
encore à donner des informations détaillées dans sa
réponse. Ce sont des questions d'aperçu ou de
résumé utilisées pour obtenir un aperçu général d'un
événement ou d'une situation. Elles sont souvent
utilisées au début de l'entretien afin de faire parler la
personne. Exemple : pourquoi ne pas commencer
par me raconter ce qui s'est passé ce jour-là, tel que
vous vous en souvenez.
Non pas qu'ils puissent aussi être utilisés pour
faire parler le client : exemple : que s'est-il passé
ensuite ?
